AGENDA ITEM: Request by Beaches Habitat to approve a re-plat of a portion of the E. H.
Dormer's subdivision to create seven two-family lots and one single-
f:unily lot on property located on the west side of Francis Avenue, east of
Mayport Road and to be known as the Francis Cove Three subdivision.

BACKGROUND: The Francis Cove Three subdivision will be developed with seven two-
family dwellings and one single-family dwelling for a total of 15 dwelling; units. The
Comprehensive Plan high-density category would permit a maximum of twenty units on this site;
therefore, the re-plat is consistent with the Comprehensive Plan. The site will be: developed in
accordance with the RG-2 Zoning District requirements as well as all other applicable Land
Development Regulations. Construction and continued private maintenance of drainage and
stormwater facilities will be the responsibility of the developer and Homeowner's Association,
as expressed by dedication on page one of the plat.
The Community Development Board considered the preliminary plat at their January 21, 2003
meeting and unanimously recommended approval, subject to the dedication regarding
maintenance of drainage and stormwater facilities, and also that street design comply with City
standards. The project has been somewhat modified since the Community Development Board
meeting, in that the project originally contained twenty multi-family units in live buildings.
Since the change to 15 two-family and single-family units represents a decrease in both density
and intensity; and further; the location of roadways and drainage facilities remains the same; and
the conditions of the Community Development Boazd remain in place, Staff has not required a
second review by the Community Development Board. The Commission has thy: discretion to
return the project to the Community Development Boazd for additional reviE:w if deemed
necessary. Staff finds that the proposed plat is consistent with the Comprehensive Plan and
applicable Land Development Regulations, and accordingly, recommends approval of the
proposed plat.
BUDGET: No budget issues.
RECOMMENDATION: Approval of the Francis Cove Three subdivision, a re-plat of a
portion of the E. H. I)onner's subdivision, subject to a condition that stormwater retention,
drainage facilities and structures shall be privately maintained buy the property owners and
Homeowner's Association and all successors and assigns in ownership.

MINUTES OF MEETING OF
COMMUNITY DEVELOPMENT BOARD
January 21, 2003
The regulaz meeting of the Community Development Board was held on "Tuesday,
January 21, 2003, in the City Hall Commission Chambers. Present were Chair Don
Wolfson, Craig Burkhart, Karl Grunewald, Samuel Jacobson, Mary Walker, Cormunity
Development Director Sonya Doerr, City Attorney Alan Jensen and Recording Secretary,
Susan Dunham.
1. Call to Order
The meeting was called to order at 7:00 p.m.
2. Approval of Minutes of Meetin¢ of December 17.2002
A motion was made by Mr. Burkhart, seconded by Mr. Grunewald and
unanimously carried to approve the Minutes of the Community Development Board
meeting of December 17, 2002.
Election of Officers:
A motion was made by Mr. Jacobson, seconded by Mr. Grunewalld, and
unanimously carried to re-elect Mr. Wolfson as Chair and Mr. Frohwein ;~s Vice-
Chair.
3. Recoenition of Visitors
None.
4. Old Business
a. Final review of proposed revisions to the Evaluation and Appraisal Report on the
adopted Comprehensive Plan. The Boazd agreed to address this item after New
Business.
5. New Business
a. Plat 2003-O1, Francis Cove Three, Beaches Habitat. Request to consider a. re-plat
of certain lands within the E. H. Dormer's subdivision to create five parcels,, which
are proposed to be developed with a total of twenty (20) multi-family residential
units, located within the RG-2 Zoning District, west of Francis Avenue, north of
Stanley Road and south of Dora Street.
Mr. Burkhart acknowledged a conflict of interest and recused himself from proceedings
and voting on this item.
Mr. Brian Kientz of Connelly and Wicker Engineering introduced himself representing
the application. Ms. Doerr advised that several minor notes on the preliminary plat
needed to be changed and these would be corrected on the final plat. She stated that this
parcel is one of the few remaining pazcels that was zoned for multi-family and also has a
Comprehensive Plan designation of Residential, High density. She further stated that this

