AGENDA ITEM: Proposed revisions to Chapter 17, Signs and Advertising Structures

BACKGROUND: Attached is an initial draft of proposed revisions to Chapter 17, Signs
and Advertising Structures. Please consider this as a working draft for review and discussion
purposes only. As you will quickly note, this is a substantial re-write of Chapter 17. Within the
strikethrough copy, my comments and explanations for some of the suggested changes are in bold,
italici¢ed print.
The City's sign regulations have not had a substantive update for many yeazs. Amendments to
sign regulations must be cazefully considered because of First Amendment constitutionally
protected speech issues and the risk for legal challenges. District and Federal Court decisions
aze. often inconsistent and ever evolving, but the general rule in drafting sign regulations is to
strictly adhere to "content neutral" language that sets only "time, place and manner" types of
restrictions. In other words, regulate the physical chazacteristics of signs, such as size, height,
location, number allowed, lighting, and not the message contained on a sign. (There are a few
exceptions to this, such as in the case of obscene signs.)
The proposed regulations provide standards for signs allowed according to the Zoning District
in which they aze located. I have also included. a Prohibited Signs section and definitions that
aze consistent with sign regulation terminology used nationwide.
RECOMMENDATION: No action requested.

ARTICLE I. IN GENERAL

Sec. 17-1. Intent.
•t'he City Commission recomizes that there are various persons and entities that have an interest in
communicating with the public through the use of Sims. The Commission is also responsible for furthering the
C;hra nhhwarirm to its residents and visitors to maintain a safe and aesthetically pleasing environment where
Signs do not create excessive visual clutter and distraction. It is the intent of the Commission that the
regulations contained in this Chanter shall provide uniform Sim criteria which shall place the fewest possible
restrictions on personal liberties property rights and the free exercise of Constitutional rights while achieving
the City's goal of creating a safe healthy attractive and aesthetically pleasing environment that does not contain
excessive clutter or visual distraction from rightof--ways and adiacent properties and the surrounding natural
environment.

Art. II. DEFINITIONS
Advertising Message: The letters and graphics on a Sign intended to directly or indirectly promote the sale of
a product service commodity entertainment or real or personal property This definition shall also be deemed
to include political copy intended to directly or indirectlypromote acandidate or
issue. Advertising Message shall not include Signs or portions of Signs that defined as a Public Sign.
Animated SiQn• Anv Sim or part of a Sign including Advertising Message which chanties physical position
by any means of movement.
Automatic Changeable Message Device: Anv Sim which through a mechanical. electrical, solar, or other
power source is capable of delivering messages which rotate or appear to rotate change or move at any time in
any way. including Tri-Vision or any MuIH-Prism Sign faces.

Sec. 17-i. Exemnt Signs.
The following Signs are exempt from theprovisions of this Chapter:
(11 Decals limited to those as required by law, which are affixed to or paintedorSigns
s-peiated on store windows, store equipment, fuel pumps or other types of vending equipment
used for dispensing retail products.
Ll Lettering only. when placed oven doors and windows of lawfully licensed businesses, with

The above is included to allow for hours of operation, emergency contact, or similar types of

(12) Political campaim Signs announcing the candidacy of a candidate for public office not
exceeding four (4) squaze feet in azea. The placing of such Signs on public property or on
public rieht-of-ways shall beis-e>cpress}y prohibited and such Signs shall be removed by the
City Code Enforcement Officer without notice to the candidate or abuttine property owner or
occupant. Such Signs must be placed wholly within the boundaries ofprivete

Sec. 17-2. General Provisions annlvin¢ to all Sims.
All Sims, which aze not Exempt Sims as set forth in Section 17-1. shall be subiect to the following_ eneral
provisions.
{11 No Sim shall be installed. erected or placed prior to issuance of a Sign Permit as required by
Article II of this Chapter.
(2) All Signs shall be eneineered and constmcted as required by these regulations and the Florida
Building Code. Si¢is shall also be professionally designed and lettered.
(31 No Sim shall create a traffic or fire hazard. or be daneerous to the general welfare or interfere
with the free use of public streets or sidewalks.
(4) No Sim shall be attached to or placed seainst a Buildine in anv manner which impedes or
blocks ingress or eeress throueh anv door or window of anv Buildine, nor shall anv Sim
obstruct or be attached to a fire escape.
(51 No Sim shall be erected at the intersection of any Street in such a manner as to obstruct free
and cleaz vision, or at any location where, by reason of position, shape or color, it may interfere
with. obstruct the view of or be confused with any authorized traffic Sim, Simal or device, or
which makes use of anv word or words commonly used on traffic-control Sims or Signals.
(61 Where the reaz of any Sim structure is visible from anv Street or from any adjoining residential
Zonine District, all exposed structural and electrical components members of any such Sign
shall be concealed by in a manner as approved by the City Manaeer.
(3) Fascia or Wall Signs, shall be mounted directlvupon the surface ofthe Buildine, and shall not
be mounted upon racewavs, or other type of protrusions from the surface of the Building,
Sign contractors may take issue with the above provision. Signs mounted on raceways are commonly used
because they are cheap to manufacture and install Direct-mounted Signs, however, provide a much higher
quality, more consistent and uniform appearance, particularly onmulti-tenant buildings. This is purely a
Sign construction regulation though, and we have authority to regulate this ifthe Commission chooses to do
so.
Sec. 17-3. Signs permitted within Residential Zonin¢ Districts.
The current Sign regulations do not have standards for residential subdivisions. I haveproposed whatseems
reasonable below, but the dimensions and requirements can be set as the Commission desires. Wejust need
clear standards.
(a) Except as provided for in Section 17-1. above, Sims within Residential Zoninie Districts shall
be limited to those as set forth below.
(1) For Single-family and Two-family residential subdivisions and developments

