AGENDA ITEM: Dewees Avenue/Coquina Place

BACKGROUND: Eight sepazate petitions have been presented requesting various
improvements and other actions for the Dewees/Coquina/Shell Street area.
They request that the three streets be paved by the City, that Dewees and
Coquina be designated for one-way traffic, that,the azea referred to as
"Marvin's Gazdens" be expanded by the addition of unused street right-of-
way and that the right-of--way along Dewees Avenue be reduced to either
30 or 40 feet. City staff has reviewed this proposal and offers the
following input;
Paving; Staff is in favor of paving these streets. They have required a
considerable amount of maintenance to fill in potholes and add limestone
for years. City staff has proposed paving in past, but there was opposition
from the adjoining owners. The present widths of streets in the azea are
substandazd and they would remain substandazd if paved to a 14-foot
.width. The preferred width for one-way streets with pazking on one side is
19 feet. The preferred width for Shell Street, which is proposed to remain
two-way, is 20'.
One-way designations; The Police Department does not favor the one-
: way designation of Dewees Avenue and Coquina Place. Their assumption
is that the better (paved) surface, along with aone-way designation would
encourage higher speeds and thereby increase the risk of accidents for
other vehicles and pedestrians. in the azea.
Park Property; There may be a legal problem in converting the street
right-of--way to a park. Staff s preliminary review of Florida Law (without
consulting the City Attorney) indicates that when a street is abandoned,
the right-of--way must be conveyed to the adjoining property owners.
Therefore about half of the right-of--way would go to the City for '
enlargement of "Marvin's Gardens", but the other half on the north and
east sides would go to the property owners.. Second, the closing of this
right-of--way may eliminate legal access to several of the lots. The shared
driveway of the Ocean Grove Condominiums off of Beach Avenue is not a
public street. Last, several of the condominium owners in the Ocean

Grove complex set their garbage over their fence and into the street right-
of-way adjacent to Marvin's Gazdens. If this property was converted into
a park with additional landscaping would it affect their ability to have their
garbage picked up from this side of their homes?
Right-of--way dedication; The standard requirement for a street to be
built in Atlantic Beach is to have a 60 foot right-of--way unless curbs and
gutters are installed. Shell and Coquina Streets presently have 40-foot
right-of--ways, and there is no proposal for that RO W to be reduced.
Dewees Avenue is the only one ofthe three that has sufficient right-of-
way under the City regulations, although it is proposed to be 40 feet in one
area and 30 feet in another. Second, there are both water and sewer lines in
portions of the ROW proposed for dedication to the adjoining property
owners. A six-inch water line runs along the north and east side of
Dewees Avenue. Our records show it approximately 10 feet south of the
north right-of--way line. If 15 feet were dedicated to the adjoining owners,
then the water line would be 5 feet inside of private property. Similarly, a
City sewer line runs through the road ROW on the north east side of
Marvin's Gazdens which may end up on private property if the RO W was
split between the adjoining owners. Last, the staff has put together a
rough estimate of the value of the RO W to be abandoned of $545,000.
This would be added to the tax rolls. and be taxable to the adjoining
owners. Employees in the Tax Assessors Office have indicated that any
abandonment of adjacent ROW should not affect a homeowner's three
percent cap for property tax increases from one year to the next.
BUDGET: The estimated cost to pave the streets. is $ 7,500. There is no budget for
this project.
RECOMMENDATION: Paving; Staff recommends that the City Commission consider the paving
of the streets in connection with the upcoming budget for 2002-3. If funds
could be found for the project, it would eliminate some future maintenance
by City crews. If a 14-foot paving width is considered, the City Attorney
should be consulted about the possibility of the City assuming any
additional liability for accidents caused by substandazd width streets.
One-way designation; Staff does not favor designating these. streets for
one-way traffic for the reasons discussed above.
Addition to "Marvin's Gardens"; If the adjoining residents are wIlling
to make landscaping. improvements to Marvin's Gazdens and the street
RO W on the north east side, and keep it maintained, it would improve the
aesthetics ofthe area for the adjoining owners. This can be done without
the necessity of abandoning any ROW, and incurring alI ofthe related
problems described above. It would be appropriate for the owners that

want to make these improvements to submit a plan to the City for approval
much the same as the present beach access improvements aze handled.
Right-of--way dedication; Staff opposes the reduction of ROW along
Dewees Avenue, particulazly along the north side where a water line
would be affected. It would also seem inappropriate to reduce the width
of an existing ROW when we aze requiring developers of new
subdivisions to designate 60-foot ROW for streets without curb and gutter.
However, if the Commission wishes to proceed with the RO W reduction,
the next step would be to call for a public. hearing and notify the adjacent
property owners. Even though not required for paving without an
assessment, the Commission may want to call for a public hearing to give
all affected parties a chance for input.

