My client recently received an Order Imposing Fine (Case No. 17-0279), a copy of which is enclosed herewith, with respect to existence of a non-conforming sign upon or about said property, requiring that the same be removed on or by April 12,2018. While my client is in the process of replacing the subject sign, it is not feasible for the same to occur on or by April 12, 2018, and as such, we are requesting an extension of the time in which to complete the necessary corrective action. As a matter of background,the panels on my client's pylon were damaged last fall during inclement weather. My client attempted to replace the panels; however, they were advised that the sign was non- conforming and needed to be removed and replaced with one that was consistent with the standards set forth in the City's Code of Ordinances. Pursuant to the process outlined in Chapter 17 of the City's Code of Ordinances,my client submitted a waiver request to allow for the replacement of the sign panels(keeping and maintaining the main sign structure and cabinet intact),which request(WAIV18-0003)was denied on February 26, 2018. Since that time, my client has working on the design of a replacement sign (which is consistent with the standards and requirements of the City's Code of Ordinances); however, as of the date of this correspondence,the same is still in process. Please accept this correspondence as Star Realco's formal written request to extend the time for performance set forth in the Order Imposing Fine from April 12, 2018 until May 30, 2018 and to suspend any further enforcement action with respect thereto. The foregoing extension will provide Star Realco with sufficient time to complete the design of a new conforming sign, to obtain any and all permits related thereto, and to remove and replace the existing non-conforming sign. (2) Freestanding signs, permitted pursuant to section 17-29, made nonconforming upon the initial effective date of these amended regulations, which are not in compliance with respect only to maximum width, height or size shall be allowed to remain, provided that such signs are otherwise in compliance with the terms of this chapter. (3) Nonconforming signs, including those as described in preceding paragraphs (1) and (2) shall be made conforming with all provisions of this chapter when any of the following changes are made: a. Any change to the structural supports or structural materials, including temporary relocation associated with routine maintenance of a property. b. Any change which increases the illumination. c. Any change which increases the height of a sign. d. Any change, which alters the material used for the display area or face area by more than twenty-five (25) percent. e. Any replacement required as the result of an accidental act or a weather- related act. f. Any replacement of an abandoned sign. g.
