BACKGROUND:
The applicant desires to operate a Used Automobile Sales and Rental business at
1400 Mayport Road, in the CG, Commercial General district. Sale of used automobiles
is permitted by exception in this district. The location has been used for similar
purposes in the past.
RECOMMENDATION:
The Community Development Board heard this request and unanimously
recommended approval subject to the request being granted to the applicant only for
this location, permitting only operable vehicles, and that only minor maintenance of the
vehicles be permitted.

MINUTES OF THE COMMUNITY DEVELOPMENT BOARD
OF THE CITY OF ATLANTIC BEACH, FLORIDA
December 17, 1996
7:00 P.M.

Chairman Don Wolfson called the meeting to order and asked for approval of the
minutes from the meeting of November 19, 1996. Upon motion made and seconded the
minutes were approved.
NEW BUSINESS:
I. Application for Variance to construct a new home on a substandard lot at
property known as Lot 11, except the south 150 feet, Block 1, Donners Replat.
There being no one present to speak on behalf of the application the Chairman moved
the application to the end of the meeting.
II. Application for Use-by-Exception filed by Ron Meardy to operate a used
automobile sales business at property located at 1400 Mayport Road.
Mr. Meardy introduced himself and requested that his application be amended to
include auto rentals. He stated that the previous occupant was granted a use-bv-
exception for auto sales and rentals.
After discussion, Ms. Pillmore moved to recommend approval of the use-by-exception
as amended to include rental automobiles, but be limited to only operable vehicles and
that only minor maintenance work be permitted on the site. Mr. Frohwein seconded the
motion and the motion passed unanimously.
III. Application for Variance filed by Shorecrest Condominium Association to replace
leaking roof with pre-engineered A-Frame roof system at property located at 193 to 197
Beach Avenue.
Property Manager Sam Higgs introduced himself and stated that a variance was being
requested to construct a structural alteration to the roof system of the existing three-
story nonconforming building.
Charles Pernichiaro, President of Shorecrest Condominium Association, and owner of
Unit 2, expressed endorsements in favor of the variance.
After discussion, Mrs. Pillmore moved to grant the variance provided that the building
not exceed the 35 feet height limitation. Mrs. Walker seconded the motion and the
variance was unanimously granted.
IV. The board deferred action on the application of James Gipson until the next
regularly scheduled meeting.
V. The board deferred action on the application of Dorothy Papazian until the next
regularly scheduled meeting.
Mrs. Simpkins arrived.
VI. ELECTION OF OFFICERS
The board elected Don Wolfson and Robert Frohwein as Chairman and Vice-
Chairman respectively.
The board decided to discuss the proposed amendments to the Zoning Code of
Ordinances at the next regularly scheduled meeting. Mr. Worley was instructed to
include the discussion as an agenda item.
There being no further business to come before the board on motion duly made the
meeting was adjourned.

AGENDA ITEM: # 4.a. Application for Variances to lot size and setback
requirements to permit the construction of a single-family
home on a substandard Lot 11, except the south 150 feet,
Block 1, Donners Replat.
The applicant desires to construct a single-family home on a substandard lot. To
construct a house that complies with the zoning codes minimum living area requirement of
1000 square feet, the applicant must encroach the required setbacks at some point. The
applicant has initially proposed to encroach both the front and rear setbacks while
maintaining the side yard setbacks.
After a review of this lot and considering the minimum living square footage
requirement of the code,Staff recommends the applicant be required to comply with the
front yard setback requirement of 20 feet, be granted a Variance to permit a 10 foot rear
yard setback. and a Variance to permit a total of 10 feet of side yard setback (5 feet on
each_sid). Staff believes this will allow the applicant to construct a 1000 square foot
home and meet the intentions of section 24-83.

The applicant desires to operate a used automobile sales business on property
zoned CG, commercial general. Sale of Used automobiles is permitted by exception in
the CG district.
staff recommends_the applicant be granted the Use-by-Exception. but be limited
to_o.}2erable_automobil_uonly_and that only minor maintenance work be permitted on the
site,
AGENDA ITEM: # 5. a. Application for Variance to construct a structural alteration
onto an existing nonconforming multi family structure at 193
Beach Avenue.
The applicant desires to construct a structural alteration to the roof structure of
this,existing nonconforming structure. The structure does not comply with the setback
requirements or the permitted density of the RG-2 district. The work proposed is a
complete replacement of the roof structure. The existing setbacks will not be effected.
The proposed alteration is structural in nature and is of sufficient scope to require a
Variance under Section 24-85 (a) (3) b.
Because the proposed work will not increase the existing setback encroachments
and is necessary to correct a major deficiency in the structure, Staff recommends
approval of the requested Variance.
