(See attached proposed site plan) . The reason variance is being sought: The change in jurisdiction from the City of Jacksonville to the City of Atlantic Beach made the set back requirement increase from 10' to 20' . This is different from the deed restriction and has changed since the purchase of the property in 1985. Variance Granted Subject to Conditions. The owner/s of the real property described in this order are hereby granted a zoning variance from the requirement of Chapter 24 of the Ordinance Code of the City of Atlantic Beach permitting total rear yard of ten ( 10) feet, subject however to the condition that said variance shall be transferable and shall run with the title to the property described in this order and subject further to the condition that said variance shall be commenced within one year from the effective date of this order. Section 2. Owner and Description. The land as to which a zoning variance is granted by this order is owned by Seda Construction Company and described as follows: LOT 11, BLOCK 1, BEACHSIDE-1869 BEACHSIDE COURT Section 3.
