New Business b) Update on the paid parking solution (recommended by the Committee and approved by the City Commission) status update by Beaches Town Center Agency President Mr. Jay Handline. Beaches Town Center President Mr. Jay Handline gave an update of the On-Street Paid Parking System and explained the differences between a public/private initiative and a City-run program. Town Center's plan includes Town Center parking, employee parking, beach traffic, residential parking, validation options for merchants and businesses, community valet, free golf cart shuttle services, and various options for expanding the parking services in and around the Town Center. He spoke about creating a parking management program. The City of Neptune Beach will draft a Bid Proposal for parking management programs in the area. Chair Stinson went around the table to allow questions from Board members. All questions were answered. Chair Stinson thanked Mr. Handline for coming. Old f Unfinished Business f) Consideration to recommend to the City Commission the creation of a sidewalk and crosswalk adjacent to the parking lot on the southeast corner of East Coast Drive and Ahern Street tabled on 1 March 2018. A projection map was shown of the area and there was discussion about safety, whether a crosswalk should be on the north side or the south side, existing parking spaces, the amount of space needed for a sidewalk, pedestrian traffic, blind spots, legal issues, budgeting, and bidding. Chair Stinson suggested drafting a Recommendation to the City Manager and staff to consider this as an item for the 2018-2019 budget year, and be placed on the Agenda for the City Commission Meeting to be held on May 14, 2018. VIII. New Business d) Consideration of lighted pedestrian crosswalks and the use of high visibility sheening for inclusion in the coming fiscal year budget April19, 2018 PARKING AND PEDESTRIAN SAFETY ADVISORY RESOURCE COMMITTEE MEETING Discussion ensued about requesting this item for the 2018-2019 budget, how many locations should be requested, structural uniformity, lighted versus non-lighted, evaluation of areas in the City in most need of crosswalks, upgrading existing crosswalks, types of lighting, and other priorities for this year's budget. Consensus for Committee members to evaluate the City's crosswalks and create a list for Chair Stinson to take to next Commission meeting for consideration in next year's budget. Committee Member Winfree stated she would like to make Motion to remove the crosswalk at East Coast Drive and Third Street as it appears the crosswalk leads to no sidewalk. Motion to remove the crosswalk at Third Street and East Coast Drive Moved by Winfree, second by Kupperman Ayes-1 Nays-6 The Motion Failed Chair Stinson asked Public Works Director Scott Williams if any installation of lights is being planned for Mayport Road. Mr. Williams answered 1/No." Mayport Road is a Department of Transportation (DOT) road and DOT would be responsible for that type of work. VII. Old I Unfinished Business a) Membership update and resignation of members Nancy Whittington and Terry Essick. Chair Stinson addressed the Board members and stated that Terry Essick resigned due to family and personal demands. Nancy Whittington has also resigned due to similar conflicts. He asked the Board to let him know of anyone who might be a good candidate and answered questions regarding the application process. b) Selection and Appointment of Olsen & Associates Deputy Liaison. Chair Stinson opened the floor to discussion. Jennifer Wagner agreed to serve as Deputy Liaison to Olsen & Associates. Consensus was given by the Committee. c) Request for a Committee Member to present the Recommendation to City Commission to Install Temporary No Parking Signs along Ahern Street between East Coast Drive and Sherry Drive to the City Commission at the 23rd of April2018 Commission Meeting. Michael Tari offered to present this Recommendation to the City Commission at the Monday April23, 2018 meeting. e) Request for a Committee Member to present a Committee Report to the City Commission on the 23rd of April2018. Both Michael Tari and Paula O'Bannon agreed to present a Committee Report to the City Commission. g) Request from Police Chief Michelle Cook to review the City of Atlantic Beach Parking Ordinance for revision and clarification. Chair Stinson explained Chief Cook has asked the Committee to review the Parking Ordinance for clarification. Some residents are finding the Ordinance difficult to understand. Discussion ensued about this request and the possibility of a future on-street paid parking system. The Committee decided to table the issue. Motion: To table request to review the City of Atlantic Beach Parking Ordinance. Moved by Wappes, seconded by Tari. Ayes-7 Nays-0 The Motion passed unanimously. New Business a) Committee Governance related to member absenteeism (J. Lagner). Jennnifer Lagner suggested adopting a policy similar to other Boards regarding absenteeism. A lengthy discussion ensued about chronic absenteeism, the need to have a policy, what constitutes excused and unexcused absences, which rules