Call to Order Chair Ben de Luna called the meeting to order at 6:00 p.m., followed by the Pledge of Allegiance to the Flag. 2. Roll Call Secretary Donna Bartle read the roll, finding a quorum was present. 3. Approval of the Revised Minutes of the Regular Meeting on November 14, 2017. Motion: Approve the revised minutes of the Regular Meeting on November 14, 2017 and the minutes of the regular Meeting of January 9, 2018. Officer Deborah White, Code Enforcement (CE), introduced Attorney John Wallace, who is representing the City. She introduced Shane Corbin, the City's new Community Development Director. Officer White announced the May 2018 meeting has been cancelled. The next meeting is scheduled for July. 5. CE Officer White reviewed the case history of the violations and displayed photos of the property. Mr. Whalen has been operating his lawn service business here since 2003. He stores his vehicles and equipment here and his employees report to this property. Officer White explained that the Code requires the property to be stabilized with asphalt or concrete for storage ofthe vehicles and equipment. Fencing is also required to block the view. Mr. Whalen explained he is having issues moving forward due to the costs involved to construct the parking lot, adding landscaping, construct fencing, adding lighting, etc. Officer White recommended allowing an extension so that she and Mr. Whalen can meet with Community Development Director (CDD) Corbin to research options and work out all the details to meet compliance. Ms. White stated that the paving requirements are a result of the recent Mayport Overlay, which changed the Code, and this is the biggest issue for Mr. Whalen. Officer White stated Mr. Whalen is agreeable to installing the fence and doing the landscaping. Motion: The Board adopts the staff recommendation for Case # 17-570. to allow an extension to the July meeting in order to meet with CDD Corbin and Officer White to research options and achieye compliance. This is rental property owned by Mr. Chambliss. Ms. White reported inspection this date reveals the demolition is in process and near completion. Mr. Chambliss has the required demolition permit. Robert Chambliss, property owner, was present and addressed the Board. He anticipates the dem'olition will be completed within the next couple days or less. He stated he does not have definite plans for the property going forward. The Staff recommendation is to find in violation and allow 15 days for compliance to complete removal of the demolition debris, including the slab. The business owner applied for a waiver but this was denied by the Commission. Officer White reported the hearing notice was received; there were no representatives present. Officer White stated the sign cannot be restored as it was before the damage. Code requires a monument sign to be constructed. The Staff recommendation is to find in violation, allow 30 days for compliance by removing the damaged, non-conforming ground sign. Failure to comply will result in a $250.00 fine for the first day and $250.00 per day fine until full compliance is achieved. The owner is doing Page 8 of II the work on the vehicle. Inspection this date reveals the vehicle is now properly tagged but still has a concrete block in front of it, pending repairs. Michael Steinert, property owner, was present and addressed the Board. He explained how the vehicle broke down and listed all the repairs that have been completed to date. Mr. Steinert stated he hopes to have the 1988 vehicle operating by the end of this week. If not, then he stated he plans to sell it. The Staff recommendation is to find in violation, allow 30 days for full compliance. This is rental property owned by Mr. Halleak and his tenant was storing a large boat in the front yard. Officer White reported inspection this date reveals the boat is gone and the propetty is now in compliance. The Statf recommendation is to find in violation for the time in violation, and now in compliance. There was a brief discussion about the repeat violation process and where a boat could be stored on the property and be in compliance. This is Page 9 of 11 rental propetty owned by Mr. Xingping. His tenant, Micah Huxford, subleased the unit, advetiising on Airbnb. Officer White provided the Board with copies of ads placed on Airbnb, short/long term lease documents, and some customer reviews for this propetiy, which is attached and made part of this Official Record as Exhibit A. Ying Jacobs was present and stated she is a friend of the property owner. Chair de Luna administered the Oath to Ying Jacobs, 2016 Sandpiper Pt., Neptune Beach. Ms. Jacobs confirmed she is a friend of the property owner, not the property manager. Micah Huxford, tenant, was present and addressed the Board. Mr. Huxford stated he rents the propetty from Mr. Xingping. He stated he has done short/long term leases of this property, but has stopped the short term leases -anything less than 90 days. Currently he has a long-term lease agreement for a business providing engineering services at Adventure Landing. Officer White reported she has received numerous complaints from neighbors about the increase of traffic on the property, the number of vehicles, the number of out-of-state vehicles, etc. There was discussion about prorating the lease agreements, which makes them short-term leases, anything less than 90 days. Pro-rating needs to be removed and the lease agreement should be for at least 90 days. including the names of the people occupying the property listed on the lease agreement. City Attorney John Wallace addressed the Board and spoke about correcting and changing the language in the lease agreements going forward. Mr. Huxford agreed to do this. The Staff recommendation is to find in violation, cease all short-term rentals for periods of less than 90 days immediately, and advertising of same. Failure to comply and/or future violations will result in a $250.00 fine for the first day, and $250.00 per day fine until full compliance is achieved. Rehearing CASE#: 14-1335 NAME: Pillar, LLC ADDRESS: 1202 Jasmine Street VIOLATION(S): Section 22-74 CE Officer White presented a brief synopsis of the case history of the violation, the property going into foreclosure, purchased by Pillar, LLC with an accrued fine of $44,293.50, property brought into full Page 10 of 11 compliance, and then a request by Pillar, LLC for the Board to consider a reduction of the accrued fine. The Board reduced the fine to $27,000.00 in November 2017. Ms. White stated she received a records request from Pillar, LLC for any similar code enforcement cases with accrued fines that were reduced by the Board. There was one case in 2014, #1240 at 995 Camelia St., with a $65,820.00 fine that was reduced to $500.00. CE Officer White reported that Pillar, LLC has requested a rehearing to consider further reduction of the $27,000.00 fine. At the direction of City Manager Gerrity the case was placed on this agenda. Chair de Luna expressed concern that the request does not meet the requirements per Code for a request for rehearing. Michael Sean Griffith, of Pillar, LLC, took the floor to address the Board. Mr. Griffith stated that the reduced fine of $27,000.00 (from November 20 17) is now incurring 10% interest with the City of Atlantic Beach and he cannot afford to pay this. Mr. Griffith stated he met with City Manager Gerrity, Deputy City Manager Hogencamp, and City Attorney Durden about obtaining relief from this fine. At their suggestion, he found examples of similar propetiies/cases where the Code Enforcement Board (current/past) extended favorable leniency and then presented it to them. Mr. Griffith stated he even offered to give this property to the City of Atlantic Beach because he cannot afford to pay the amount due. He explained his offer was declined and it was suggested to request a rehearing with the Code Enforcement Board for reduction of the fine. Chair de Luna explained the history of this case and reiterated to Mr. Griffith that his request for a rehearing does not meet the requirements per the City Code. There was a brief discussion and no motion was made. Chair de Luna explained the without a motion, we are done. City Attorney Wallace was asked to convey this information to City Attorney Durden and Mr. Gerrity. Closing Comments City Clerk Bartle explained the change to the November meeting and agreed to send out the 2018 meeting schedule. Chair de Luna thanked Commissioner Kelly for her observation of the person who had not been sworn in. The Board discussed the meeting schedule and the process for calling special meetings. Chair de Luna thanked the staff and Committee. He requested that the Board Secretary monitor those needing to be sworn in and he would try to remember to ask. Chair de Luna explained the need to discuss succession at the next meeting.
