COMMISSION MEETING STAFF REPORT AGENDA ITEM: Terms and Term Limits for Atlantic Beach Boards and Committee SUBMITTED BY: Tim Hanson Ci . DATE: May 29, 2003 BACKGROUND: At the last commission meeting,. a desire was expressed by the' Commission for the adoption, of uniform terms and term limits for the City's Code Enforcement Board; Community Development Board, Tree Conservation. Board and Cultural Arts and Recreation Advisory. Committee.. A suggestion was also made about. adopting provisions to automatically remove members from these Boards or Committee after a certain number of absences and about the possibility: of requiring the. rotation: of Chairman. Attached for your review and consideration are two documents that; if approved, would impose uniform terms and term limits on the three boards 'and committee. ,The first is a resolution that amends a previous resolution that created the Cultural Arts and Recreation Advisory Committee. The second•is an ordinance, which amends the City Code provisions relating to the three- affected boards. Each of the boards was originally created by ordinance and the Cultural Arts and Recreation Advisory Committee was .created by a resolution. Language already exists in the enabling resolution for the.Cultural Arts' and Recreation Advisory Committee as well as in the City Code creating the Code Enforcement Board for automatic removal for vacancies. The language in the Committee Resolution is as follows; "Members' will be automatically removed from the Committee if they miss three meetings unless their absence is excused by the Chairman." Neither the Community Development Board or Tree Board have provisions for automatic removal of members. for absences. If the Commission would like this language added to the ordinance concerning terms and term limits, it can easily be done prior to the first wading. - AGENDA ITEM 8A JUNE 9, 2003 Presently there is no language in the City Code. or Resolution creating the :Committee that requires the rotation of chairmen. Ifthe Commission wishes to add this to the attached documents, it can be done. No proposed limit on the amount of time a person can serve as Chairman has ....yet been discussed. ]BUDGET: There are no budget issues related to this` action. .RECOMMENDATION: Provide the staff with direction as to the issues of automatic removal for absences and rotation of chairmen. so thanthe attached Resolution and Ordinance can be amended for adoption. COMMITTEE ..AND PROVIDING AN EFFECTIVE. DATE. WHEREAS, on 3uly 8, 2002 the City Commission. adopted Resolution 02-13 creating a Cultural Arts and Recreation Advisory. Committee which included a provision limiting the maximum number of consecutive terms that any appointee may serve, and WHEREAS, the City Comrrussion has expressed a desire for appointments to city boards and committees to have uniform terms and term limits so ghat all members will be appointed for two-year terms and that -there will be a maximum of four consecutive terms. NOdV THEREFORE BE IT RESOLVED, by the City Commission, City of Atlantic Beach as follows; Section. 1. That Section 4 of Resolution 02-13 be .:repealed and that a new section on ..:membership be adopted as follows; There should be a total of nine (9) members .appointed by the Mayor and .Commission. 1~Iembers must be residents of Atlantic Beach. The terms of membership will be for two- years with a maximum of four consecutive terms. The initial appointments will be for staggered terms so that five members will serve. full two-year terms and the remaining .four members will `serve one-year terms. Members will be automatically removed from the Committee if they miss three consecutive .meetings unless the Chairman excuses their absence. A member can choose to resign from the Committee at any time giving written noticeto the City Clerk.. One. member of the Committee shall either be a member of the Atlantic Beach Teen Council or an adult advisor to same. Section 2. Florida: Section 1. The Code of Ordinances of the City of Atlantic Beach, Florida. is hereby amended by amending. Section 2-141 creating the Code Enforcement Board as follows: -Sec. 2-141. Created; membership; terms. (a) There is hereby created a code enforcement board of the city, which shall consist ®f seven (7) members to be appointed by the mayor and approved by the city commission. All members of the board shall be .residents. of the; city and shall serve ..without compealsation. The term of the appointed. members of the board shall be for two j2Zyears and members may serve a maximum of four (4) consecutive terms. Section 2. The Code of Ordinances of the City of Atlantic Beach, Florida is hereby amended by amending Section 14-18 creating the Community Development Board as follows: -Sec. 14-18. Terms of offace of members; falling of vacancies.. Initial appointments to the communty development board shall be as follows: Two (2) members for one year, two (2) members for two (2) years, two (2) members for three (3) . gears, .and one member for four (4) years. Following the initial appointments, the term of the. appointed members. of the community development board shall be for. f(43 two 2 years; except, that the first members appointed shall serve staggered terms as provided. All terms shall expire on December 31 of the proper year. -Any vacancy during, the unexpired term of an appointed member shall be filled by the city commission for the remainder. of the term. Members of the board ma~seek reay~ointment but they shall not serve'more than fear (4) consecutive terms. Section 3. (2) years and three (3) for three (3) years and serve until their _successors are fully appointed and approved by the city commission. Successors to the original members shall thereafter be appointed for terms of twee-{~-)two 2 years.: Vacancies caused by death, resignation, or otherwise shall be filled immediately for the expired term in the same manner as the original. appointments are made.
