Mr.Sykes:
Just wanted to follow up and let you know I had spoken to the sign contractor on this case to advise compliance can be
met with the removal of the pylon sign. There is not requirement to install a new sign on the site. He agreed to remove
the sign and post.A permit application, plans and engineering can be submitted for a new sign any time after the sign in
violation is removed. If you have any question, please let me know. Thanks, Debbie

Dear Deborah:
The undersigned is legal counsel for and represents Star Realco LLC, the owner of the above-
described real property. My client recently received an Order Imposing Fine (Case No. 17-0279), a copy
of which is enclosed herewith, with respect to existence of a non-conforming sign upon or about said
property, requiring that the same be removed on or by April 12,2018. While my client is in the process of
replacing the subject sign, it is not feasible for the same to occur on or by April 12, 2018, and as such, we
are requesting an extension of the time in which to complete the necessary corrective action.
As a matter of background,the panels on my client's pylon were damaged last fall during inclement
weather. My client attempted to replace the panels; however, they were advised that the sign was non-
conforming and needed to be removed and replaced with one that was consistent with the standards set
forth in the City's Code of Ordinances. Pursuant to the process outlined in Chapter 17 of the City's Code
of Ordinances,my client submitted a waiver request to allow for the replacement of the sign panels(keeping
and maintaining the main sign structure and cabinet intact),which request(WAIV18-0003)was denied on
February 26, 2018. Since that time, my client has working on the design of a replacement sign (which is
consistent with the standards and requirements of the City's Code of Ordinances); however, as of the date
of this correspondence,the same is still in process.
Please accept this correspondence as Star Realco's formal written request to extend the time for
performance set forth in the Order Imposing Fine from April 12, 2018 until May 30, 2018 and to suspend
any further enforcement action with respect thereto. The foregoing extension will provide Star Realco with
sufficient time to complete the design of a new conforming sign, to obtain any and all permits related
thereto, and to remove and replace the existing non-conforming sign.

In the event that any sign, including an exempt sign, is determined by the:building official to be unsafe,
such sign shall be immediately removeupon written notice from the building official ordering removal.
Such notice shall be sent,by certified:mail to,the property owner of record. If not removed within ten
(10) days, the sign shall be considered a hazard to;public safety''and shall be removed at the property
owner's expense.
CONCLUSIONS OF LAW
THAT the Respondent is NOT IN COMPLIANCE and has failed to correct such violation as of this
hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,
Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance within 30
days on or before April 12, 2018. Compliance will require non-conforming pylon sign including posts
be removed from the premises. Failure to comply will result in fines of two hundred fifty dollars
($250.00) for the first day and two hundred fifty ($250.00) per day every day the violation continues to
exist. In addition, any fine shall also include the administrative costs to the City incurred in prosecuting
this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement
Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at 1500
MAYPORT RD for the total assessment plus costs incurred for,the-fling of the lien. All lien amounts
are to be made payable at an interest rate of ten (10) percentper,annum,firom date of certification until
paid.

ARTICLE IV. - NONCONFORMING SIGNS AND WAIVER TO CERTAIN PROVISIONS
Sec. 17-51. - Nonconforming signs.
All signs, which were lawfully in existence and constructed or installed with properly issued sign
permits as of the effective date of these amended regulations, and which are made nonconforming by
the provisions herein shall be allowed to remain in accordance with the following conditions:
(1) Freestanding signs, permitted pursuant to section 17-29, made nonconforming
upon the initial effective date of these amended regulations, which are not in
compliance only with respect to the minimum required distance of five (5) feet
from any property lines shall be allowed to remain in the existing location
provided that no portion of the sign is located within any publicly owned right-
of-way or utility easement and that no interference with clear sight distance
exists, and further provided that such signs are otherwise in compliance with
the terms of this chapter.
(2) Freestanding signs, permitted pursuant to section 17-29, made nonconforming
upon the initial effective date of these amended regulations, which are not in
compliance with respect only to maximum width, height or size shall be
allowed to remain, provided that such signs are otherwise in compliance with
the terms of this chapter.
(3) Nonconforming signs, including those as described in preceding paragraphs
(1) and (2) shall be made conforming with all provisions of this chapter when
any of the following changes are made:
a. Any change to the structural supports or structural materials, including
temporary relocation associated with routine maintenance of a property.
b. Any change which increases the illumination.
c. Any change which increases the height of a sign.
d. Any change, which alters the material used for the display area or face
area by more than twenty-five (25) percent.
e. Any replacement required as the result of an accidental act or a weather-
related act.
f. Any replacement of an abandoned sign.
g. Any change necessary for compliance with Florida Building Code
requirements.

(4) The provisions of this section shall not be construed to apply to signs that are
abandoned, deteriorated, dilapidated, or in a general state of disrepair, or
which are determined to create a hazard to public safety. Such signs shall be
subject to the provisions of section 17-33.

Sec. 17-52. - Requests to waive certain terms of this chapter.
Requests to waive terms of this chapter may be made upon specific application to the city
commission, with proper public notice required, provided that no waiver shall be requested that would
allow a prohibited sign, or any otherwise unlawful sign. The applicant requesting such waiver shall
have the burden of demonstrating the need for the requested waiver, and that the waiver is not in
conflict with the intent of this chapter. The terms of any waiver to the provisions of this chapter shall be
established by order of the city commission.

The Code Enforcement Board may levy fines up to $250.00 per day for the first violation and $500.00
per day for a repeat violation. If the violation is corrected and then recurs or if the violation is not
corrected by the time specified for correction by the Code Enforcement Officer, the case could be
presented to the Code Enforcement Board even if the violation has been corrected prior to the Board
hearing. Upon completing the corrective action required, it is your responsibility to contact Atlantic
Beach Code Enforcement and arrange for an inspection to verify compliance at(904) 247-5855.
You have the right to obtain an attorney at your own expense and to present witnesses in your behalf. If
you desire to have witnesses subpoenaed or if you have questions regarding the procedure, please
contact Dayna Williams, Secretary of the Code Enforcement Board within five days of the receipt of this

Please be advised, Atlantic Beach Code Enforcement has found your property referenced above to be in
violation of the City of Atlantic Beach, Code of Ordinances,to wit:
VIOLATION(S)
Sec. 17-41. Removal of unsafe, damaged or poorly maintained and abandoned signs. (a) Unsafe signs.
In the event that any sign, including an exempt sign, is determined by the building official to be unsafe,
such sign shall be immediately removed upon written notice from the building official ordering removal.
Such notice shall be sent by certified mail to the property owner of record. If not removed within ten
(10) days, the sign shall be considered a hazard to public safety and shall be removed at the property
owner's expense.
This letter requests that the noted violation(s) be corrected by removing damaged non-conforming
pylon sign within five (5) days of the receipt of this notice (permit required for any new signage).
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this notice
must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The
Board may impose fines up to two hundred fifty ($250.00) per day for continuing violations. Upon
completing the corrective action required, it is your responsibility to contact Atlantic Beach Code
Enforcement and arrange for an inspection to verify compliance.
