Blythe Waters Invocation and pledge to the flag Mayor Glasser introduced Carol Barber, Outreach Coordinator for Palms Presbyterian Church who gave the invocation, followed by the Pledge of Allegiance. Mayor Glasser welcomed former Atlantic Beach Mayor/Jacksonville City Councilman Bill Gulliford former Atlantic Beach Mayor. Call to order Mayor Glasser called the meeting to order at 6:30 P.M. City Clerk Bartle called the roll and Mayor Glasser noted that a quorum was present. 1. Approval of minutes A. Approve minutes of the Regular City Commission Meeting on March 12,2018. B. Approve minutes of the Roundtable Meeting on November 15,2017. C. Approve minutes of the Regular Commission Meeting on March 26,2018. Mayor Glasser asked if there were any corrections to the above minutes. There were no changes or corrections and the minutes stand as submitted. 2.Courtesy of Floor to Visitors A.Proclamation in Recognition of Revive Civility Month Mayor Glasser announced there are two Proclamations. The first being Proclamation in Recognition of Revive Civility Month. Commissioner Kelly provided background for the Proclamation. Commissioner Kelly spoke in recognition of Revive Civility Month and stated that the interest comes from the National Institute for Civil Discourse based out of the University of Arizona. Commissioner Kelly spoke about taking the pledge to enhance civil discourse in the political arena, bringing varying points of view together and engaging in respectful and civil conversations. B. Proclamation in Recognition of Water Conversation Month Mayor Glasser read the Proclamation into the record and presented it to Carol Barber from Palms Presbyterian Church. Mayor Glasser read the second Proclamation into the record, acknowledging April as Water Conservation Month. She presented the Proclamation to Jennifer Mitchell and Geoffrey Sample from St. Johns River 1 April 9, 2018 REGULAR COMMISSION MEETING Water Management District. Public Comments Mayor Glasser opened Courtesy of the Floor and explained the process for public comments. City Clerk Bartle confirmed five speaker forms were submitted. Mayor Glasser stated each person will be allowed five minutes to speak. Commissioner Stinson addressed Mayor Glasser with a special request to allow Jacksonville City Councilman, Bill Gulliford, to speak first. Mayor Glasser asked if there were any objections to this request. There were none. City Clerk Bartle called the speakers: Bill Gulliford spoke about the traffic and parking issues on Beach Avenue regarding vendor and/or service vehicles and the "No Parking" signs. He requested the Commission consider making a modification to the current Ordinance that would allow vendor and/or service vehicles legal parking in the area. Sally Clemens spoke about the City improving communications with its citizens and suggested ideas utilizing the City website, City Manager Meetings, City Manager email updates, and monthly utility bills. Jayne Bohannon spoke in support of the pergola for Tideviews Preserve and thanked the Commission for the dedication to her father. Reuben Bennett spoke in support of the pergola for Tideviews Preserve and thanked the Commission for their support. John November, Executive Director of Public Trust, spoke in support of Resolution No. 18-15 and thanked the Committee for their support. Mayor Glasser closed Courtesy of the Floor. 3.City Manager Reports A. City Manager's(CM) Report CM Gerrity reported the City received a $30,000 Grant from the Coastal Initiative Program to go toward the 10th Street Beach walkover. CM Gerrity also announced the City received notification about the one-third funding match for the Septic to Sewer conversion from St. Johns Water Management Environmental Grant. This will convert 14 to 16 residences from septic to sewer service. CM Gerrity spoke about the increase in new home construction. He explained the Building Department is self-sustaining, tax dollars are not used to support that department, and everyone is paid with the money collected from building fees. He asked the Commission for permission to add a third Permit Tech position and believed it could be justified because of the volume of building permits being done. Mayor Glasser suggested taking up the issue toward the end of the meeting. CM Gerrity distributed a handout regarding a parcel for sale. He stated that the land is in the area where the Public Works yard is currently located and the asking price is much less than the appraised value. CM 2 April 9, 2018 REGULAR COMMISSION MEETING Gerrity stated the property could be used for expanding the Public Works yard and expanding the dry pond. The funding for the purchase of the property will come out of the designated $250,000 in the budget for local drainage improvements. CM Gerrity asked for permission from the Commission to proceed into a contract with the seller of the property. Mayor Glasser asked the price of the property. CM Gerrity stated the price is $62,500 and the appraised value is $100,000. Consensus from the Commission was to allow CM Gerrity to come back with a resolution contract to purchase the property. B. Accept the 90-Day Calendar(April through June 2018) CONSENSUS: To accept the 90-Day Calendar as submitted and discussed. 