AGENDA ITEM: Adoption of revised Evaluation and Appraisal Report

BACKGROUND: The City adopted an Evaluation and Appraisal Report (EAR) of the
Comprehensive Plan in September of 1997, which was determined to be insufficient in
addressing the minimum requirements of Chapter 163.3191, Florida Statutes.
This revision to the adopted Evaluation and Appraisal Report is intended to address the
requirements of Chapter 163.3191, as revised in 1998, in order to allow the City to proceed
with needed amendments to the adopted Comprehensive Plan. This revision to the adopted
EAR has been considered at three public hearings before the Community Development Board.
The Community Development Board recommended approval of the revised EAR and
transmittal to the Department of Community Affairs at its regular meeting on January 21,
2003. The City will begin the process of required and appropriate Comprehensive Plan
amendments, including an updated GIS map series, immediately following a finding of
sufficiency by the Department of Community Affairs.
BUDGET: Professional Service funds in the amount of $15,000 (Acct. 001-1005-515.31-00)
are budgeted for the Comprehensive Plan amendment process. It is anticipated that Staff will
prepare portions of the Comprehensive Plan amendments, and the budgeted funds will be used
for consultant services to assist with certain technical portions of the amendment process,
particularly revisions to the Transportation and Coastal Management Elements.
RECOMMENDATION: Motion to approve Resolution Number 03-03 adopting the revised
Evaluation and Appraisal Report and authorizing transmittal to the Department of Community
Affairs for sufficiency review.

A RESOLUTION OF THE CITY OF ATLANTIC BEACH,
FLORIDA ADOPTING AN EVALUATION AND APPRAISAL
REPORT FOR THE CITY OF ATLANTIC BEACH
COMPREHENSIVE PLAN, REVISING THE PREVIOUSLY
ADOPTED EVALUATION AND APPRAISAL REPORT AS
ADOPTED BY RESOLUTION NUMBER 97-34; STATING THE
INTENT OF , THE CITY COMMISSION TO AMEND THE
COMPREHENSIVE PLAN BASED UPON RECOMMENDATIONS
CONTAINED IN THE REPORT; AND APPROVING
TRANSMITTAL OF THE REPORT TO THE DEPARTMENT OF
COMMUNITY AFFAIRS IN ACCORDANCE WITH SECTION
163.3191, FLORIDA STATUTES.
WHEREAS, the Florida Legislature intends that local planning be a continuous and
ongoing process; and
WHEREAS, the City Commission of the City of Atlantic Beach has adopted the City of
Atlantic Beach Comprehensive Plan, Ordinance No. 95-90-48 on December 13, 1990; and
WHEREAS, Section 163.3191, Florida Statutes, directs local governments to
periodically assess the success or failure of the adopted plan to adequately address changing
conditions and state policies and rules; and
WHEREAS, Section 163.3191, Florida Statutes, directs local governments to adopt
needed amendments to ensure that the plan provides appropriate policy guidance for growth and
development; and
WHEREAS, the Community Development Board, acting as the designated Local
Planning Agency, has reviewed the Evaluation and Appraisal Report, held advertised public
hearings, provided for participation by the public in the process, and rendered its
recommendations to the City Commission; and
WHEREAS, the City Commission has reviewed the revisions to the previously adopted
Evaluation and Appraisal Report, held an advertised public hearing, and provided for comments
and public participation in the process in accordance with the requirements of state law and the
procedures adopted for public participation in the planning process;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS:

Section 1: The City Commissioner does hereby adopt the revised Evaluation and
Appraisal Report, attached hereto as Exhibit A.
Section 2: The City Commission does hereby state its intention to amend the City of
Atlantic Beach Comprehensive Plan Ordinance No. 95-90-48 in accordance with .the
recommendations contained in the Evaluation and Appraisal Report.
Section 3: The City Commissioner does hereby approve transmittal of the Evaluation
and Appraisal Report to the Department of Community Affairs for the purpose of a sufficiency
review in accordance with Section 163.3191, Florida Statutes.
Section 4: This Resolution shall become effective immediately upon its passage.
Section 5: All Resolutions and parts of Resolutions in conflict herewith are repealed.
