Dickinson for a waiver from the sign regulations in conjunction with redevelopment of a commercial property, located at 725 Atlantic Boulevard (North Beach Center) SUBMITTED BY: Sonya Doerr, AICP ~~ Community Development Director DATE: May 16, 2003 BACKGROUND: The applicant has requested a waiver, pursuant to Section 17-15 of the sign regulations, to allow an increase in the maximum height and size of a freestanding sign. The proposed sign would serve various businesses at the North Beach Center (the former Pic- n-Save property), which is undergoing redevelopment to include various retail, commercial and limited warehousing uses. Chapter 17-6 limits this project to one freestanding sign on the Atlantic Boulevard frontage not to exceed eighty square feet in size and eight feet in height. The proposed sign contains 250 square feet at a height of 25-feet. The Applicant has also requested that signs mounted on exposed raceways be permitted, and that no limit on colors of signs be enforced. AUse-by-Exception was previously approved for the North Beach Center project, and the following the condition of approval addressed signage. A unified sign plan shall be approved by the Community Development Director, which shall comply with the City's sign regulations, and which demonstrates a common theme with respect to sign type and construction, illumination, size, style and color. All owners and lessees, and any assigns seeking sign permits within this Development Project shall be subject to this unified sign plan. Section 17-6 (b) of the City's sign regulations also requires a unified sign plan for projects with multiple signs. BUDGET: No budget issues. RECOMMENDATION: The proposed freestanding sign would seem to be in conflict with the intent of the Commission that signature signs identifying the name of the shopping center, rather than each business within the center, become the standard for commercial uses. The applicant must demonstrate that there are circumstances unique to this project, which justify the need for the requested sign. Staff does not object to varying colors of fascia signs provided that a unified plan and theme for signage, as requested by the Community Development Board, is developed. (Signs containing any Federally registered trade or service marks are entitled to use registered colors and logos.) ATTACHMENTS: Application and supporting materials. Sec. 17-15. Requests to waive certain terms of this Chapter. Requests to waive terms of this Chapter may be made upon specific application to the City Commission, with proper public notice required, provided that no waiver shall be requested that would allow a Prohibited Sign, or any otherwise unlawful Sign. The applicant requesting such waiver shall have the burden of demonstrating the need for the requested waiver, and that the waiver is not in conflict with the Intent of this Chapter. The terms of any waiver to the provisions of this Chapter shall be established by order of the City Commission. Allow Raceways - In using the existing concrete building (former Pic N' Save), painted raceways are our best option for mounting fascia signage. 2. Individual Colored Fascia Signs -Tijuana Flats and Tree Steakhouse are trade marked names and they intend to use their own logo, signage colors and letter style. Signs shall consist of internally illuminated individual letters with flat plastic faces in metal retainers mounted to aluminum type letters, all returns and raceways shall be painted. Please allow each tenant their own individuality or else we'll have most signage with the same color and a few with odd colors. Atlantic Beach is very artistic and individuality seems important to its decorative style. 3. Increase Pylon Si n~Height -The tenants need the pylon sign to be fifteen feet (15') to allow for the center's name and address and decorative features. Otherwise we're going to have a plain, unsightly, paneled box for signage. The property sits back off Atlantic Blvd. and each tenant will have bare minimum of drive-by exposure. The tenants desire a prominent sign with matching stainless steel, glass blocks and neon which will entice shoppers and help their business to prosper.
