AGENDA ITEM: Approve the contract of VIA Concepts for design, bid
documents and construction administration of an
approximately 6,000 square foot skate park facility in the
amount of $26,174.00

BACKGROUND: Staffwas authorized to negotiate a contract with VIA
Concepts for the design, bid documents and construction
administration of an approximately 6,000 square foot skate
park facility. The contract includes time for two public
meetings, which will be set once the contract is approved.
The skate park will be constructed in Russell Park and the
City Commission will approve the final plans prior to
bidding.
Staff also negotiated the sale of the Adele Grage building
model at $800 to VIA Concepts. The sale of the model was
deducted from the total cost to design the skate park.
BUDGET: The budget for this phase of the project is $30,000 and is
budgeted in account number 131-0000-572-63-00.
RECOMMENDATION: Approve the contract of VIA Concepts for design, bid

For the following Project:
Owner's Objective
The Owner's proposed project involves the design and construction of a new outdoor skate
park in the City of Atlantic Beach. The location of the skate park is to be located in Jack
Russell Park, Atlantic Beach, Florida. The new skate park is to be constructed in reinforced
concrete. The skate park's design is gear toward beginners and intermediate level of
skateboarders. Other amenities for the skate park are not fully established at this time.
Support areas such as queuing and viewing area will be considered during the programming
and preliminary design phase. It is the intention of the Owner to create small
(approximate/y 6,000 square-foot) skate park in the center of Atlantic Beach where
residents and visitors can enjoy.

Project Scope
This proposal is for the design of a new skate park to be located in the city Atlantic Beach,
Florida. The Architect will present a design solution to the Owner
for review and acceptance after programming and pre-design services. The Architect will
then develop the design scheme and submit for owner review at various stages of the
construction drawings and specifications. The document will include Typical Area Site Plan,
Skate park Plan, Demolition Plan of existing area (if needed), Details and Elevations.

The following represents possible scope of services for the development of skate park design
drawings in sufficient detail to allow an estimate of components of this project:
SITE DESIGN: Site Inventory and Analysis
• Review existing survey and geotechnica/ data
• Review site drainage and topography information made available
by the City of Atlantic Beach or the surveyor of record
• Adaptation of utility connections to skate park
• Adaptation of surface water management & drainage (site grading)
• Design and detailing of miscellaneous pathways and apron area
• Consider pedestrian and vehicular linkages to and from this
proposed facility
• Consider views to and from this facility
• Detail tree and shrub planting
• Indication of plant removal and relocation
• Selection and specification of plant materials
BUILDING DESIGN: Programming
Meet with. City of Atlantic Beach personnel to develop and detailed
space and functional requirements for each space within the skate
park. This includes criteria for finishes, power, lighting,
communications, plumbing, storage, fixed equipment, etc.
Develop flow and adjacency among spaces to assist in layout
Establish applicable building code requirements for this project

• Dimensioned plan indicating. spaces, doors, fixed equipment,
structural elements and exterior. park furnishings
• Exterior elevations indicating materials heights, doors, windows

The Owner and Architect agree as set forth below
11.1 AN INITIAL PAYMENT OF One thousand five hundred Dollars ($ 1,500.00)
shall be made upon execution of this Agreement and credited to the
Owners's account at final payment.
11.2 BASIC COMPENSATION
11.2.iFOR BASIC SERVICES, as described in Article 2, and any other services
included in Article 12 as part of Basic Services, Basic Compensation shall be
computed as follows:
- Said FEE for the heretofore mentioned Professional/Architectural Services of Phase
Architectural Services for the new outdoor skate park in Atlantic Beach, Florida shall be
charged on a lump sum basis as follow:
Phase 1 Programming/Pre-design Phase
Phase 2 Design
The Architect shall review with the Owner alternative approaches to design
and construction of the Project. Based on the mutually agreed-upon
- program, schedule and construction budget requirements, the Architect shall
prepare, for approval by the Owner, Design Documents consisting of drawings
and other documents appropriate for the Project, and shall submit to the
Owner a preliminary estimate of Construction Cost.
This phase includes schematic design layout and drawings for fund raising
activities. Extra Services for this phase may include Architectural Model
and/or Rendering as well as extra meetings beyond the scope described
above.