containine ten (10) or more residential Lots. where individual Lots are accessed from a
common internal roadway. one Sign identifying the name of the subdivision shall be
allowed at each entrance from a Collector or Arterial Sheet, not to exceed two (21

iii. Twe allowed: Freestanding Crround or Monument style. Where more than one
Sim is allowed. each such Sim erected shall be constructed and desimed in the
same manner.
iv. Rluminafion: These Signs shall be externally illuminated with ¢<ourid mounted
lighting only. Anv lighting shall proiect from the ground onto the Sid only, and
shall not be directed towazds any Street or residential Lot.
f2) For Mulfi-Familvresidential Uses. one Sien identifying the name ofthe multi-family
Develovment shall be allowed at each entrance not to exceed two (21 Sims. Internal
directional Signs and Signs identifying Buildings and shall also be allowed limited to
three (3) feet in height and ei htg (8) squaze feet in Sim Display Area.
i. Size permitted: Sixty (60) squaze feet of Sign Area.
ii. Maximum Height of Sim: Twelve (121 feet.
iii. Type allowed: Freestanding Ground or Monument style. Where more than. one
Sim is allowed. each such Sign erected shall be constructed and desimed in the
same manner.
iv. Illumination: These Signs shall be externally illuminated with mound mounted
lighting only. Anv li¢htine shall proiect from the ground onto the Sign only. and
shall not be directed towazds any Street. vehiculaz drive or residential unit.
(bl Signsr as set forth with above Section (al. located within Public or dedicated Right-of-ways
shall be approved by the Citv Commission. Such Signs maybe approved at the time of Final Plat approval as
set forth by Section 24-202 of this Code, or alternatively. such Sims maybe approved anon specific application
to the Commission. Approval of the Commission shall be required prior to the issuance of a Sign Pemrit. Such
Signs shall complement and conform to the existing "WELCOME TO ATLANTIC BEACH" suns in lettering.

Sec. 17-1. Sins permitted within Commercial and Industrial Zoning Districts.
(al Subject to the provisions as set forth within this Section, the following Sims shall be pemritted
within Commercial Professional Office (CPO). Commercial Limited (CLI. Commercial General ~CGI. Central

(1) Fascia Sims for Buildines with a single Occupant.
i. Size permitted: One (11 square foot of Sign Display Area for each linear foot of
the buildine width that faces the front of the Lot. as defined Section 24-17 of this
Code. provided that no single Fascia Sign on any one side of a Building shall
exceed sixty(601 square feet of Sign Display Area. (For example. ifthe width of
the Buildine facine the front of the Lot is fifty (501 feet wide, the maximum total
Sim Display Area for all Fascia Sims is fifty (501 square feet.l
ii. Number of Fascia SiE;ns permitted: Not more than three (31 Fascia Sims shall be
allowed on any one side of a Buildine. Where Fascia Sims are placed upon more
than one side of the Building. the combined Sim Display Area. shall not exceed
the amount permitted by the subparagraph (li above.
(21 Fascia Sims for Buildings with multiple Occupants.
i. Siu permitted: One (,, souaze foot of Sim Display Area for each lineaz foot of
the unit(sl occupied by one tenant or business. provided that no such Fascia Sim
shall exceed forty-eight (48) squaze feet of Sign Display Area for any one
occupant. (For example, if the width of a unit or several units, occupied by one
business is twenty-four feet, then one Sim, a maximum of twenty-four feet of
Sim Disolav Area is permitted.l
ii. Required spacing between Sims on BuildinQS with multiple occupants. Fascia
Signs for different businesses shall be separated by a minimum distance or thirty-

(a) Unsafe Sims In the event that any Sim is determined by the Buildine Official to be unsafe.

All Signs, which were lawfully in existence and constructed or installed with properly issued Sign Pemuts as of
July 14, 1997, and which are made nonconforming by the provisions htrein shall be allowed to remain in
accordance with the following conditions:
a. Signs pemritted pursuant to Section 17-2, including Pole Signs or freestanding Signs, that are not in
compliance with Section 17-12 with respect to the minimum required distance of five (5) feet from any
property lines shall be allowed to remain in the existing location provided that no portion of the Sign is
located within any publicly owned rightof--way or utility easement and that no interference with cleaz
sight distance exists, and further provided that such Signs are otherwise incompliance with the terms of
this Section.
b. Signs permitted pursuant to Section 17-2, including Pole Signs or freestanding Signs that are not in
compliance with the terms of Section 17-2(b)(6) with respect to maximum height orsize-skellsize shall
be allowed to remain, provided that such Signs are otherwise in compliance with the terms of this
Section.
o, Nonconforming Signs, including those as described in preceding paragraphs (a) and (b) shall be made
conforming with all provisions of this Chapter when any of the following changes are made:
i. Any change to the structural supports or structural materials, including temporary
relocation associated with routine maintenance of a property;
ii. Any change which increases the illumination;
iii. Any change which increases the height of a Sign;
iv. Any change which alters the material used for the display or face area by more than
twenty-five (25) peroent;
v. Any replacement required as the result of an accidental act or a weather related act.
vi. Any replacement where a Sign has been abandoned or unused for a period longer than
three (3) months.
vii. Any change required to conform to Florida Building Code requirements.
d. The provisions of this Section shall not be construed to apply to Sigr~sivl3iekS_gns that are deteriorated,
dilapidated, or in a general state of disrepair, or which are determined to create a hazard to public
safety. Such Signs shall be subject to the provisions of Section 17-7.