4. Unfinished Business from Preceding Meeting. None. 5. Reports and/or Requests from City Commissioners City Clerk Bartle called the Commissioners. Commissioner Norris Addressed the Commission on the Revised Civility Month and suggested the Commission sign the Pledge together at the next meeting. Invited all to a presentation on Manhattan Beach, Florida, by Brittany Cohill of The Beaches Museum and History Park, at 6:30 p.m. on Friday April 13, 2018 at the Gail Baker Center. Commissioner Stinson Addressed the Commission about the parking issues on Beach Avenue and the importance of the Commission addressing the issue. Commissioner Waters Addressed the Commission on the Beach Avenue issue and the Commission's priorities. Reported that it is Child Abuse Prevention Month, and spoke about providing a strong support network for families, asking everyone that works with children to stay aware. Commissioner Kelly Shared her experience on judging the Fletcher High School Marine Science students and learning about growing sea oats faster,beach trash analysis, and measuring the health of our water system. Reminded everyone about Arts in The Park in Johansen Park on April 21, 2018. Reminded all that sea turtle season is coming up in May. Mayor Glasser Commended Commissioner Stinson for his service on the Parking and Pedestrian Safety Advisory Resource Committee. Spoke about Atlantic Beach Cares, which allows donations to be made on utility bills to help others in the community that are struggling. She provided forms for all who wanted to sign up for this program. Announced the Community Outreach Session this week at the Gail Baker Center and a Workshop Meeting to be held afterward. Spoke about the State Legislation on Customary Use Relative to Public Beaches and the impact on Atlantic Beach. State Representative Cord Byrd has been responding to any questions regarding this and encouraged communication with Mr. Byrd regarding legislation. 3 April 9, 2018 REGULAR COMMISSION MEETING 6. Committee Reports A.Environmental Stewardship Committee Report. Judith Leroux, Chair of Environmental Stewardship Committee (ESC), announced the following: Next ESC Meeting on April 11, 2018 at 6:00 p.m. Greenscape Jax Digs Trees Community Tree Planting at Tideviews from 10:30 a.m. to 12:00 p.m. on April 14, 2014. Tree planting ceremony and tree giveaway at Atlantic Beach Elementary School on April 27, 2018 at 8:30 a.m. The event fulfills the City's requirement for Tree City USA for 2018. Ms. Leroux asked the Commission to designate Florida Arbor Day (third Friday in January) as the Atlantic Beach official Arbor Day. Ms. Leroux, on behalf of ESC, accepted the stewardship of the Tree Conservation Trust Fund. Shane Corbin, Community Development Director (CDD) reported on the Parks Plan regarding inventory, updating documents from 2009, mapping exercises, the ratio of tree removals versus the planting of new trees, statistics on Legacy Trees, the confusing permitting process, the Tree Sub-Committee work, site inspections on approved landscape plans, violations, and reminding contractors about the City's Tree Ordinance. Mayor Glasser inquired about the process for posting the Tree Removal Permit. Commissioner Waters inquired about Legacy Trees in the new permit application. 4 April 9,2018 REGULAR COMMISSION MEETING 8. Action on Resolutions A. RESOLUTION NO. 18-14 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE EXPENDITURES OF FUNDS FROM THE TREE CONSERVATION TRUST FUND FOR ARBOR DAY EVENT. Mayor Glasser read the title of the Resolution into the record. CM Gerrity addressed the Commission on the Arbor Day Celebration and asked the Commission's permission to withdraw up to $2,500 from the Tree Fund for this event. Motion: To Adopt Resolution No. 18-14 as written. Moved by Stinson, Seconded by Norris CDD Shane Corbin addressed the Commission stating the amount should come in under $1,000. RESOLUTION NO. 18-15 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, ACCEPTING A DONATED PERGOLA AT TIDEVIEWS PRESERVE; APPROPRIATING AN AMOUNT NOT TO EXCEED $1.500 FROM THE PUBLIC WORKS DEPARTMENT PARKS ACCOUNT FOR THE PURPOSE OF CONSTRUCTING A CONCRETE BASE FOR THE PERGOLA; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY CONTRACTS AS NECESSARY TO EFFECTUATE THE PROVISIONS OF THIS RESUOLUTION; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the title of the Resolution into the record. CM Gerrity addressed the Commission and reiterated the authorization of the City to donate up to $1,500 for the base of the pergola that is being contributed to the City. Commissioner Kelly asked CM Gerrity if the property is under the Land Trust Conservation, and CM Gerrity answered that it is not. The Commission acknowledged and thanked the Bennett family and everyone involved in this project. Motion: To Adopt Resolution No. 18-15 as written. Action on Ordinances A. Ordinance No. 90-18-231,Public Hearing and Final Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, AMENDING CHAPTER 24, LAND DEVELOPMENT REGULATIONS, ARTICLE III, DIVISION 2, SECTION 