AN ORDINANCE AMENDING THE CODE OF ORDINANCE S OF
THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CERTAIN
SECTIONS OF CHAPTER 8 FLOOD HAZARD AREAS, ARTICLE 1, IN
GENERAL, AND ARTICLE III, FLOOD HAZARD REDUCTION
STANDARDS, TO COMPLY WITH REQUIREMENTS OF THE NATIONAL
FLOOD INSURANCE PROGRAM AND THE COMMUNITY RATING
SYSTEM; PROVIDING AN EFFECTIVE DATE.
BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE
PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA:
SECTION I. Section 8-5 Definitions, "Structures",.and Section 8-7 Basis
for establishing the areas of special flood hazard, and Sec. 8-33, Standards for
streams without established base flood elevations and/or floodways (a) and (b), of
the Code of Ordinances of the City of Atlantic Beach, Florida, are hereby
amended to read as follows:

special flood hazard identified by the Federal Emergency Management Agency in
its Flood Insurance Study/ Flood Insurance Rate Map, dated "~~-~'~.~"m
April 17. 1989, with accompanying maps and other supporting data, and any
revision thereto, are adopted by reference and declared to be a part of this chapter.

floodwav data have not been provided in accordance with Article 1. Section
8-7. then the local administrator shall obtain. review, and reasonably utilize
any base flood elevation and floodwav data available from a federal, state.
or other source in order to administer the provisions of Article III.

engineering certification should be supported by technical data that
conforms to standard hydraulic engineering~rincinles.
SECTION 2. The Code of Ordinances of the City of Atlantic Beach.
Florida. is hereby amended by adding a new definition under Section 8-5.
and a new subsection C~ under Section 8-33. which shall read as follows:
"Section 8-5. Definitions. Lowest Floor means the lowest floor of
the area lowest enclosed area. (including basementl ofa building An
unfinished or flood resistant enclosure. used solely for parking of vehicles
building access. or storage in an area other than a basement is not
considered a buildings lowest floor provided that such enclosure is not built
so as to render the structure in violation of the nonelevation design standards
of this ordinance. Structures mean a walled and roofed building that is
principally above ground. a manufactured home or a gas or liquid storage
tank.
Section 8-33. Standards for streams without established base flood
elevations and/or tloodwavs.
(c) In special flood hazard areas without base flood elevation and
floodwav data. new construction and substantial improvements ofexisting
structures shall have the lowest floor of the lowest enclosed area ,(including
basement) elevated no less than two (2) feet above the hi hg est adjacent

SECTION 3. This ordinance shall become effective October 1.2003.

Section 8-7. Basis for establishing the aeeas of special flood hazard. The

1989, with accompanying maps and other supporting data and any revision thereto,
arc adoptul by reference and declared to be a part of this chapter.
Section 8-33. Standards for streams without established brio flood
elevations and/or floodways. Located within the'azeas of special flood hazard
established in section 8-7, where small streams exist bttt where no base flood data
have been provided or where no floodways have been provided, the following
provisions apply:
(a) When base flood elevation data or floodway data have not been
provided in accordance with Article I, Section 8-7, then the local adminisaator shall
obtain, review, and reasonably utilize any base flood elevation and floodway data
available from a federal, state, or other source in order W administer dte provisions
of Article III.
(b) In special flood hazard areas with base flood elevations (Zone AE)
but without floodways, no encroachments, including fill material or structures, shall
be permitted unless cerdficadon by a registered professional engineer is provided
demonstrating that the cumulative effect of the proposed development, will not
increase the water surface elevation of the base flood more than one foot at any

point within the community. The engineering certification should be supported by
technical data that conforms to stvrdazd hydraulic engineering principles."