REQUEST FOR ACTION
By citizens in the Dewees Avenue, Coquina Place neighborhood.
This report was prepared at the request of City Manager Jim Hansen for the purpose of
outlining our neighborhood request for modifications to certain city Rights-of-Way,
roadway conditions and creation of a neighborhood pazk. We have met with and
discussed these issues with Public Works Director, Bob Kosoy and Police Chief David
Thompson as well.
Please reference the corresponding signed petition with the corresponding category.
A. .Creation of Coquina Park
It is proposed that the City abandon the old Shell Street roadway right-of--way as
shown in Figure A. The northerly outside right-of-way adjacent private property
would. remain and become the newly created Park border. Abandoning the old
right-of-way (currently it is just an open grassed azea) and reducing the Dewees
right-of-way from 60' to 30' would create a larger. park. The park would grow
from 2,000 SF to 18,000 SF (0.4 Acres). Currently, there is a small triangular
pazk (the 2,000SF mentioned above) called Marvins Gazdens, (named ignobly.
after a former resident's dead German Shepherd dog, named, Mazvin). We
propose the name be changed at the time of this pazks creation to Coquina Park.
The name is derived from the naturally occurring lime rock shell stone and a
western bordering street; Coquina Place. The pazk would be triangulaz in shape,
and bordered by Dewees Avenue and Coquina Place right-of-ways and the rear
property line of Ocean Grove Condominiums. About half the site is composed of
native Red Bay Oaks and Cabbage Palms. The remaining property is open field
grass and sandspur (the azea outlined as the right-of-way subject to abandonment).
It should be understood that the city is neither gaining nor loosing any land, just
simply cleaning up unnecessary property lines and consolidating the property into
simple metes and bounds pazk-like form.
As surrounding neighbors, we offer to plant a few new trees in the baze areas,
maintain the park in good order by mowing the grass, picking up dead limbs and
fronds and bordering the park with a wood horse fence, perhaps painted white.
Some fence constructed by the city currently exists. We would add additional
..fence to prevent cars from pazking in the park and better define its borders. We
ask that the city provide an irrigation tap and meter so that in the future we can:
irrigate the park in the grassy azeas. The system would be manually controlled
and utilized only in .very ,dry times to keep the native grass alive and in good
cover. We plan or request no further improvements to the new park at this time.

It is our true intent to leave it in its passive, undeveloped state, minus some debris,
vines and ground clutter.
B. .Dewees Avenue Right-of-Way Reduction
Currently, Dewees Avenue is platted as a 60' right-of-way. No other road, with
the exception of Seminole Road, has as lazge aright-of-way in Old Atlantic
Beach. Since Dewees is currently an unpaved, 12' wide dirt road, this represents
a tremendous amount of unusable land in the city's hands that would be more
useful and beneficial to surrounding property owners. In addition and in
conjunction with the formulation of Coquina Park as outlined in paragraph A: a
segment of road right-of-way on adjacent Mandalay Park could revert to just
being Mandalay Pazk property instead of unused right-of-way.
We propose that the Dewees Avenue right-of-way be reduced to 30', which is
sufficient for the proper functioning of the roadway and utilities that currently
exist. This width is consistent for one-way roads with other surrounding rights-
of-way such as Coquina Place (40') and Beach Avenue (25'). We propose that
it's circulation become one way -heading east to Beach Avenue.
We have reviewed the potential impact of utilities and a reduced R.O.W. with the
Public Works Director and have found, in a preliminary fashion, no impacts to
utilities falling into private property if the R.O.W. was reduced to the requested
size. New water and sewer lines, installed in 1997, would still be in City right-of-
way or the newly proposed Coquina Pazk.
Reducing the right-of-way would not eliminate any of the current beach access
pazking along the road. Gazbage and Firetrucks would have the same dimensions
as other beach roads in the azea. The key is to enforce no parking on the south
side of the roadway.
C. One-Way Posting of Dewees Avenue
Residents with adjacent property to Dewees Avenue have signed a petition of
one-waying Dewees Avenue towazds the beach. Some are ambivalent to
direction, but aze in general agreement that due to the roads current narrowness,
and the necessity of providing pazallel parking for beach access, that the road.
should be one way in direction.. One-waying it towazds the beach seems the most
logical direction particularly in light of Beach Avenue's one way, northerly
direction. One-waying should not effect traffic noticeably on either Beach
Avenue or Ocean Boulevazd. This traffic pattern would effect only a handful of
local residents.

D. Paving of Dewees Avenue, Coquina Place and Shell Street
Despite attempts in the past by the City of Atlantic Beach to asphalt-pave the
above named roads, there is now a willingness to pave the road. Consensus, as
portrayed by the signed .petition, indicates the neighborhoods desire to forgo the
rustic, bucolic glory of an old gritty beach road, for the dust free, low
maintenance and quiet of an asphalt roadway. The current dirtroad width is about
12'±. This width services two-way traffic and pazallel beach access parking. We
recommend a 14' paved section with 6-8" lime rock base which has the blessing
of the Public Works Director. There is by our estimates, 1160' LF or 1805 SY, of
new roadway surface.
E. Beach Access Parking
It has been suggested by some that the purpose of this neighborhood project is to
limit or eliminate beach access parking. This is unequivocally not the case.
Currently those beach goers choosing to drive to the beach generally pazallel park
along the northern side of Dewees Avenue. There aze approximately ten parallel
spaces. Parking is not allowed im the park as posted. The enclosed petitions and
actions of the neighbors does not effect beach pazking at all. Parallel pazking
would continue as is. No spaces would be lost and cazs would still be parked on
city right-of-way.. They would however be parked on a paved surface instead of a
dirt road.
These petitions do not dictate road width. Road widths mentioned previously are.
strictly measurements of the current. road width, where it can be determined. The
road functions well except when surfers double pazk and prevent passage of
vehicles, which is a policing problem, not a design problem.
We hope that you will give cazeful consideration to -these requests. It is .the
neighborhoods desired intent to cleanup an azea and blend it into the changing visual and
economic landscape of Atlantic Beach. The time to act on these issues is now,
pazticularly in light of the fact that there is good consensus among the surrounding.
