COMMUNITY DEVELOPMENT BOARD REPORT AND ACTIONS: HARDMAN/WEEKS CONSTRUCTION, INC. t 1644 PARK TERRACE, WEST ATLANTIC BEACH, FL 32233 (904) 241-2165 December 29, 1987 Board of Directors Oceanwalk Subdivision Atlantic Beach, Florida SUBJECT: Lot 47, Unit Three, Oceanwalk Gentlemen; We employ, possibly, one of the best footing companies in the area, North Florida Footing Company of Jacksonville. They are very active in the Oceanwalk area. On Lot 47 , Unit three, they ware contracted to put in footings . They pulled the line to the NE B.R.L. to find that it hit directly upon a tree located at this corner. They set back 5. 5 feet to avoid this tree, and pulled from that corner. This was the first reason for that particular corner.Secondly, they found that they required approximately 2 . 5 feet from that corner in order to square the house with the street, and also to be square with the home directly to the south. Both John Weeks and Chuck Hardman were out of the city on business , and had given North Florida permission to proceed, especially in view of their expertise and familiarity iihh the Oceanwalk area. The set back theyfound they required has resulted in the foundation of this home being 44 inches beyond the B.R.L. on the Northwest corner for a length of 23 feat (north to south) .We are attaching a survey to show this foundation. Unaware that this situation existed, construction proceeded, and it was not until we received the foundation from Durden did this situation coma to light. We have contacted Mr. Don Ford, Atlantic Beach Inspector, relative to this infraction. The fact that the right rear of the house sets inside the right property line a distance of 20.7 feet, seems to help somewhat, plus the fact the tree was saved, and the house is square with the street. We, as builders, are experiencing a first, and really are at a loss as to how to proceed, but we ask that we be granted an approval from Oceanwalk for this 44" by 23 feet, that we may schedule a meeting with Atlantic Beach Variance Committee as soon as possible.