to adopt and which not to adopt, adopting the policy used for the Cultural Arts & Recreation Advisory Committee and the Environmental Stewardship Committee. Several Motions were made and then withdrawn during this discussion. Chair Stinson suggested bringing examples to the next meeting so this Committee can create a policy about absenteeism. Consensus was given by the Committee. c) Presentation by Public Works Director Mr. Scott Williams regarding plans for the lOth Street Beach access reconfiguration and engineered recommendations. April19, 2018 PARKING AND PEDESTRIAN SAFETY ADVISORY RESOURCE COMMITTEE MEETING Public Works Director Scott Williams gave a presentation and passed around a Plat Map design on the reconfiguration. Discussion ensued on American Disabilities Act (ADA) access, the pros d.Hd cons of the design, making existing ramps ADA compliant other possible areas for ADA compliant solutions, parking and traffic issues. After discussion, it was agreed that a Town Hall meeting on the 10th Street Beach Access would be beneficial. Chair Stinson agreed to research and follow up when and where to hold the Town Hall meeting. Members Winfree and Reich left the meeting at 8:35p.m. No quorum for a vote. e) Request from City Manager Mr. Joe Gerrity for the Committee to consider recommending delineation of parking by use of painted striping. Discussion ensued regarding where the striping should go, the pros and cons of painted striping, regulations, and placing this issue on the next agenda. f) Consideration of sidewalks and pedestrian crosswalks on Donner Road between Sandpiper Lane East and Mayport Road. Scott Williams explained the ideas for improvements. He has asked an engineer to assess utilities and rights-of-way to get an idea of costs. Discussion ensued about the scope of the work engineering, and available grants. g) Handicap Parking at the 19th Street beach access. Discussion ensued about the two handicapped signs at 18th Street. It was suggested to move one to 19th Street. Set Agenda & Announcements Mr. Wappes will not be at the next meeting as he will be out of town. Discussion ensued about attending meetings by telephone. (a) No person shall stop, stand or park a vehicle in a roadway other than parallel with the edge of the roadway in the direction of the traffic. If a curb is present, the curbed side wheels of the vehicle shall be within twelve (12) inches of the edge of the roadway, except as provided in the following paragraphs: (1) Angled parking upon a street, which has been marked or signed for angle parking. The vehicle shall be parked at the angles of the curb indicated by the mark or sign. (2) Loading or unloading in a place where, and at hours when, stopping for the loading or unloading of merchandise or materials is permitted. A vehicle is used for the transportation of merchandise or material may be backed into the curb to take on or discharge loads. (b) No vehicle, trailer, boat, equipment of any kind shall be temporarily or permanently parked or placed in any location on public or private property, which interferes with the safe, clear and unobstructed sight distance of any rights-of-way intended or designated for use by pedestrians, bicycles, and vehicles. Such obstruction shall be immediately removed by order of the police department, and if required, charges for towing and storage, as set forth herein shall apply. (Ord. (a) On a sidewalk or in a manner that any part of the vehicle is protruding over a sidewalk or any part of the sidewalk area; (b) On any city right-of-way within seven (7) feet of a public driveway, or private driveway upon complaint; (c) Within twenty (20) feet of an intersection; (d) Within fifteen (15) feet of a fire hydrant; (e) On a crosswalk; (f) Within twenty (20) feet of a crosswalk at an intersection, unless permitted to do so by a zone or devices established in the area; (g) Along side or opposite any street excavation or obstruction when the stopping, standing or parking could obstruct traffic, and any place where any official sign prohibits stopping or parking, and any about:blank Page 1 of 7 Atlantic Beach, FL Code of Ordinances 5/1/18, 9:39AM parking place specifically designated and marked for the disabled unless the vehicle displays a parking permit as required by state law. (1) A person who is chauffeuring a disabled person shall be allowed, without need for an identification parking permit, momentary parking in the parking space for the purpose of loading or unloading a disabled person, and no penalty shall be imposed upon the driver for this monetary parking. (2) A person convicted of violating these provisions regarding parking spaces designated for disabled persons shall be punished by a fine of two hundred fifty dollars ($250.00). (h) Parking shall be prohibited on the following streets and roadways at all times: (1) East Coast Drive. (2) Ocean Boulevard. (3) Sherry Drive (South). (4) Seminole Road. (5) Plaza Drive (except for the 300 Block). (6) Royal Palms Drive. (7) Sailfish Drive. (8) Levy Road. (9) Dutton Island Road. (1 0) Donner Road. (i) Overnight parking prohibited. No vehicle, boat or trailer, other than official vehicles as authorized by the city, shall be parked overnight in any public park or public open space, on any property occupied by a government use, or in any other location posted by the city to prohibit overnight parking. No person shall stop, stand or park a vehicle in a street in a manner or under such conditions as to leave available less than ten (1 0) feet of a roadway for free movement of vehicular traffic, except a driver may stop temporarily during the actual loading or unloading of passengers or when necessary in obedience to a traffic regulation or traffic sign or signal or a police officer. No. 75-04-16, § 1, 9-13-04) Sec. 21-20.