VALERIE JONES, Administrative Assistant. 2 1 PROCEEDINGS November 21, 2017 6:55p.m. 2 * * * * * 3 THE CHAIRWOMAN: Our next agenda item is 4 Item 4B, ZVAR17-0010, and I will turn it over 5 to staff. 6 MR. BROEDELL: Good evening, board. 7 So good news, this is not in a PUD. 8 So this is a variance to allow a 6-foot 9 fence in the front yard at 1505 $elva Marina 10 Drive. This property is in the RS-L, large lot 11 zoning district. Future land use, Residential 12 Low Density. And it is a corner lot that 13 fronts both Selva Marina Drive and Seminole 14 Road. 15 And the City code defines corner lots as 16 abutting two or more streets, and then it goes 17 on to explain that the exterior lot line of the 18 narrowest side of the lot adjoining the street 19 shall be considered the front of the lot. So, 20 with that, that makes the southern property 21 line that fronts --or abuts Seminole Road the front of this property by code. So the proposed plan is to install a 24 6-foot-tall wood fence to run along this 25 southern front property line (indicating), Diane M. Tropia, Inc., Post Office Box 2375, Jacksonville, FL 32203 (904) 821-0300 3 1 before it kind of makes a turn and then runs 2 back to the house. 3 So the need for a variance is Section 4 24-157, within required front yards the maximum 5 height of any fence shall be 4 feet; and then 6 within required side or rear yards, the maximum 7 height of any fence shall be 6 feet. 8 So as I stated with -­how the City code 9 defines the front yard for corner lots, this 10 6-foot fence would be -­is in their required 11 front yard. 12 So the proposed fence along this southern 13 property line would be over 30 feet from the 14 pavement of Seminole Road. And as you can see 15 from this aerial, the property is a good 16 distance away from the intersection of Selva 17 Marina and Seminole Road. So sight line issues 18 are pretty minimal. 19 Continuing with that, the -­if you can 20 see that hedge in these three pictures, the 21 hedge is on right-of-way, City property, so the 22 majority of this proposed fence would be placed 23 behind that hedge, before it comes out a little 24 bit more and then runs back to the house. So, 25 again, minimizing sight line issues even more. Diane M. BROEDELL: Yes. 6 BOARD MEMBER SIMMONS: (Off microphone.) 7 Another question, how many (inaudible) are 8 there between the sidewalk and the property 9 line of the proposed fence? 10 MR. BROEDELL: That, I don't know. 11 Based on just kind of eyeing it, while I 12 was out there, it's probably about 5 feet, but 13 that's -­that's really just based on walking 14 out there. It doesn't say on the survey or-­ 15 BOARD MEMBER LANIER: I can comment on 16 that. Again, it's my 'hood. 17 That's a really mature ligustrum hedge. I 18 believe it's ligustrum, maybe viburnum. And I 19 remember when that was planted. And it's 20 gotten really mature and it's -­it really is 21 right -­it's very close to the sidewalk. And 22 so if it's on the City right-of-way, then I 23 would guess this proposed fence would be back 24 about 5 feet from the sidewalk, possibly? 25 MR. BROEDELL: Yeah. Diane M. I know it's, obviously, behind the hedge. And, again, based on just going out 5 there, it looks like it would be at least 6 5 feet from the sidewalk. 7 BOARD MEMBER LANIER: And the City did not 8 plant that hedge, correct, or do you know? My 9 guess is not. 10 MR. BROEDELL: Yeah, I'm not sure. 11 THE CHAIRWOMAN: Do you guys have any 12 additional questions for staff? 13 BOARD MEMBERS: (No response.) 14 THE CHAIRWOMAN: No. All right. 15 Thank you. 16 MR. BROEDELL: Uh-huh. 17 THE CHAIRWOMAN: All right. If the 18 applicant is here and would like to make a 19 statement. 20 (Audience member approaches the podium.) 21 AUDIENCE MEMBER: Hi. 22 I'm Lori Gaglione. I live at 1505 Selva 23 Marina Drive. 24 So, as he stated, my property is unusually 25 configured because the --the home is built Diane M. Tropia, Inc., Post Office Box 2375, Jacksonville, FL 32203 (904) 821-0300 6 1 facing Selva Marina Drive. Our address is 2 Selva Marina Drive. Our door opens to 3 Selva Marina Drive. Our driveways are on 4 Selva Marina Drive. 5 And it was unbeknownst to me--Seminole 6 Road's considered our front yard. So when we 7 had all these plans drawn up to do the fence, I 8 had no idea. And so, of course, when the 9 permit was denied, I was told we needed to get 10 the variance. 