BACKGROUND: Section 24-255 (a) of the Subdivision regulations requixes all newly.
.created residential' lots to have a width of not less than 75 feet and lot area of not less than 7;5.00
square feet. The applicant and her family own one 50-foot wide by 130-foot deep lot (Lot 20) on
Eighth Street and also one-half of each of the two adjacent 50-foot wide lots. The applicants
wish to reconfigure their existing property to create two 50-foot wide by 130-feet deep lots...
The sub}ect property is located within the RL (Residential, Low Density) Comprehensive Plan.
land use category;: which. requires 7260 squaze feet of lot area. per dwelling .unit. The proposed:
lots would contain only 6500. square feet of lot azea. As such, staff cannot find that the two.
proposed 50-foot by 130-foot lots are corisistenf with the'Comprehensive Plan. Staff recognizes
that the original platting pattern_of this area consisted. of SO by 100-foot lots; however, as
indicated. by the attached property appraiser's map; many lots within this azea have been
reconfigured such that the 50 by 1.00-foot lot is no longer the predominant lot size.
BUDGET: No budget issues involved in this request.
RECOMMENDATION: Motion to deny a request for a waiver of Section 24-255 (a), finding
that the two proposed lots, which. are 50-foot wide by 130-foot deep and containing 6500 squaze
feet each, are not inconsistent with the Residential, Low Density Comprehensive Planland use
designation:

First, thank you for educating my brother and me on the history and challenges of
development in Atlantic Beach. Having grown up on 8th Street, we never realized.
.This letter is in reference to our coriversafion of a Subdivision Waiver for our family land
at 34Y 8~' Street in Atlanfic Beach. I would like to :request a subdivision of the lots listed
above. The ordinance involved is 90-01-172, secfiori 24-19 L We are requesting the 100'
- recorded parcel be subdivided into two lots of size consisting of 50' x 130' buildable size
lots. This would be done by subdividing: Lot 20 in half and joining the West 1/2 Lot 20
with East '/z Lot 22 to create orie lot 50' x 130' to create a lot of record.. The East'/z Lot
20 and the. West'/Z Lot 18 would become a second similar lot of record..
A survey is provided for your review. Each lot would be 6500 square feet. Each lot
would be able to be built upon withoutvariance to setback. Each lot would be for a
single family dwelling within boundary guidelines. My brother Mitchell will be the
general contractor.
.The land has been deeded in my father's name for 30.years, and in my fathers and mine
since 1994 (until 1999 wherein my father quit claimed the deed to me). I would now like
to share thafbetween my brother Mitch, my husband John and myself and build two
single family homes. One house is to be sold. The other house will be occupied for
many years to come by our immediate family.
