Nuisances (a) It shall be unlawful for any person or business, to do, perforin, have, allow, suffer or permit any act, occurrence or condition within the city which constitutes a dangerous, unsafe, dilapidated or unsanitary condition,which may be injurious to the health and well being of the community. Sec. 401.1 The provisions of this chapter shall govern the minimum conditions and standards for light, ventilation and space for occupying a structure. Sec. 401.2 Responsibility. The owner of the structure shall not occupy as owner/occupant, or permit another person to occupy, any premises that do not comply with the requirements of this chapter. Sec. 401.1 Habitable space. Every habitable space shall have not less than one window of approved size facing directly to the outdoors or to a court. The minimum shall total glazed area for every habitable space shall be 8 percent of the floor area of such room. Wherever walls or other portions of the structure face a window of any room and such obstructions are located less than 3 feet from the window and extend to a level above that of the ceiling of the room, such window shall not be deemed to face directly outdoors not to a court and shall not be included as contributing to the required minimum total window area for the room. Sec. 24-111 Commercial general districts (CG). (a) Intent. Within the City of Atlantic Beach, the CG zoning district is intended for uses, which provide general retail sales and services for the City of Atlantic Beach and the closely surrounding neighborhoods. New development and new uses within these districts should have direct access to arterial or collector streets, and sites should be designed so that increased traffic through adjacent residential neighborhoods is avoided. The City of Atlantic Beach is a predominantly residential community, and it is a stated goal within the comprehensive plan that the residentialcharacter of the city should be retained. As such,the appropriate level of intensity for general commercial uses may be less than other communities with large commercial zones or a more diverse mixture of uses in close proximity. (g)Within all residential zoning districts, and also including any property containing a residential use, household items, furniture and those items customarily intended for indoor use shall not be displayed, maintained or permanently stored outdoors, or in any location on the lot where such items are visible from adjacent properties. Discarded or unused household items shall be stored or properly disposed of to avoid mold, rodent and insect infestations which may result in health risks and which also create unsightly appearances that negatively affect neighborhoods. Such violations shall be corrected immediately upon written order from the city. Unit 143 Outside storage of pallet, logs, misc. including trailer with no tag with logs stored. Sec. 24.154 Outdoor display, sale and storage of furniture household items, merchandise and business activities outside of enclosed buildings. * (g) Within all non-residential zoning districts, the outside display of products, or outside sale of furniture, clothing, dry goods, hardware or other similar merchandise, equipment and materials, and also street vendors, shall be prohibited. Sec. 502.1 Dwelling units. Every dwelling unit shall contain its own bathtub or shower, lavatory,water closet and kitchen sink which shall be maintained in a sanitary, safe working condition. The lavatory shall be placed in the same room as the water closet or located in close proximity to the door leading directly into the room in which such water closet is located.A kitchen sink shall not be used as a substitute for the required lavatory. (b) DWELLING UNIT. A single unit providing complete, independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation. Unit 152 Occupied and being used as a dwelling without minimum requirements, plumbing,ventilation etc. This letter requests that the noted violation(s) be corrected by ceasing occupancy of"storage units" and removing all unlicensed, inoperable, junk, outiside storage, dismantled vehicles from the premises within ten (10) days of the receipt of this notice. To avoid having this case be referred to the Code Enforcement Board, all listed violations on this notice must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The Board may impose fines up to two hundred fifty ($250.00) per day for continuing violations. Upon completing the corrective action required, it is your responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.