11 Okay. So the plan is to come in right 12 behind the hedge so that --and I brought a 13 picture of another property at the beach that's 14 got a similar sort of configuration with a 15 fence inside of a hedge line, which is --and 16 this is kind of the style fence that we're 17 proposing (indicating). 18 And I submitted a bunch of pictures with 19 my --I don't know if you guys all got that. 20 I -­ 21 THE CHAIRWOMAN: Yes, we did. MS. GAGLIONE: Okay. THE CHAIRWOMAN: There were a variety of 24 pictures sent in our packet. 25 MS. GAGLIONE: Yeah. I was trying to sort Diane M. We're 4 trying to make a backyard because right now, 5 you know, it's just kind of an open property. 6 Everybody on Seminole Road can see into our 7 backyard. You can see in from the front. You 8 can see along the sides. So we're trying to 9 just, you know, create privacy and create a 10 beautiful backyard that we're going to do all 11 sorts of things in -­in terms of improvements, 12 but that's sort of the gist of why we're trying 13 to get a 6-foot fence, so that -­so we can 14 have privacy, and so my--so I can feel safe 15 with my children running around back there 16 with -­you know, not -­no one can see over or 17 see through the hedge. 18 I don't know who owns that hedge, but I 19 know the City maintains it, which is part of 20 the reason why we -­initially, we weren't sure 21 we even needed a fence because that hedge was 22 nice and thick, but the City came through and 23 just sort of gutted it. And so then it really 24 opened up our backyard. And you hear traffic, 25 you see everybody walking along, which is fine, Diane M. Tropia, Inc., Post Office Box 2375, Jacksonville, FL 32203 (904) 821-0300 8 1 but I have young children, and so, you know, 2 there's safety issues, but -­so that sort of 3 pushed us over the edge of wanting to put up a 4 fence there, so -­ 5 But, you know, we're trying to beautify -­ 6 we have a whole plan to redo that -­the whole 7 house, and this is just part of it. We're not 8 just putting up a fence. I'm doing a whole 9 redo on the exterior of the home. 10 And so I tried to provide pictures so you 11 can see it. It's sort of a rundown condition. 12 It's a really neat mid-century house, but 13 it's--you know, it--it needs an update, so 14 that's--this is just part of that plan. 15 THE CHAIRWOMAN: Thank you. 16 You guys have any additional questions for 17 the applicant? 18 BOARD MEMBER SIMMONS: (Off microphone.) 19 I drove by, you know, both streets, both 20 (inaudible). And it appears to me that that's 21 a very, very small backyard. Given the shape 22 of the lot and the position of the house, that 23 a lot of your yard space down here, on this 24 point -­where you wouldn't be allowed 25 (inaudible), you wouldn't put -­place that, Diane M. GAGLIONE: Agreed. BOARD MEMBER SIMMONS: (Off microphone.) And that you'd have a hard time setting 5 that fence back to have any (inaudible) -­ 6 MS. GAGLIONE: Absolutely. 7 And we planted a lot of fruit trees right 8 along in there that was part of sort of the 9 master plan to create this park environment in 10 our backyard, and it would --if I have to come 11 ten feet within the fence, my fruit trees are 12 going to be outside my fence, so that's not 13 going to work. So -­ 14 And it --I don't --I just don't think it 15 would --I don't think it would look nice 16 ten feet in. If you see the property-­ 17 especially not with that hedge there, because 18 you'll have a tall hedge, ten feet, and a 19 fence. It's not --it's going to look weird. 20 So, to me, it just made perfect sense to 21 come right in behind the hedge. You've already 22 got a --a visual line there. I'm just 23 mimicking it and sort of cleaning it up, I feel 24 like, trying to make it look more, I don't 25 know, attractive, from --from the street Diane M. It needs some love. 4 THE CHAIRWOMAN: All right. You guys have 5 any additional questions for the applicant? 6 BOARD MEMBERS: (No response.) 7 THE CHAIRWOMAN: Thank you. 8 MS. GAGLIONE: Thank you. 9 THE CHAIRWOMAN: I'd like to take this 10 time to open this up to public comment. 11 Is there any public comment on this 12 variance? 13 AUDIENCE MEMBERS: (No response.) 14 THE CHAIRWOMAN: It appears there is no 15 public comment. 16 MS. GAGLIONE: I meant to --I'm sorry, I 17 forgot. 18 THE CHAIRWOMAN: Please. 