WAIVER AND RELEASE
Building and Zoning
The undersigned hereby acknowledges the existence of a well at
Coquina Place in Atlantic Beach, Duval County, Florida, SJRWMD well
number D-1265, which is adjacent to certain real property owned by
the undersigned. The City of Atlantic Beach, Florida, has informed
the undersigned that the St. Johns River Water Management District
has determined that the aforementioned well is an abandoned
artesian well as described in Sections 373 .207 and 373 .209, Florida
Statutes, and has agreed to include this well in its Abandoned
Artesian Well Plugging Project.
It is further acknowledged that the City of Atlantic Beach,
Florida, also informed the undersigned that the St. Johns River
Water Management District is willing to pay the total cost of
plugging or repairing said well.
In consideration of the foregoing, together with other good
and valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, the undersigned hereby releases the St. Johns
River Water Management District and the City of Atlantic Beach,
together with their respective authorized agents and employees,
from all claims and demands, directly or indirectly arising from or
growing out of the loss of use of well-water caused by the plugging
or repairing of the abandoned artesian well at Coquina Place in
Atlantic Beach, Duval County, Florida, SJRWMD well number D-1265,
which said artesian well is adjacent to or in the vicinity of
certain real property which the undersigned owns or in which the
undersigned has an interest in, specifically the property located
at 1651 and 1653 Coquina Place, Atlantic Beach, Florida, also known
as Lot 1, Block 6, Ocean Grove, Duval County, Florida. This
Limited Waiver and Limited Release is specifically and expressly
related only to damage caused by or related to the undersigned's
loss of use of the water from the plugging of the aforesaid well,
and does not waive or release any other type of claims or demands
for other damages .
DATED this 7th day of April 1994, at Atlantic Beach, Duval
County, Florida.
