Subject: Request for Waiver of Mitigation (TREE18-0059)
1. I recently submitted a Tree Removal request to the city to remove a 20” Live Oak
that is pending approval waiting for me to submit a mitigation plan.
2. I am requesting a waiver for mitigation for the following reasons:
a. When my house was built in the late 1980’s the city approved a site plan that
kept a Live Oak within 36 inches of the foundation. This tree was also leaning
towards the house so the roofline had to be notched to accommodate this tree.
After 30 years this tree has outgrown the notch and my roof is becoming
embedded into the tree. In addition shoots from this tree have penetrated the
space between my foundation and stucco causing damage.
b. I am now left dealing with a problem that should have been foreseen by the
city and the original builder. I have no information on the decision process
regarding this tree at the time the house was built. In my opinion the decision
to allow the house to be built around this tree was a poor decision. The house
should have been sited further from the tree, as there was sufficient space in
the front yard to do so. The tree could have been removed and mitigated then.
Had a better decision been made 30 years ago, I would not be facing this
problem of having to remove a healthy tree.
c. This tree will be technically difficult and expensive to remove, creating a high
level of risk to the workers carrying out the removal, causing further damage
to my roof and possible collateral damage to my driveway from the weight of
the crane needed for removal.
3. In summary I am asking for permission to remove the tree and relief from mitigation
due to a poor decisions made years ago when this house was originally built.
