Atlantic Beach, FL and eglasser@coab.us Dear Mayor Glasser, This letter is being directed to you to ask for your assistance in resolving an issue regarding a reported code violation. On October 31,2016 an e-mail was sent to Derrick Reeves,city planner, from Frank E. Houser regarding concerns about a fence being built in violation of the city code (Article III Sec. 24-157), which structure was built without obtaining a permit. Debbie White came out immediately to inspect the fence and found it in violation. A violation letter was sent to Karl Klein, 1918 Oak Circle and the issue was placed on the agenda for the March 14, 2017 code enforcement meeting. This issue was removed from the meeting's agenda and placed on hold because Mr. Klein was working with Mr. Reeves to obtain a variance. In May, 2017 Mr. Reeves stated that there was a PUD/zoning issue the city was addressing. It has been approximately eighteen(18)months and there have been numerous e-mails sent to Mr. Reeves, Mr. Hogencamp and the previous mayor to no avail. The response given is that they are still working on a solution. There has been no direct response to the questions: is the fence in violation of the city code as found by Ms. White and if so, will enforcement actions be taken to correct the violation? At the recommendation of two members of your city management staff, I am writing you in hopes that you may be able to find a judicious resolution of the conundrum. If you will bear with me, I will lay out the problem as briefly as I can. Over twenty-five years ago, the area behind my house (part of the Selva Marina woods) was clear cut. I was under the impression that trees in the area were sacrosanct, so I approached the City to find out what was going on. I was advised then that the City did not manage the unit-- nor in actuality did the developer. I was told that the best I could do was to build a privacy fence at the rear of my property. I did, and it stood, without challenge, for over twenty-five years. In the interim, the City has taken over management of the Unit. (I recently obtained a City permit for and built a similar fence on the left side of my property.) Then came Hurricane Matthew. In addition to considerable other damage to my property, the rear fence was partially destroyed. In the chaos that followed, I was unable to find a contractor who could rebuild the fence in any reasonable time-frame. So my son and I rebuilt the fence, using some of the remaining posts and mostly new materials. I did not seek a permit for this work, thinking it was merely a replacement of an existing structure. I have since been served with a code violation for a structure built without a permit. I immediately submitted a permit request. After meetings with Code Enforcement Officer Debbie White and Acting Head of the Permit Office Derek Reeves, I have learned that my permit request is being held in abeyance, pending the City's consideration of the special status of Selva Unit 12A. When my wife and I bought our property in 1989, we were never informed of a set of"covenants"relating to the unit. As best I can determine, these covenants have not been effective (certainly not enforced) for decades. They were to be managed by a now-defunct development corporation. In its absence, the City has since routinely granted permits in violation of the covenants. Then, in the wake of Hurricane Matthew, the City somehow took notice of the covenants and is now wrestling with their legal validity. My fence is thus in limbo. Officer White and Mr. Derek Reeves have been very considerate in working with me, but it is now apparent to me (and apparently to them)that we need a policy decision that should be made by elected City Officials. So I 1 am asking for a meeting, at your convenience,to discuss the matter with you and with City Commissioner Waters. I am confident that you will find a judicious solution. After the hurricane my neighbor put up a fence. It is non compliant, a permit was never pulled. I informed several officials. One came out while under construction,but did nothing to halt construction.Now that Van Liere is no longer with us and I have yet to hear anything I was wondering if you can help or direct me to someone to rectify the situation. Talk about dragging feet. I don't see a difficult situation,no permit,not in compliance...fix it to city ordinance...simple. When I wanted to put in a patio the city was all over me and made me tear up my driveway and install a semipermeable one at the tune of 25k. Now I have to look at the Great Wall fence, which could have been stopped before completion. What ever you can suggest will be appreciated. Thanks for listening.