property is 5.24 acres and has 20 units in five buildings, and is therefore consistent with
the density limitation.
Chair Wolfson recogr..ized Commissioner Desmond Waters.
Mr. Grunewald expressed concern that he did not see any indication of sidewalks in the
plans. Ms. Doerr responded that City regulations require internal sidewalks. Ms. Doerr
also confirmed that irrigation would be placed in the island at the entrance.
Discussion was held with regazd to fencing. Mr. Wolfson stated that he would like a
requirement that any fencing on this property would be green vinyl coated.
In response to questions from the Board Mr. Kientz advised that the homeowner's
association would maintain the stormwater system.
Ms. Doerr reminded the Board that this was a preliminary subdivision plat only and that
construction and engineering plans would be submitted to the City for approval ;after the
final plat was approved by the City Commission.
A motion was made by Mr. Jacobson, seconded by Mrs. Walker, and unanimously
carried to recommend approval of the re-plat. Mr. Burkhart recused himself from
voting and signed Form 8B, Memorandum of Voting Conflict.
4. Old Business
a. Final review of proposed revisions to the Evaluation and Appraisal Report on the
adopted Comprehensive Plan.
Ms. Doerr gave an overview of the Evaluation and Appraisal Report process and the final
elements since the last meeting. She advised that a full transportation element would be
required as part of the amended Comprehensive Plan and a consultant would most likely
be hired due to the technical nature of this issue. Ms. Doerr stated that the Board was
required to make a recommendation to the City Commission to adopt the Evaluarion and
Appraisal Report and then transmit it to the Department of Community Affairs.
A motion was made by Mr. Burkhart, seconded by Mr. Grunewald, and
unanimously carried to recommend to the City Commission the adoption of the
Evaluation of and Appraisal Report and transmittal.
6. Other Reports or Business Not Requiring Action:
Discussion was held with regazd to Mr. Burkhart signing the appropriate affidavit with
regazd to conflict of interest, agenda item S.a. Plat 2003-01, Francis Cove T'hree,l3eaches
Habitat.
Mr. Burkhart rescinded his motion to approve the Minutes of December 1'~, 2002.
Mr. Grunewald rescinded the second.

STAFF COMMENTS AND RECOMMENDATION
The proposed re-plat of a portion of the E.H. Dormer's subdivision will create five new parcels, which
will be developed with twenty multi-family units in five buildings. The subj ect propert~~ is one of the
few remaining undeveloped areas in the City designated for high-density development by the adopted
Comprehensive Plan. The High Density category permits up to twenty dwelling units per acre. The
proposed development consists of twenty units on property containing 2.40 acres.
The proposed re-plat has been reviewed by the Public Works and Public Utility -departments.
Construction and engineering plans will be required to demonstrate compliance with all drainage and
utility requirements. Stormwater permits from the St. Johns River Water Management District will be
required prior to issuance of any City permits. As typical, Planning Deparhnent staff has requested
that provision for the continued private maintenance of stormwater facilities be addressed on ttre Final
Plat and within deed restrictions.
The site will be developed in accordance with the RG-2 zoning district standards, as well as other
applicable land development regulations. Access to each parcel shall be provide by a rcew fifty-foot
wideright-of--way with a 20-foot wide paved, curb and gutter section terminating in a cul-de-sac, and
extending from Francis Avenue on the east of the site. Central water and sewer will be provided. Staff
finds that the proposed plat is consistent with the Comprehensive Plan and the High Density future
land use category. The project is particularly supportive of goals and policies of the Housing Element
of the Comprehensive Plan related to the provision of new housing for low and moderate-income
residents. Staff also finds the proposed re-plat consistent with applicable Zoning, Subdivision and
Land Development regulations, and accordingly, recommends approval of the proposed re-plat.
SUGGESTED ACTION TO RECOMMEND APPROVAL
The Community Development Board may consider a motion to recommend approval to the City
Commission of a proposed re-plat of the E. H. Dormer's subdivision to create five liarcel, which
shall contain a total of twenty multi-family units within the RG-2 Zoning District, to be known
as Francis Cove Three subdivision, and as described within the attached legal description,
subject to the following conditions and Sndimgs:

private maintenance of all drainage improvements and stormwater facilities>.
