Respondent represents the interests of the Property located at 20 Donner Road, Atlantic Beach, Florida. ("The Property"). 2. The Respondent requested a lien reduction on a prior violation from January 2, 2018. The Respondent did not appear. 3. The Respondent's Property was cited and a lien imposed for violation of Chapter 20 Business Tax Receipts, Section 20-52, Section 24-173 Neighborhood Preservation and property maintenance standards and Chapter 24, Land Development Regulations. 4. On November 14, 2017, a fine of$100.00 per day was assessed if the violation continued past January 2, 2018 and payable at an interest rate of ten(10)percent per annum from the date of the certification until paid. The City of Atlantic Beach was approached by the Respondent for a lien reduction. The Respondent requested a continuance until the March 2, 2023 hearing date. CONCLUSIONS OF LAW 5. The City of Atlantic Beach provided time for a hearing for the Respondent on the issue of a lien reduction. The Respondent requested a continuance until the March 2, 2023 hearing date. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered: A. Respondent represents the interest of the Property located at 20 Donner Road, Atlantic Beach, Florida. ("The Property"). Proper notice of the hearing was provided and Mr. Kelly Mathis, Esquire appeared on behalf of the Respondent. 2. Previously, the Respondent requested a lien reduction on a prior violation from an Order entered on November 29, 2017 and a violation hearing dated January 2, 2018. The Respondent did not appear at the November 14, 2017 hearing resulting in the November 29, 2017 Order. There was testimony that the Respondent at the time did not receive the notice or it could have been delivered to the wrong address. 3. The Respondent's Property was cited and a lien imposed for violation of Chapter 20 Business Tax Receipts, Section 20-52, Section 24-173 Neighborhood Preservation and property maintenance standards and Chapter 24, Land Development Regulations. 4. On November 14, 2017, a fine of$100.00 per day was assessed if the violation continued past January 2, 2018 and payable at an interest rate of ten (10) percent per annum from the date of the certification until paid. The violations have been corrected and/or are in compliance. The City of Atlantic Beach was approached by the Respondent for a lien reduction. The Respondent requested a continuance until the May 4, 2023 hearing date as she was unavailable for personal reasons until that time. It was again continued until the July 6, 2023 hearing date. 5. Attorney Kelly Mathis presented evidence that the Property in question was actually a part of the Mayport Overlay District when assessed the fine. Respondent introduced the Overlay District map and findings which specifically allowed for the outside storage in 2017. The alleged "violations" (if any) at that time were found corrected in 2018. The City of Atlantic Beach claims the violation fines were for 152 days at $100.00 per day, plus interest for approximately $21,148.00. The City of Atlantic Beach stated they had about $500.00 in outstanding costs. CONCLUSIONS OF LAW 6. The Property was assessed for the Code violations. The City of Atlantic Beach provided time for a hearing for the Respondent on the issue of a lien reduction. The Respondent requested a continuance until the July 6, 2023 hearing date. The evidence presented by the Respondent shows the Property is in the Overlay District allowing for the outside storage at that time. The evidence showed that the Property owners at that time were in communication with the City of Atlantic Beach and believed all matter had been satisfied prior to the November 14, 2017 hearing.The City of Atlantic Beach stated they had received a check for over$18,000.00 as payment in the past, but the check was returned November 21, 2022 when the discussions of the Overlay District being approved was presented. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered: A. The Respondent is fined $1,000.00 payable within thirty (30) days from the date of this Order for the costs incurred in this matter and the failure to appear at the November 14, 2023 hearing.
