ADDITIONAL FINES FOR DOGS AND CATS IN HEAT, REPEALI1i?G
REGISTRATION ANTD TAGGING REQUIREIVIIIVTS, AND PROVIDING
AN EFFECTIVE DATE.
BE IT ENACTID BY THE CITY CONIlYITSSION ON BEHALF OF THE PEOPLE
OF THE CITY. OF ATLANTTIC BEACH, FLORIDA:
- SECTION 1. Sections 4-il(2), 4-23, 4-24 and 4-30(b)(3) of the Code of Ordinances
of the City of Atlantic Beach, Florida. aze hereby amended to read as follows:
"Sec. 4-11. Classification of dogs as dangerous; certification of registration; notice of
hearing requirements; cont`mements of auimal; exemption; appeals;
...unlawful acts.
(2) Within fourteen :(14) days after the dog has been classified as dangerous by
he animal control -authority or, a dangerous .dog classification is upheld by .:the
county court on appeal; the owner of the dog must obtain a certificate of registration
-for the dog .from the animal control authority ser~iing the: area in which he or she
resides, and the certificate shall be ienewed annually.;' The annual cost for such
certificate of registration shall be one hundred dollars ($100.00). Anhnal .control
authorifles are authorized to issue such certificates of registration; and renewals
thereof, only to persons who are at least eighteen (18) years of age and who present
to the animal control authority sufficient evidence of:
Sec. 4-23. Impoundment for unregistered dogs and cats.
Any unregistered dog or cat `found iri ,the city: shall be picked 'up by the 'city or the
.designated authorized agent of the city and. placed in a shelter for a period of not less than three (3)
days ,nor more than seven ('~ ,days, :except. the animal may. be released sooner upon identification
and .compliance with the registration requirements contained herein, and upon the payment of a
'.~:en~y a^'~ {28:89) thirty dollar ($30.00) fee plus an additional seven dollazs ($7.00) per day for
the redemption be of said animal.. _ In the event any animal has to be tranquilized with chemical
ca tub re e uipment then the redemption fee shall be one hundred dollars ($100 001 The
registratio~r fee for unregistered dogs or cats. that have been picked up shall be double the fee in
effect on the day the dog or cat is picked up.

Sec. 4-24. Running at large.
It shall be unlawful for the owner of any dog. or cat to permit or allow the dog or cat to
commit a nuisance or to. be found running at lazge on any of the public streets, parks, playgrounds,
alleys, beaches or vacant lots inthe city and such dog or cat. shall be picked up by the. city or the
designated authorized agent of the city and placed in a shelter for a period of not less than three (3)
`.days nor more than seven (~ days; except-the: animal may be released sooner upon. proper
identification and compliance with the registration requirements :contained herein, and upon-the
payment of a _ thirty dollar $30.00) fee plus addifional seven dollars ($7.00)

`Sec. 430. Citations authorized;. penalties provided.
(b) Violations of this article shall be punishable s as follows:
(3) Third and subsequent offenses: (The current offense is a third or subsequent
offenses if there have been two (2) or more previous citations within the preceding thirty-six (3~
months). Two hundred fifty ($250.00) ,and/or sixty {(0) days in jail• if not paid in fourteen (14)
days, fine. goes to five hundred dollars ($500,00). .Mandatory appearance before the code
enforcement board."
SECTION 2. The Code of .Ordinances of the City of Atlantic Beach, klorida, is hereby
amended by adding new sections to be numbered Sec. 4-11 (2)(d) and Sec. 4-30(b)(~, which
sections shall read as follows:
"Sec 411(2)(d). Liability insurance in the amount of at least on one hundred thousand
dollars ($100.000,003 toeether with a surety bond on said dog of at least one hundred
thousand dollars ($100 000 00~
Sec. 430, (b)(~. An additional fine of one hundred dollazs ($100 00) for any violation
involving a dog or cat m heat "
SECTION 3. Sec.' 4-22. Registration and tagging'required, of Chapter 4 Animals, Article
II. Dogs and Cats, of the Code of Ordinances. of the. City of Atlantic Beach, Florida, is hereby
replealed.