19 MS. GAGLIONE: I did speak with four of my 20 neighbors, and I have their addresses and names 21 that I can tell you --so I spoke with the "" four --the two directly across the street from me at 1510 and 1520, and the two to my side, 24 1515, 1525. I explained exactly what I was 25 doing and I showed them my pictures. None of Diane M. GAGLIONE: Thank you. 7 THE CHAIRWOMAN: I'd like to take this 8 time to close the public comment portion and 9 bring it back to the board for discussion and 10 motion. 11 BOARD MEMBER LANIER: So I feel like I'm 12 doing all the talking tonight, and I'm not sure 13 why, but maybe because they're all in my 14 neighborhood. 15 So that's really unfortunate about the 16 hedge because that was a pretty good-looking 17 hedge for a long time, and I didn't know who 18 slaughtered it, but-­ 19 MS. GAGLIONE: It wasn't us. 20 BOARD MEMBER LANIER: Okay. Thank you. 21 I remember Dr. McKay (phonetic) used to 22 live in this house. He built this house, yeah, 23 and it is -­it is a wonderful -­to me, a 24 wonderful example of the kind of homes that 25 were built in that sort of golden 1950s, 1960s Diane M. It's a beautiful house 2 and I hope you're going to keep the character 3 of the house when you remodel it. 4 You know, there are rules and then there 5 are rules that make sense. And the fact that 6 the Seminole Road side of the house is the 7 front of the house -­I mean, I get it, that 8 that's a rule, but you could -­if a hundred 9 people stood in front of the house and you 10 said, where is the front of the house, they 11 would say it's Selva Marina Drive. 12 And it's -­this house is parallel to all 13 the other houses that go right up that side of 14 the street. I mean, there's nothing about this 15 house that says the front yard is Seminole 16 Road. So I would be inclined to say, you know, 17 go ahead and build a fence behind the hedge. I 18 think that makes a lot of sense. 19 I'm not sure about this chunk that sticks 20 out closer towards the street, but what I'm 21 seeing here is the property line. I'm not 22 seeing, like, the street and the sidewalk. I 23 don't know, like, how close this -­Derek, 24 could you put the -­the property picture back 25 up again? Diane M. REEVES: Or do you want the survey? 2 BOARD MEMBER LANIER: Okay. No, that-­ ., okay. So that yellow line is actually the property line? 5 MR. REEVES: I would not rely on that. 6 I'll go back to the -­ 7 BOARD MEMBER LANIER: Okay. 8 MR. REEVES: The lower corner there is the 9 survey. That one's more accurate. 10 BOARD MEMBER SIMMONS: (Off microphone.) 11 This is the --because you've got where 12 the fence -­ 13 BOARD MEMBER LANIER: Okay. So one of my 14 concerns, when I saw this in our packet, was, 15 wait a minute, is there going to be a 6-foot 16 fence, like, coming out sort of into that nice, 17 little triangle that --the triangle does need 18 some --it needs some love. It's ratty and 19 it's full of ants and all that, but it looks to 20 me like the fence is not going to come out into 21 the triangle because that's not even your 22 property. 23 MS. GAGLIONE: Exactly. 24 BOARD MEMBER LANIER: Okay. That was my 25 biggest concern about this. Diane M. Tropia, Inc., Post Office Box 2375, Jacksonville, FL 32203 (904) 821-0300 14 1 So the fence is going to be up much closer 2 to the house, and I don't think it will be -­ 3 well, staff has already said it's not going to 4 be an obstruction for traffic, for the --for 5 the visual part of pulling in or out, and it's 6 not going to invade that little triangle there. 7 So I'm --I'm peaceful with this one. 8 BOARD MEMBER SIMMONS: (Off microphone.) 9 Do you see where the fence is drawn 10 (inaudible)? 11 BOARD MEMBER LANIER: Uh-huh. 12 BOARD MEMBER SIMMONS: (Off microphone.) 13 I'm not sure what triangle you're talking 14 about. 15 BOARD MEMBER LANIER: Below that--the 16 bottom curve there, so -­ 17 THE CHAIRWOMAN: There's quite a bit of 18 grass between -­ 19 BOARD MEMBER LANIER: There's--yeah, 20 there's --there was a -­ 21 (Simultaneous speaking.) "? THE CHAIRWOMAN: It's heavily grassed before it's paved. 24 BOARD MEMBER LANIER: Yes. There's a big, 25 grassy triangle there that--again, it needs Diane M. Tropia, Inc., Post Office Box 2375, Jacksonville, FL 32203 (904) 821-0300 1 to be prettier, but the fence does not invade 2 that triangle because that's not even her 3 property. 