Ms. Joyce Conway,
The City of Atlantic Beach did a preliminary review of your plans for various projects including a
new deck with pergola and outdoor kitchen and lower level deck on east of an existing single
family home as well as deck and stair replacement on the south and west side of the same single
family home at 1789 Beach Avenue.There is also landscape improvements with sea turtle friendly
lighting.Drawings provided show that the pergola with outdoor kitchen and elevated deck comply
with all setback requirements. Based on this, the proposed construction does not contravene any
local setbacks or zoning codes.
This letter does not constitute an approval by the City of Atlantic Beach. The project must still be
submitted to the City in a permit application and be reviewed by all applicable departments prior
to approval and issuance of a permit.

Joyce,
have a few questions and comments that need to be addressed before I can write your DEP letter.
Can you provide a site plan showing setbacks to the new structures over 30 inches tall?This would be
the trellis and kitchen on the east side of the lot and the trellis on the south side of the lot as well as any
deck surfaces including railings that are over 30 inches in height. REPLY BY OWNER:The pergola on the
east is at 9'-2" above finished first floor and approximately 9'-6"above the patio(the patio will slope to
drain).The arches at the south entry deck are 3"wide steel arches as shown in the attached sketch.
These arches have no connectors between and no roof of any kind.The landscape plan shows potted
vines that will be"trained"to the arches.There is an existing approx.6'tall privacy fence that sits on the
property line.This is shown in the sketch.
The decks to the south at the entry are 16"and 28"above existing grade and do not have handrails or
guardrails.The deck to the east near the boardwalk varies relative to a sloping grade but none of the
deck is more than 30"above grade and there are no handrails or guardrails.
The kitchen wall on the east side is 6'-0"off the property line and is 59" above grade.The pergola is 7'-
6"off the property line and as noted above is about 9'-6"above grade.
Is there any new fencing proposed? I see one reference to existing fencing, but new fencing should be
shown as well. REPLY BY OWNER: There is a new fence indicate in the east yard. It is indicated on sheet
L-3 as a black metal picket fence—42" high.
What type tanks are being relocated and where are they being move to? This scope is deleted.
What is the height of the new retaining walls? Related to this is.What is the plan for the area next to the
garage door?It looks like two walls are being removed.This is a pretty significant grade change.Would
the soil be slopped? Is there a retaining wall?If there is a wall,how tall would it be? OWNER REPLY: All
of this scope is deleted.
Is the proposed lighting sea turtle friendly?In addition to State requirements,the City has certain
lighting requirements,including no up lighting and all lighting must be in the long wavelength
spectrum. OWNER REPLY: All lighting on the lighting plan is specified to be turtle friendly amber lights
per DEP requirements.There are uplights on the west side indicated in the plan.These will be deleted. I
don't know what long wavelength means but it is all amber DEP spec.
Answer these questions on the plans where possible and provide a written explanation where
necessary.You can submit the revisions to the Permits Desk at City Hall.
