OWNER OF PROPERTY: The owner of the unit is Sarah H. Bohr whose resides on the property and whose address and telephone numbers are listed above. 2. UNILATERAL CONTRACT & CONSIDERATION: After the payments of all rents, fees, and deposits as set forth herein, Owner will rent to the Renter, Joseph V. and Barbara A. Prokop, the southern oceanfront unit commencing on September 13, 2009 for a rental of$650.00 weekly. This fee is inclusive of all taxes, utilities charges, condo fees, etc. Payment shall be made as follows: payment for the first five (5)weeks of$3250 at the commencement of the rental, with the balance due 30 days thereafter. 3. Check in time is 3:00 p.m. and check out time is 11:00 a.m. 4. This is a NON SMOKING unit. A $100.00 fine will be charged if there is any evidence of smoking on the premises. 5. PETS are permitted in the unit for an additional fee of$100.00 per pet. 6. We will not rent to any one with a criminal record or anyone that has previously been evicted from any premises. 7. DAMAGE DEPOSIT: An advance payment/security deposit of$500.00 is due at the time of the booking of the reservation. The damage deposit is not applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met: a) No damage is done to the unit or its contents, beyond normal wear as might be expected during the short term rental period. b) There is no excessive or abusive use of the utilities. c) No appliances, dinnerware, cookware, glassware, utensils, or general kitchenware are missing or damaged. d) No beach items, books, or games damaged or missing or in disarray. e) All television, cable, and stereo controls are returned to their proper places in the unit. fj All debris, rubbish, and discards are placed in the proper trash bags and proper trash bins. g) The key is returned to the owner and the unit if left unlocked. h) No linens or towels are lost or damaged. i) The owner's personal property was not accessed and no items are damaged or missing. 1 8. CANCELLATIONS: Cancellations that are made more than thirty (30) days prior to the arrival date will result in the forfeiture of the initial deposit. Cancellations that are made less than thirty (30) days prior to the arrival date will result in the forfeiture of rent equal to one month's rental. Cancellations or changes that result in a shortened stay or early departure do not warrant any refund of rent or deposit. You may choose to purchase travel insurance separately. 9. MAXIMUM OCCUPANCY- The maximum number of guests in the property is 4 persons. 10. THIS PROPERTY REQUIRES A MINIMUM STAY of 13 weeks.There is no penalty for early termination of the rental period provided the renter provides 14 days advance written notice of the date of termination. 11. CHILD FRIENDLY BUT NOT CHILD PROOF. The Unit is NOT child proof. While the unit is rented to people with children, there are many items abound that could be hazardous to small children. It must be understood that renters must take action to make the unit safe for babies, infants, and small children. Renters assume responsibility for all risks or hazards. 12. NO DAILY MAID SERVICE —Linens and bath towels are included. Maid service is not included in the rental rate. However, additional Maid Service is available at an additional rate of$75.00 - $100.00 per day depending on the size of the party and the services requested with an advance request at the time of booking. 13. BARBEQUE GRILL. The Barbeque Grill is located on the pool deck and is shared with the guests in the other rental unit on the property. The Unit contains barbeque utensils and cleaning items. Please clean the Grill before and after each use. 14. FOOD ITEMS. The unit is not supplied with any food items or beverages. There is a Publix on Atlantic Blvd., near Penman Road. 15. ITEMS PROVIDED FOR CONVENIENCE. For the convenience of our guests, the unit will be stocked with certain items such as spices, condiments, and cleaning supplies that we ask you to replace as used. 16. BEACH TOWELS. The unit is stocked with numerous beach towels. These are the only towels we permit you to bring to the beach or the pool. 17. RATE CHANGES —Rates subject to change without notice until booking. The rate is only guaranteed, as long as, you comply with reservation payment / deposit requirements. Failure to make a timely payment of the balance of the rental payment or security deposit may result in a rate change or forfeiture of the advance payment / deposit and rebooking of the unit to someone else. 18. FALSIFIED RESERVATIONS — Any reservation obtained under false 2 pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in. 19. HURRICANE OR STORM POLICY— HURRICANE OR STORM POLICY: No refunds will be given unless: a. the National Weather Service orders a mandatory evacuation in a "Tropical Storm/ Hurricane Warning" area that includes the location of the unit, and /or b. A "mandatory evacuation order has been given for the Tropical Strom/ Hurricane Warning" area of residence of a vacationing guest. c. As of the day that the National Weather Service orders a mandatory evacuation order in a Tropical Storm / Hurricane Warning area in either a or b above, we will refund: i. Any unused portion of rent from a guest currently registered, ii. Any unused portion of rent form a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and iii. Any advance rents collected or deposited for a reservation that is schedule to arrive during the Hurricane Warning period. Otherwise there will be no refunds. Sorry but we cannot guarantee the weather. 20. TRAVEL INSURANCE: We highly recommend your purchase travel insurance. If you wish to purchase travel insurance, you may wish to price insurance at websites such as www.InsureMyTrip.com. 21. ACCESS BY OWNER. It is expressly understood that the owner has the right to enter the premises to make inspections, provide maintenance services or show the home to prospective buyers, renters, mortgagees, or workers. As provided by law, in cases of emergency, the Owner may enter the premises with the renters' consent. 22. OWNERS' CLOSETS. The unit has some personal items of the owners in some of the closets. These items are off limits to renters and should not be accessed. 23. NO ASSIGNMENT. Renter may not assign the rental agreement to any third party and may not sublease the premises. 24 SUBORDINATION. This rental contract is subordinate to ay mortgages which may exist. 25. RETURNED CHECKS. If any checks are returned by the bank for not sufficient funds, then the maximum charge allowed by law will be assessed. 26. CUMULATIVE RIGHTS. The rights under this rental agreement are cumulative. 3 27. DAMAGES, COSTS, ATTORNEYS FEES. Renter shall be responsible for all damages, costs and attorneys fees in the event the Renter fails it any of its obligations under this agreement. 28. CREDIT CARDS.