Phase 3 Construction Documents Phase
Based on the approved Design Documents, the Architect shall prepare, for
approval by the Owner, Construction Documents consisting of Drawings and
Specifications setting forth in detail the requirements for the construction of
the Project, and shall advise the Owner of any adjustments to previous
preliminary estimates of Construction Cost.
The Architect shall assist the Owner in connection with the Owner's
responsibility for filing documents required for the approval of governmental
authorities having jurisdiction over the Project.

Specification: The technical specifications indicate detailed instruction
of the required materials, finishes and workmanship -all
grouped by building trades. It is common practice to
include each trade in the order of actual construction.
The Construction Documents, the working drawings
together with the technical specifications, are the most
important parts of the documents constituting the
contract of the build form. In general, information on
the design, location, and dimensions of the elements of
building is found on working drawings, and information
on the quality of materials and workmanship is found in
the specifications.

The Architect shall provide assistance in the bidding process. Bidder
evaluation recommendation, attend pre-bid meeting and provide required

11.2.2Where compensation is based on a stipulated sum or percentage of
Construction Cost, progress payments for Basic Services in each phase shall
total the following percentages of the total Basic Compensation payable:

in writing by the Owner at the appropriate time during the progression of work.' The

(2.75 )times the amounts billed to the Architect for such services.

11.4 REIMBURSABLE EXPENSES
11.4.1 FOR REIMBURSABLE EXPENSES, as described in Paragraph 10.2, and any
other items included in Article 12 as Reimbursable Expenses, a multiple of
one( 1.0) times the expenses incurred by the Architect, the Architect's employees
and consultants in the interest of the Project.
11.5 ADDITIONAL PROVISIONS
11.5.1 IF THE BASIC SERVICES covered by this Agreement have not been
completed within ( ten )months of the date hereof, through no fault of the
Architect, extension of the Architect's services beyond that time shall be
compensated as provided in Subparagraphs 10.3.3 and 11.3.2.
11.5.2 Payments are due and payable thirty(30) ca/endar days from the date of the
Architect's invoice. Amounts unpaid thirty(30) calendar days after invoice date
shall bear interest from the date payment is due at the rate entered below, or in
the absence thereof, at the legal rate prevailing from time to time at the principal
place of business of the Architect.
At the time of delivery of the drawings the balance of the remaining sum steal! be due in full.
Interest at 1 1/2 percent (1.5 %) per month will be charged on the unpaid balance
commencing (thirty) 30 calendar days from the delivery of the drawings. Legal and
collection expenses incurred by the Architect on delinquent accounts shall be reimbursed by
the Owner, including filing of liens.
11.5.3 The rates and multiples set forth for Additional Services shall be annually
adjusted in accordance with normal salary review practices of the Architect.
ARTICLE 12
OTHER CONDITIONS OR SERVICES
The scope of this contract shall not include surveys (boundary, topography, trees, utilities),
geotechnica/ exploration, off-site utilities systems design, specialty audio/visual consultant,
acoustical design specialty consu/taut, lighting design consultant, audio/visual equipment
procurement specifications, detailed cost estimating (beyond that provided as Basic
_ Services), design of irrigation engineering, and other consultants as required.
Please see Artic/e 3 -Additional Services, Section 3.1 for more reference. In the event that
sealed plans of these mentioned services are required by building officials, fees for said
services shall be additional to this contract and steal/ be strictly pre-approved in writing by
the Owner at appropriate time during the progression of work.
The scope of work in this agreement may be renegotiated after the completion of the Design
Phase (Phase 1) if the Owner is unable to acquire the necessary funds to complete the
project.
SCHEDULE
Depending upon the intent of the Owner, the over all scope of services may be
accomplished within nine (9) months:

Additional times may be necessary for fundraising and community meetings
to the overall project schedule
This does not include any internal review and discussion time by the City of Atlantic Beach
staff. Nor it includes possible fundraising period for the project. VIA Concepts is flexible to
the desires of the Owner and will cooperate regarding deliverable timeframes.
NOTICE
The Owner shall be made aware that renovation/addition and new construction of
real properties can often be a very difficult and costly process. The local and state governing
bodies can impose heavy restrictions upon construction project, especially when the project
is located in the property of a public park. VIA Concepts shall not be held responsible if
governing bodies determine that the Owner is not permitted to proceed as proposed, or if
construction and related costs exceed the Owner's proposed budget limits and time period.