-Parking limitations. When a sign is erected in each block giving notice thereof, no person shall park a vehicle for longer than the respective times set forth in any schedule applicable thereto promulgated and adopted by the city manager. (Ord. No. 75-04-16, § 1, 9-13-04) Sec. 21-21.-Parking for certain purposes prohibited. No person shall stand or park a vehicle upon any roadway or right-of-way for the principal purpose of: (a) Displaying it for sale; or (b) Greasing, changing the oil or other fluids, or repairing the vehicle, except repairs necessitated by an emergency. (Ord. No. 75-04-16, § 1, 9-13-04) Sec. 21-22.-Commercial, recreational, etc., vehicles; weight requirements. (a) No person shall stop, stand, or park a commercial vehicle in excess of ten thousand (1 0,000) pounds gross vehicle weight, or any combination thereof, or any component part thereof, including the tractor unit or trailer unit of any tractor-trailer-type truck, upon any private property in a residential zone except for the purpose of loading and unloading. No more than four (4) hours shall be allowed for loading and unloading, unless otherwise authorized by the city manager or his designee. (b) No person shall stop, stand, or park a recreational vehicle, camper, bus, flatbed truck, travel trailer, equipment trailer, boat, boat trailer or commercial vehicle upon any street or right-of-way, except for the purpose of loading or unloading. No more than four (4) hours shall be allowed for loading and unloading, unless otherwise authorized by the city manager or his designee. (c) Violations of subsection (a) or (b) above shall be punishable by a fine in the amount of fifty dollars ($50.00) for a first offense and one hundred dollars ($1 00.00) for each subsequent offense. (Ord. No. 75-04-16, § 1, 9-13-04) Sec. 21-23.-Parking in the right-of-way. Parking in the right-of-way for short periods of time (not to exceed eight (8) hours) is permissible. Parking in the right­ of-way is not intended to be a solution for limited driveway and/or garage parking. Sec. 21-24.-Abandoned, wrecked, junked or inoperative property, etc.-Declared unlawful; exception; nuisance declared. Members of the department of public safety of the city are hereby authorized to remove and shall cause to be removed any vehicle from any street or alley or right-of-way within the city to a public garage or other place of safety under circumstances enumerated in this article: (a) When a vehicle is left unattended: (1) On a sidewalk; (2) Within seven (7) feet of a public or private driveway upon complaint; (3) Within fifteen (15) feet of a fire hydrant; (4) Within an intersection; (5) On a crosswalk; or (6) Alongside or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic. (c) When any vehicle is left unattended upon any street or right-of-way for a period of time longer than seventy-two (72) hours. (d) When a vehicle upon a street or alley is so disabled as to constitute an obstruction to traffic, or the person in charge of the vehicle is, by reason of physical injury or condition, incapacitated to such an extent as to be unable to provide for its custody or removal. (e) When any vehicle is left unattended upon a street or alley and is so parked illegally, or the vehicle constitutes an obstruction to normal movement of traffic. (Ord. Any and all towage and storage charges reasonably due the operator of the garage or place where the vehicle under provisions of this article, shall constitute a lien against the vehicle. The operator of the garage or other place the vehicle is stored is hereby authorized to hold the vehicle until the towage and storage costs are paid by the owner of the vehicle, or, in his behalf, the operator; provided, that in no event shall the city or any officer; employee or department of the city be liable for the charges and costs by reason of their enforcement of this section. The director of public safety shall have exclusive control of and shall have printed uniform traffic citations which shall be prenumbered and which shall be issued to the public safety officers. It shall be the duty of the public safety officers to check on parking locations for indications of illegal parking and to give the notice ofthe violation of parking ordinances regulating the parking of vehicles in any street block of the city. Notice of violation of a parking ordinance by public safety officers shall be given by leaving a citation specifying the violation with the