Bids for Ditch Spraying and Maintenance were opened on
April 10, 2002. Three firms submitted bids. They are as follows:

The apparent low bidder, Nature's Way Pest Control, Inc., submitted the required documents with his
bid, however, the Occupational License was from Jacksonville Beach, not Duval County, and it was
office work only, The Contractor was advised of this deficiency, and on April 12, 2002, he
submitted a copy of his receipt and application for the Occupational License as an exterminator in
Duval County. On April 15, 2002, we received a letter from the second lowest bidder, Blue Water
Environmental of Florida, Inc., protesting that the proper Occupational License was not furnished
with the bid.
RECOMMENDATION:
If the City Commission desires to waive the technicality of the improper Occupational License
submitted with the bid, we recommend awarding the bid to Nature's Way Natural Pest Control,
Inc., the apparent low bidder.
The amount of the award will be $15,842.52 per year for Ditch Maintenance Items 1-28, award
Alternate Bid #1 for the Jasmine Street Retention Pond of $427.20, and Alternate Bid #3 for
Mosquito Control Program, on an as needed basis. The total award price will be $17,469.72 and will
be awarded contingent on contractor's receipt of a Duval County Occupational License, applied for
on 4/12/02.

On April 10, 2002 Bid NO. 0102-15 was opened for Ditch Spraying and
Maintenance for the Pubic Works Department. Nature's Way Natural Pest Control, Inc.
was the low bidder at $15,842.15. However, there is no record of a Duval County
occupational license ever issued to Nature's Way Natural Pest Control, Inc. as of April S0,
2002. It is clear that Nature's Way Natural Pest Control, Inc. possesses a City of
3acksonvilfe Beach license that permits ofFce work only. This license does not permit field
operations anywhere in Duval County. A copy of a current Duval County occupational
license was to be included as part of the documents required to be eligible to bid this
project. Bids were sealed and no additional documents can be added after 2:30 PM on
April 10, 2002 therefore; it is clear that the bid submitted by Nature's Way Natural Pest
Control, Inc. must be deemed ineligible and disregarded as a valid bid.
We understand that ail bids are not finalized until reviewed by the Department. Our
bid submittal was for a total of $24,929.84 which makes Blue Water Environmental of
Florida Inc. the next eligible bidder. We assure you that we will meet your expectations
and requirements as a legitimate environmental business.

decision for Bid No. 0102-15. I will make myself available to meet you at your conven-
ience to answer any questions or review our maintenance plan.
Thank you for the opportunity to bid the ditch spraying project for the City of
