Item 10A- Request for WaiverCITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF RE, PORT AGENDA ITEM: WAIV 18-0006 public Hearin Request for a waiver as permitted by Section 17-52 to waive the required mitigation for tree removal on a residential property as required by Section 23-33 to allow for the construction of a new single family home at 2347 Fiddlers Lane (Lot 54 Oceanwalk Unit One). SUBMITTED BY: Shane Corbin, Community Development Director BATE: May 29, 2018 BACKGROUND: The applicant is Julie Ilammond, the owner of 2347 Fiddlers Lane. The applicant is requesting to waive the 50% mitigation rate for tree removal on private property as required by Section 23-33. The tree removal permit for this property was submitted in September 2017 in preparation for the construction of a new home. Prior to construction beginning in late. 2017, the lot had remained vacant for decades resulting in heavy vegetation growth with 104 trees being identified on the lot. The tree removal permit identified 43 of these trees, totaling 540 inches, as being removed. 13cr Section 23-33, this resulted in a required mitigation of 270 inches (50%). Mitigation can be in the form of tree replacement (new plantings), relocation, or preservation. In November 2017, the applicant submitted a successful mitigation/landscape plan that showed 73 inches of preservation credit and 202 inches of replacement credit for a total of 275 inches of mitigation, Specifically, the mitigation plan called for the planting of twenty palm trees, one crape myrtle, and four live oaks on the property. With construction of the new home nearing completion, the applicant has requested, at a minimum, relief fro.r-n planting the four live oaks. I followed through with the purchase of the lot in hopes to retire in Atlantic Beach one day. i Have so looked torward these past 30 plus years to living in such a wonderfful triendly community. Had this house Been Built BacR in 198671987 there would not be a waiver request or this discussion. This situation is the exception to the rule with Chapter 23 Protection of Trees and Native Vegetation. There are very tew vacant properties in Atlantic Beach that have not Been Built oi, and should be the exception. Planting this many trees on one piece of property is not fixing or saving the canopy of the City of Atlantic Beach. CRapter 23 need to Be rewritten to in compass all situationz. and work towards fixing/keeping a beautiful canopy. A Better requirement tar trees, for example would be a minimum � number of trees per square teet/yard/acreage on each piece of property. (11 The particular physical conditions, shape or topography of the specific property involved causes an undue hardship to the applicant if the strict letter of the artiLle is Lamed out. This property needed 51 loads of dirt to Bring it up to the required code for the street level. According to tFie Building codes of residential property, the House and land Had to Be at a required level to the street. The property could not be Brought up to these codes without clearing the minimum numBer of required trees. There were 100 trees tagged on the property that were 4" or larger. Ot the 100 trees, 43 tree were removed to clear the property and prepare for building. TRe 43 trees removed were not in the Best condition after 30 years of over growth of vines etc. Therefore, over 5 trees were lett on the property to include additional trees that are smaller than the 4". Oceanwalk's Declaration of Covenants and Restrictions requires a "minimum square footage of one thousand eight Hundred (1,800) square tees of interior living area, exclusive of garages, porches and patios, But total ground coverage shall not exceed thirEy-tive percent (.j5%) of the lot surface area". The House in the process of being Built is within this requirement. (2) The granting of the waiver will not Be injurious to the other adjacent property. i I F a 3 e Oceanwalk is over a 30 year old subdivision (June 4, 19M). This property is one of 3 lots nut developed out of 249 lots. This lot is the last lot on ridders Lane to be developed, therefore it will not be injurious to the other adjacent properties. (3) The conditions, upon which a request for waiver are based, are peculiar to the property for which the waiver is sought, are not generally applicable to other property and do not result trom actions of the applicant. The current approved Tree Removal Calculations requires 202 inches to Be replanted on the property. That is 91% more mitigation than the average Tree Kemoval Permit on the city of Atlantic Beach webbite. The waiver is requesting at a minimum relief from mitigation ut 39" ur 5 - 4" Live Oak Trees. Which would still require the planting of 1- 3" Crape Myrtle tree and 20 - s" Palm trees.
