Request for waiver as permitted by Section 23-8 to waive the
required mitigation for tree removal on a residential property as
required by Section 23-33 to allow the construction of a new single
family honk at 2347 Fiddlers Lane (Lot 54 Oceanwalk Unit One.)

BACKGROUND: The applicant purchased the property in 1986 and it has remained vacant
resulting in heavy vegetation growth. In November 2017, the applicant submitted a successful
mitigation/landscape plan as part of her building; permit for a new home. 96 healthy trees were
identified on the lot while processing the tree removal permit. 43 cif these trees were identified for
tree removal totaling 540 inches. This resulted in a required mitigation calculation of 270 inches
(50%).
The approved mitigation plan called for twenty palm trees, one crape myrtle, and five live oaks.
However, the applicant believes the mitigation plantings in conjunction with the number of trees
she is preserving (53) results in too many trees for her lot (79). On June 111", the applicant brought
a waiver request to reduce the required mitigation to the City Commission for consideration. At a
minimum, the applicant was seeking relief from planting; the five live oaks.
The City Commission deferred their vote on the waiver request to June 251" in order for the
applicant to explore additional mitigation options with staff. Stam has been working; with the
applicant on an alternative that would allow offsite plantings and the Oceanwalk Home Owners
Association has agreed to accept any trees the applicant cannot lit on her lot. However, offsite
planting locations have not yet been identified and the applicant is not able to attend the June 25'1'
meeting. Therefore, the applicant is requesting to defer this request until July 9"'.
