Exh 9AAGENDA ITEM N9A SEPTEMBER 8, 2003 CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Request from Rainer and Doris Rosarius for a waiver from Section 24-255 (a) of the Subdivision Regulations seeking approval to reconfigure Lots 2, 3 and 4 within Block 125 of Section H subdivision to create hvo lots with one lot that is less than 75 feet in width and less than 7,SOU square feet in Lot Area. SUBMITTED BY: Sonya Doerr, AICP ,~~ Community Development Director DATE: August 26, 2003 BACKGROUND: Section 24-255 (a) of the Subdivision regulations requires all newly created residential lots to have a width of not less than 75 feet and lot area of not less than 7,500 square feet. The applicants own three 50-foot wide by 102-foot deep lots on Main Street within the Section H subdivision. They wish to reconfigure the existing three lots to create two lots: one lot that is 85-feet in width and 8670 square feet in lot area, and the second lot with a width of 65-feet and 6630 square feet in lot area. Because one of the proposed lots does not comply with the minimum width and lot area, Staff cannot approve the proposed lot division unless the Commission grants a waiver to the subdivision regulations. The proposed lot reconfiguration is consistent with the Comprehensive Plan, and the resultant two lots will be larger than the typical 50-foot by 100-foot platted lot within the Section I-I subdivision. Further, the proposed lot reconfiguration will decrease density in that the property now consists of three platted lots of record, and asingle-family residence could be constructed upon each existing lot. Accordingly, staff recommends approval of the subdivision waiver, subject to the property owners providing a new survey to the Community Development Director for approval in accordance with Section 25-189 (a) (4). BUDGET: No budget issues involved in this request. RECOMMENDATION: Motion to approve a waiver of Section 24-255 (a), finding the request to be consistent with the Comprehensive Plan, and allowing for three platted Lots of Record to be reconfigured into two lots, which are 65-fr wide by 102-fr deep and 85-fr wide by 102-fr deep, to be approved in accordance with Section 25-189 (a) (4). I would like this letter to serve as a request for the subdivision of the lots listed above in the following manner pursuant to ordinance 90-01-172 section 24-191 (waiver). The Northern lot line between lots 3 and 4 will be moved 15 feet North creating a 65 foot lot #4. The remainder of lot fi3 will be added to lot #2 to create a single lot that measures 85X102. A marked up survey is attached showing the requested changes. I have met and. discussed with all of the residents living on Main Street between 3`d and 6m Streets and have found no one that feels this subdivision would be injurious or detrimental to the other residences in this area. Most comments that I received were that the larger lots in addition to the new single family home to be built would greatly benefit this portion of Main Street. In closing, I ask that the commission will grant this subdivision and allow this section of Atlantic Beach to continue to improve it's quality of life.
