Dear Mr.Morello;
First,it is disappointing to hear that there are continued problems between you and your neighbors on
Oceanside Court. We had hoped that the completion of your construction project would settle things
down a bit.
Copies of your letter of May 29th were discussed with members of both Police and Zoning Departments
and I have the following responses;
1) Oceanside Court is a private street. Our Police Department will provide enforcement of parking
complaints,but only if they relate to a street being blocked or causing a safety hazard. Their
authority to issue parking citations on this street is more limited than it is on a public street.
2) Police records show that only one complaint has been received about parking on Oceanside Court
in recent months. Presumably,this was the complaint about your car which led to your discussion
with the officers about parking. There does not appear to be any evidence that the Police
Department is enforcing rules for one person and not another. If you have anything further on this,
please let me know.
3) Your letter expresses a concern about future construction causing obstructions on the street. You
should feel free to call the Police Department when and if this occurs. You should also understand
that the City's Building Department requires a Construction Management Plan for all major
building permits which include a plan of where the contractor intends to have their employees and
equipment parked. I am sending a copy of this response to our Building Official to make him
aware of your concerns and ask that he be vigilant to spot any problems that could be created in
future projects.
4) Your letter also discusses easements on either end of Oceanside Court. These are easements on
private property and not made to the City of Atlantic Beach.They are a matter between private
property owners. However,I will forward this response also to the President of the Homeowners
Association so that they can be aware of this issue if he is not already.

RE: ROAD EASEMENT OCEANSIDE COURT
Dear Mr. Hanson:
I am writing to inform you that my family has moved into our wonderful home on
Oceanside Court. Unfortunately, tensions here have not reduced. Just two days
ago, the city police were called to my street because my car, parked in my own
driveway, extended about two feet onto the street, which is not even a public street,
but an easement of my own property. My car did not block anyone's access to
their own property or their ability to park on the street. Today, however, I have
photographed cars (see enclosed photos) of visitors for the holiday weekend,
completely blocking access to the driveways at 2291 and 2293 Oceanside Court,
and cars parked backwards in front of 73 Oceanside Drive, an offense for which
I've been ticketed in the past. My point, rules on this street seem to be enforced
based on who breaks them. I'm not looking for more trouble with the residents
here, but I need to reemphasize that a large part of the problem (in addition to
personal vendettas which cannot be rectified) causing tensions on this block stem
from the fact that two of the street easements that were supposed to be available to
all residents, were closed off by the owners when their land was developed and
their houses were built. More specifically, the houses of 2291 Oceanside Court, 54
Oceanside Drive, 2297 Oceanside Court, and 33 Oceanside Drive have blocked
parking access on their street easements because those easements have been
incorporated into either the homeowner's personal driveway or private backyard.
Having just built my own home, I know the tensions that arise when people are
unable to get into their own driveway because it is blocked. If the houses at 2291
and 2297 Oceanside Court, and 33 and 54 Oceanside Drive ever wish to renovate
or reconstruct on those sites, the construction parking would prohibit the rest of us
at the end of the block from entering our own properties because of the lack of
these proper street easements. In fact, 2291 and 2297 have no street whatsoever in
front of their houses,just their own driveways which turn 90 degrees on the the
street in front of the adjacent house (see enclosed photos and recorded survey). I

respectfully request that the city require that before any building permit is issued
for the houses at 2291 and 2297 Oceanside Court, and 33 and 54 Oceanside Drive
these homeowners must first submit a plan to return proper access to these street
easements back to the association members of Oceanside. If these homeowners are
issued any building permit without returning those easements, I will aggressively
challenge such permit in court, calling for an injunction to stop construction if need
be. I thought, in fairness, I would be proactive and inform you of my intentions
now, before this becomes a potential legal quagmire for the homeowner wishing to
build later. Hopefully these homeowners will do the right thing and return the
easements that belong to all of us before they choose to seek a building permit
from the city.