4 BOARD MEMBER SIMMONS: Thank you. 5 BOARD MEMBER LANIER: Yeah. See, that's 6 a --Derek is pointing to that big triangle 7 there. 8 BOARD MEMBER SIMMONS: Yes. 9 BOARD MEMBER LANIER: Yeah. So there's a 10 lot of property, actually, before you get back 11 to where the fence would be. 12 MS. GAGLIONE: (Inaudible.) 13 THE CHAIRWOMAN: Yes, ma'am, please. 14 MS. GAGLIONE: If I may, the house-­ 15 THE CHAIRWOMAN: You have to come up to 16 the microphone so we can hear you. 17 (Ms. Gaglione approaches the podium.) 18 MS. GAGLIONE: The home has a 40-foot 19 setback to Seminole Road. So where the fence 20 is going to come over to the, quote-unquote -­ 21 what I call the front of the --the front yard, 22 which is the front of the house, but it's 23 actually the side yard, that's 40 foot set back 24 off the road because that's what the setback is 25 on Seminole --on Selva Marina. GAGLIONE: So it's 40 foot back from 3 the property line, and then it's --there's 4 another 20 to 30 feet from that triangle. I 5 mean, it's --it's --I mean, it's just a 6 massive amount of property right there, so -­ 7 BOARD MEMBER LANIER: Yeah. 8 MS. GAGLIONE: It's not going to look even 9 remotely close to being on Seminole Road at the 10 front.· As it goes along the side, it's just 11 going to go along the hedge line and the 12 sidewalk, if that makes sense. 13 THE CHAIRWOMAN: Thank you. 14 BOARD MEMBER ELMORE: Before this train 15 leaves the station here, I will caution that 16 this is still a right-of-way where 6-foot 17 fences are not allowed. And the neighbor to 18 the northeast could come in here and ask for 19 the same thing, if we approve this variance, 20 and say, "I want to put a 6-foot fence along 21 the property line just like my neighbor to the 22 south did." 23 And, you know, this is one of these--I 24 get what the applicant wants to do, I 25 sympathize, and I would want the same thing. And it's not that this wouldn't --this 5 isn't needed, but we really are setting 6 ourselves up for everyone else on Seminole 7 Road, not to mention all the other streets -­ 8 as you remember we had this very controversial 9 one down here by the school a while back where 10 they wanted a 6-foot fence in the front yard 11 along the property line, and we-­ 12 THE CHAIRWOMAN: Made them tear it down. 13 BOARD MEMBER ELMORE: --denied it. We 14 made them tear it down after they put it up. 15 And, you know, this is what this board is 16 for, is to not get the City in trouble or set 17 precedence where someone can haul the City into 18 court saying, "Well, you gave it to them, you 19 have to give it to me." We're here as 20 guardians of the LDRs, and I think that, you 21 know, the setbacks are huge there, I agree. 22 And, actually, I--I'm working on a 23 property nearby and the sidewalk is actually 24 about 5 feet off the property line there, 25 but --neither here nor there, she can still Diane M. Tropia, Inc., Post Office Box 2375, Jacksonville, FL 32203 (904) 821-0300 18 1 put up a fence along the property line. It 2 just can't be 6 feet. It can be 4 feet. And 3 you can plant a 6-foot hedge behind it, or in 4 front of it if you wanted to, even. 5 So it's not like you're not getting 6 anything, but it's just the --as the codes 7 say, you can't have a 4-foot [sic] fence along 8 the property line, along the roadway. No 9 matter if there's 30 or 40 feet of grass 10 between it, it's just, you know, the language 11 in the code is no 6-foot fence along the 12 right-of-way. 13 THE CHAIRWOMAN: And there have been a 14 variety of other ones that were close to some 15 beach accesses that we told them you can have a 16 4-foot fence and plant a hedge. 17 BOARD MEMBER ELMORE: But I'm --I'm all 18 ears to change it. I just really caution that, 19 you know, we could get into some sticky 20 situations. If someone wants to come in and 21 put a 6-foot fence on the property line on .,~ Seminole, and the --one thing --the whole reason that ordinance is there is so that we 24 don't look at canyons of fences along our 25 roadways. I mean, 2 we --I remember many people coming in --that 3 new house at the end of 6th Street that came in 4 and they requested the 6-foot fence and we 5 said, no, put up a 4-foot and put the 6 landscaping in, and they did that, and it looks 7 great. So they have their privacy from the 8 combination of the fence and the landscaping. 