STREET CONSTRUCTED IN THE RIGHT OF WAY MUST BE REPLACED WITH LIKE SIZE AND MATERIALS AND PERMITS) IPMC Sec 304.2 Protective treatment. All exterior surfaces including but not limited to, doors and window frames, cornices, porches, trim, balconies, decks and fences, shall be maintained in good condition. Exterior wood surfaces, other than decay-resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints, as well as those between the building envelope and the perimeter of windows, doors and skylights, shall be maintained weather resistant and water tight. All metal surfaces subject to rust or or corrosion shall be coated to inhibit such• rust and corrosions and all surface with rust or corrosion and shall be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces designed for stabilization by oxidation are exempt from this requirement( CLEAN PAINT EXTERIOR OF BUILDING INCLUDING EXTERIOR DOORS Section 24-160. -Dumpsters, garbage containers and refuse collection areas and above ground tanks. Jensen, City Attorney 411 11- DATE: October //,2011 BACKGROUND: The owners of Laura Plaza at 469 Atlantic Boulevard have requested an easement from the City. The existing building at this address encroaches approximately one (1) foot into the City's right-of-way on Sturdivant Avenue. The building Was constructed in approximately 1983 and the encroachment into the City's right-of-way has existed since that time. I am not sure how the-encroaehment came into existence,but perhaps it was because of a defect in a prior legal description, in a permit issued by the City, or the like. The owner of the property is requesting an easement in order to satisfy title insurance requirements if they are to dispose of the property,refinance it,or the like. Attached is a proposed Easement.prepared by the attorneys for the owners of Laura Plaza, which I have reviewed and find acceptable. Please note that the easement will run with the land and continue in existence until such time as the current building is either demolished or destroyed, at - which time the easement will expire and terminate. Hello Mr.Van Liere, I'm wanting to get the building at northeast Sylvan and Sturdivant cleaned up in the back. It's really becoming an eyesore with trash out back,graffiti, broken stairs, run down ac units,etc.The entire building could use a fresh coat of paint. Please take a look at the attached pictures.Can the city play a role in contacting the owner of the building and forcing them to clean up? I also understand that the back walkways might be on city property?They are also in need of repair. Finally,the signs on windows of nail salon,facing west,are a bright pink and really an eyesore. Does our sign ordinance help in forcing them to either take these down or put up a more attractive color? International Property Maintenance Code/City Code of Ordinances Section 24-160 Dumpsters, garbage containers and refuse collection areas and above ground tanks. (b) Within commercial zoning districts, dumpsters, trash receptacles, above ground tanks and similar structures and containers shall be screened from view by fencing or landscaping, or shall be located so that these are not visible from adjacent properties or streets. Above-ground tanks used to store hazardous, chemical or explosive materials may remain unscreened upon determination by the Director of Public Safety that a threat to security and public safety may result from screening such tank(s) from view. IPMC Sec 304.2 Protective treatment. All exterior surfaces including but not limited to, doors and window frames, cornices, porches, trim, balconies, decks and fences, shall be maintained in good condition. Exterior wood surfaces, other than decay-resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints, as well as those between the building envelope and the perimeter of windows, doors and skylights, shall be maintained weather resistant and water tight. All metal surfaces subject to rust or or corrosion shall be coated to inhibit such rust and corrosions and all surface with rust or corrosion and shall be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces designed for stabilization by oxidation are exempt from this requirement. IPMC 305.4. Stairs and walking surfaces. Every stair, ramp, landing, balcony, porch, deck or other walking surface shall be maintained in sound condition and good repair. IPMC Sec.304.10 Stairways, decks, porches and balconies. Every exterior stairway, deck, porch and balcony, and all appurtenances attached thereto, shall be maintained structurally sound, in good repair, with proper anchorage and capable of supporting the imposed loads. The Code Enforcement Board may levy fines up to $250.00 per day for the first violation and $500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the violation is not corrected by the time specified for correction by the Code Enforcement Officer, the case could be presented to the Code Enforcement Board even if the violation has been corrected prior to the Board hearing. Upon completing the corrective action required, it is your responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance at(904) 247-5855.
