Please consider this as a working draft for review and discussion purposes only. As you will quickly note, this is a substantial re-write of Chapter 17. Within the strikethrough copy, my comments and explanations for some of the suggested changes are in bold, italici¢ed print. The City's sign regulations have not had a substantive update for many yeazs. Amendments to sign regulations must be cazefully considered because of First Amendment constitutionally protected speech issues and the risk for legal challenges. District and Federal Court decisions aze. often inconsistent and ever evolving, but the general rule in drafting sign regulations is to strictly adhere to "content neutral" language that sets only "time, place and manner" types of restrictions. In other words, regulate the physical chazacteristics of signs, such as size, height, location, number allowed, lighting, and not the message contained on a sign. (There are a few exceptions to this, such as in the case of obscene signs.) The proposed regulations provide standards for signs allowed according to the Zoning District in which they aze located. I have also included. a Prohibited Signs section and definitions that aze consistent with sign regulation terminology used nationwide. RECOMMENDATION: No action requested. Intent. •t'he City Commission recomizes that there are various persons and entities that have an interest in communicating with the public through the use of Sims. The Commission is also responsible for furthering the C;hra nhhwarirm to its residents and visitors to maintain a safe and aesthetically pleasing environment where Signs do not create excessive visual clutter and distraction. It is the intent of the Commission that the regulations contained in this Chanter shall provide uniform Sim criteria which shall place the fewest possible restrictions on personal liberties property rights and the free exercise of Constitutional rights while achieving the City's goal of creating a safe healthy attractive and aesthetically pleasing environment that does not contain excessive clutter or visual distraction from rightof--ways and adiacent properties and the surrounding natural environment. All Sims, which aze not Exempt Sims as set forth in Section 17-1. shall be subiect to the following_ eneral provisions. {11 No Sim shall be installed. erected or placed prior to issuance of a Sign Permit as required by Article II of this Chapter. (2) All Signs shall be eneineered and constmcted as required by these regulations and the Florida Building Code. Si¢is shall also be professionally designed and lettered. (31 No Sim shall create a traffic or fire hazard. or be daneerous to the general welfare or interfere with the free use of public streets or sidewalks. (3) Fascia or Wall Signs, shall be mounted directlvupon the surface ofthe Buildine, and shall not be mounted upon racewavs, or other type of protrusions from the surface of the Building, Sign contractors may take issue with the above provision. Signs mounted on raceways are commonly used because they are cheap to manufacture and install Direct-mounted Signs, however, provide a much higher quality, more consistent and uniform appearance, particularly onmulti-tenant buildings. This is purely a Sign construction regulation though, and we have authority to regulate this ifthe Commission chooses to do so. Sec. 17-3. Signs permitted within Residential Zonin¢ Districts. The current Sign regulations do not have standards for residential subdivisions. I haveproposed whatseems reasonable below, but the dimensions and requirements can be set as the Commission desires. Wejust need clear standards. (a) Except as provided for in Section 17-1. above, Sims within Residential Zoninie Districts shall be limited to those as set forth below. Any change to the structural supports or structural materials, including temporary relocation associated with routine maintenance of a property; ii. Any change which increases the illumination; iii. Any change which increases the height of a Sign; iv. Any change which alters the material used for the display or face area by more than twenty-five (25) peroent; v. Any replacement required as the result of an accidental act or a weather related act. vi. Any replacement where a Sign has been abandoned or unused for a period longer than three (3) months. vii. Any change required to conform to Florida Building Code requirements. d. The provisions of this Section shall not be construed to apply to Sigr~sivl3iekS_gns that are deteriorated, dilapidated, or in a general state of disrepair, or which are determined to create a hazard to public safety.