9 BOARD MEMBER LANIER: You know, this 10 probably is not the time to do this, but when 11 codes are revisited, we--we've had the front 12 yard/side yard issues in front of us a few 13 times, where everything about a house says this 14 is the front yard, except the code, which says 15 it's not, it's a side yard. I think it was 16 2nd Street? 17 THE CHAIRWOMAN: We've had a variety. 18 BOARD MEMBER LANIER: We've had a bunch of 19 them. 20 THE CHAIRWOMAN: Many double-frontage lots 21 have aggrieved us at some point. 22 BOARD MEMBER LANIER: Yeah. So I'm hoping 23 that we can make that make a little bit more 24 sense maybe in the future because I think this 25 does confuse citizens, when they presume that Diane M. Tropia, Inc., Post Office Box 2375, Jacksonville, FL 32203 (904) 821-0300 20 1 when they look at their house and everything 2 about it, including the address, says this is 3 the front yard, and then they move ahead with 4 plans and find out, no, it isn't. As a matter 5 of fact, everything is different because your 6 front yard is over there. 7 I just think that's something that should 8 be addressed, but that's not an issue for us 9 this evening, but I'd like it to be sort of 10 bookmarked somewhere -­ 11 BOARD MEMBER ELMORE: And I agree. 12 And I sympathize with the homeowner here 13 because, in this instance, there's a tremendous 14 amount of land. It makes perfect sense to put 15 a fence there, but the problem is we have this 16 one-size-fits-all rule-­ 17 BOARD MEMBER LANIER: Yeah. 18 BOARD MEMBER ELMORE: --about fencing 19 where --you know, whether it's on 3rd Street 20 and East Coast or whether it's on Seminole and 21 Selva Marina Drive, it's--you know, we're 22 stuck with this code. And if we approve a 23 variance going against that, we really create a 24 lot of hardship for ourselves down the road, 25 and the City. Diane M. REEVES: I could provide a little more 2 insight to the other code provisions. ~ So on corner lots, the --we, obviously, have the front yard requirement, 20 feet back, 5 but the side yard adjoining the street also has 6 its own requirements. 7 In this case, because the right---both 8 right-of-ways are over 50 feet wide. They're 9 both 100-foot-wide right-of-ways. A 6-foot 10 fence has to be either 5 feet off of the 11 sidewalk or 15 feet off of edge of pavement. 12 So just giving you an idea, when we look 13 at these corner lot situations for fencing, 14 even the side yard does have some setback 15 requirements, the side yard that's adjoining 16 the street. It's at 5 feet from the sidewalk, 17 15 feet from the edge of pavement for the 18 street itself. So the code does kind of 19 consider it -­ 20 BOARD MEMBER ELMORE: Is that for a 4-foot 21 fence or a 6-foot? 22 MR. REEVES: That's for the 6-foot fence. 23 BOARD MEMBER STRATTON: But the 4-foot 24 fence could go in as proposed, where they're 25 proposing the current fence now, with no Diane M. I know 16 that, but at what point did the rule come along 17 that said if you have a corner lot, your 18 shorter--your shorter distance is your front 19 yard? Did that happen after this house was 20 built or before? 21 THE CHAIRWOMAN: I would say it would have 22 had to have happened after it because if you 23 knew that --building the house, that the 24 narrowest --your front of your lot was 25 considered the narrowest side, you would have Diane M. The first 14 is, addresses have nothing to do with the front 15 of the property as far as code definition. 16 That's why you see through-lots on Beach Avenue 17 that have Beach Avenue addresses and some have 18 Ocean Boulevard addresses. It's a choice 19 thing. The City, honestly--once you decide. 20 If you request a change, as long as you have 21 frontage on that street, we'll let you name it 22 or address it that way. 23 The whole reason we have this definition 24 of "corner lot" is really not for fences. That northern end is--it looks like 10.1 feet from the property line. That's technically the rear yard. It 5 should be 20 feet off. 6 Where this really comes into play is those 7 lots in North Atlantic Beach where it's 50 by 8 130 feet deep. If you say --and say that lot 9 is on the corner of 3rd and East Coast and the 10 shorter side is on 3rd, the longer side is on 11 East Coast, if you want an East Coast address 12 and the front of your home faces East Coast and 13 you apply those front yard setbacks and it's 14 only a 50-foot-wide lot, well, it's a 20-foot 15 setback in the front and 20-foot setback in the 16 rear, you end up with a 10-foot-wide buildable 17 area. 18 That is why we have the narrowest side is 19 the front. It's to determine those setbacks 20 and how that works. Fences have kind of fallen 21 into that as a way to regulate it and, you 22 know, how we determine the location as 23 appropriate. 