registered owner or operator of the vehicle or by attaching the citation to the vehicle if it is unattended. A duplicate copy of each such ticket shall be made and filed by the public safety officer, with his signature affixed thereto, at the close of each day's work, with the records division of the public safety department. Citations for violation of parking ordinances shall: (a) Be in writing and in the name of the city; (b) Set forth substantially the nature of the offense and the number of the ordinance being violated; (c) State the date and time delivered; (d) Specify the license tag number of the vehicle causing the violation as well as the person cited if delivered in person; (e) Command the owner or operator of the vehicle causing the violation to pay to the City of Atlantic Beach, finance department the applicable fine as established by section 21-38; and (f) Shall be signed by the person issuing them. The voluntary payment of a parking fine shall be deemed equivalent to the entry of a plea of guilty to the offense charged and waiver of the right to a trial for purposes of this chapter. (b) There is imposed on each person charged with violation of a parking ordinance who fails to pay the parking fine within thirty (30) days an additional cost of fifty dollars ($50.00). (c) The director of public safety shall have the discretion of relieving the person named in the citation of paying the additional fifty dollars ($50.00) late fee upon good cause being shown and documented by the director of public safety. (d) Multiple unpaid violations. If a vehicle has three (3) or more unpaid parking tickets, and the time limitations for the payment of the tickets has expired, then the vehicle may be disabled or towed pursuant to the conditions set forth within this chapter. For purposes of violation of a parking ordinance of the city, the specification of a motor vehicle license tag number on a citation for such violation, by an officer charged with enforcement thereof, shall be prima facie evidence that the motor vehicle is owned by the person in whose name the license tag is registered in the office of the appropriate agency of the state issuing the license tag. Stinson, Commissioner, Seat No.2 13th of December 2016 On the lOth of October 2016, the City of Atlantic Beach, City Commission was addressed by Miss Sharette Simpkins of 354 19th Street, Atlantic Beach, about an ongoing concern and violation of the City Codes. The violation as described by Miss Simpkins was that of an abandoned f inoperable vehicle directly across 19th Street from her home. The complaint was again presented along with detailed actions taken to resolve the violations by the City's Code Enforcement officer, Ms. Debbie White. These facts were presented to the City of Atlantic Beach, Code Enforcement Board on the 9th of November 2016. From the presenter's work as a member of the Code Enforcement Board for approximately three years, and follow up discussions with members of the City's staff, indicate that although the City's Code provides for a finding of violation in the event an automobile is abandoned or inoperable, the Codes have no provision for enforcement that include removal of the vehicle at the owner's expense. There may be other historical information, not presented in this chronology and not available at the time of the drafting of this report. The presence of an abandoned or inoperable vehicle on property not properly zoned and permitted to store such vehicles does constitute a hazard to the health, safety and environmental protection of the residents and the City of Atlantic Beach. City Code, Chapter 24, Article II, Section 24-17 defines an abandoned vehicle as "any junked, discarded, or inoperable BUDGET: RECOMMENDATION: ATTACHMENTS: motor vehicle, including any boat, motor, trailer and the like, with a mechanical or structural condition that precludes its ability for street travel or its intended use, or one that is dismantled, discarded, wrecked, demolished or not bearing current license tags." An older Ordinance, Ordinance 75-88-7 which is no longer effective, actually authorized the Code Enforcement Officer to remove abandoned property at the expense of the owner. It is the understanding of this Commissioner this enforcement option is no longer available to ensure compliance with the Codes and Ordinances of the City of Atlantic Beach. Based on the recently proposed (12th of December 2016) "Ordinance ofthe City ofAtlantic Beach creating a pilot program for permitting backyard hens...." and the absence of any cost associated with the drafting of that particular ordinance nor any budgetary impact as set forth in that recommended action by the City Manager and his staff, it is anticipated there would also be no budgetary impact to draft this proposed Ordinance. It is recommended for the City Commission to direct the City Manager to work in concert with the City Attorney and the City Manager's staff to draft an Ordinance for presentation to the City Commission for consideration and possible ratification at the regularly scheduled City Commission meeting of the 23rd of January 2017. 1.