24- 51, NOTICE OF PUBLIC HEARINGS; DELETING CURRENT SECTION 24-51 IN ITS ENTIRETY; ADOPTING NEW SECTION 24-51, PUBLIC HEARINGS AND REQUIRED NOTICES, ESTABLISHING NEW NOTICE, ADVERTISEMENT AND SIGNAGE REQUIREMENTS; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR WAIVER OF SECTION 24-51 PROVISIONS; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Glasser read the title of the Ordinance into the record. Planner Derek Reeves addressed the Commission with an update from the last meeting. He stated that, as requested, "All public hearings shall be after 5:00 pm," was added, also that mailers will be required for all notices for all public hearings, and that every Ordinance requires two public hearings at the Commission level. Public Hearing Mayor Glasser opened the public hearing. There were no speakers and she closed the Public Hearing. Commissioner Kelly asked Mr. Reeves if the amended version suited what needed to be accomplished. Mr. Reeves answered that it did. Motion: To Adopt Ordinance No. 90-18-231 as read. Moved by Stinson, Seconded by Waters Commissioner Stinson thanked the City Manager and staff for making the extra effort to meet with the Atlantic Beach Preservation Group. Commissioner Waters commented that the lack of comment at this public hearing shows that the Commission has now balanced the citizens' concerns and the City's needs in terms of modernizing signage and advertising. ORDINANCE NO. 20-18-148,Public Hearing and Final Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA FOR FISCAL YEAR BEGINNING OCTOBER 1, 2017 AND ENDING SEPTEMBR 30, 2018 FOR 6 April 9, 2018 REGULAR COMMISSION MEETING APPROPRIATING FUNDS ASSOCIATED WITH THE FIREHOUSE SUBS PUBLIC SAFETY FOUNDATION GRANT, AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the title of the Ordinance into the record. CM Gerrity addressed the Commission about the reading of an amendment to the City's budget. The City received a grant in the amount of$24,000 from Firehouse Subs and in order to accept the grant, we must acknowledge the additional revenue in the budget. City Attorney/City Clerk Reports and/or Requests City Attorney Durden (CA) announced the final draft of Medical Marijuana and Gas Station Ordinances will be on the agenda for the Community Development Board on April 17, 2018. She thanked staff, the Preservation Group, and the Commission for their input. 12. Closing Comments by City Commissioners and City Manager. City Clerk Bartle called the Commissioners. Commissioner Stinson Commended the Parking and Pedestrian Safety Advisory Resource Committee for making two recommendations for the next City Commission Meeting. Commissioner Kelly Reminded everyone of sea turtle season and hurricane Season. CM Gerrity Thanked the Commission, CA Durden and the Mayor for their suggestions on the Sign Ordinance. Spoke about the challenges regarding the Land Development Code. Chief Cook Spoke about their formalized volunteer program, and that currently 19 volunteers have received some level of training and are volunteering in various areas, including enforcing illegally parked 7 April 9, 2018 REGULAR COMMISSION MEETING cars. CM Gerrity Addressed the Commission regarding his request for a new position in the City's Building Department due to the increase in permits being issued, the revenue that is being generated, the loss of one employee, and the potential loss of another employee in this department to Code Enforcement. CM Gerrity went on to state that he has not been enthusiastic about hiring a Receptionist because most of the calls are directed at Community Development and they have to be referred back there anyway. He iterated that this position will not be funded by tax dollars, instead it will be funded by revenue generated by the Building Department. Discussion ensued about whether the building trend will continue, eliminating the position if the large number of permits discontinue, expectations of filling vacancies in the City, the role of this new position, types of phone calls coming in, the time it takes to get a permit, and whether the position could be filled by a contract worker. Mr. Gerrity clarified that he does not feel comfortable adding a new position without asking the Commission. Commissioner Stinson questioned whether formal action can be taken since the item was not on the agenda. Mayor Glasser suggested possibly putting it on the next agenda. Mr. Gerrity clarified that he was just looking for consensus. There was consensus from the Commission to allow Mr. Gerrity to add a new position in the Building Department. Mayor Glasser requested that Mr. Gerrity let the Commission know how he decides to go with filling the position, regular vs. contract employee. Mr. Gerrity agreed to follow up and stated he will ask the Building Official what his preference is. Commissioner Kelly Asked about the decision on funding the Dancin' in the Street police. CM Gerrity reported that some funding may come from the Police Overtime Budget but not the total $8,200 requested. He believed that Town Center should share some of the cost and that was how he left it. Mr. Gerrity agreed to report back if anything changes.