24 But addressing, design of the house, all 25 of that, as far as where your front door is and Diane M. REEVES: Correct. 11 BOARD MEMBER ELMORE: Don't tear down your 12 garage. 13 BOARD MEMBER SIMMONS: You know, we have a 14 highly irregular property and code here, and I 15 know it's strange that it's right next door to 16 a property that could not have a 6-foot fence 17 there, but on the other hand, we have a great 18 family house there with crazy limitations due 19 to both shape of the lot and some craziness in 20 the code, and I --I think it's very 21 justifiable to give this variance. BOARD MEMBER LANIER: I am --unless somebody can provide evidence otherwise, I am 24 not convinced that the front yard rule about 25 which side is the front yard, I'm not convinced Diane M. They 15 get the security still, if they have pets that 16 are running around in the back, they don't want 17 to get out, and they still have all the privacy 18 with the mature landscaping. 19 BOARD MEMBER LANIER: I don't think the 20 tunneling effect on this piece of property is 21 an issue as it is in, like, some of the 22 numbered streets. We really are concerned 23 about the tunneling effect, and I know we've 24 talked about it on Section H. In some of those 25 areas we've talked about it. Diane M. There's a huge hedge, which is 12 probably 10 foot tall. The fence would be on 13 the other side of the hedge and wouldn't be as 14 tall as the hedge. So most of this, like this 15 much here (indicating) would be behind a hedge. 16 If we were going to ask the applicant to 17 do something different, we could maybe say, 18 would you not build the fence out quite so far? 19 Maybe keep it more towards the backyard than 20 the front corner of the house? I mean, I think 21 that might be a compromise, but that still 22 doesn't fix the front yard issue. 23 BOARD MEMBER ELMORE: Well, just so-­ 24 you've got to --I mean, the thing that strikes 25 me --I mean, I try to sympathize with every Diane M. And I have to tell you, if 17 anybody needed security and privacy to keep 18 kids from throwing trash and things in their 19 yard, that would have been someone --and we 20 told them, no, you can have a 4-foot fence with 21 a hedge. .,.., BOARD MEMBER SIMMONS: I have-­ BOARD MEMBER LANIER: I don't remember 24 that. 25 BOARD MEMBER SIMMONS: I have a real Diane M. It's kind of a long -­ 18 BOARD MEMBER SIMMONS: I'm sorry, I 19 can't-­ 20 BOARD MEMBER ELMORE: --ranch (inaudible) 21 house with a metal roof -­ 22 BOARD MEMBER SIMMONS: I'm sorry, I 23 can't-­ 24 BOARD MEMBER ELMORE: --but the lot is 25 the same thing. So imagine putting a 6-foot fence 8 along their, quote, side yard there. And 9 that's really wide open. You'd see that big as 10 life and then, I mean, they could say, "Well, 11 you did it down the street, why can't I do it 12 here?" 13 It's actually Tad Chance's (phonetic) 14 house. I don't know if you know Tad or not, 15 Tad and Karen Chance. 16 You know, I would love to grant this 17 variance, and there's a lot of me that could be 18 convinced otherwise. I'd have to have the 19 support of staff and, you know, playing some 20 gymnastics with the verbiage a little bit, but 21 I --I'm really concerned about -­ 22 You know, fences are one of the biggest issues we get variances on. And if you let-­ :.:.. everyone comes in with their issues and their 25 pleas and we all sympathize with that, but the Diane M. And I just feel that if you put 5 this fence right along the Seminole 6 right-of-way, even though it's going to be 7 30-something feet off the edge of pavement, I 8 just worry about what the other homeowners are 9 saying. "Well, my front yard faces Seminole. 10 I want to be able to do the same thing here." 11 And we're really creating some real 12 issues. Then it starts--let's say four or 13 five people start doing that and you get the 14 canyon effect with the fences, and now look 15 where we are. 16 MS. I think things were just very 15 different. I mean, look at where the garage is 16 built.
