The Code Enforcement Board of the City of Atlantic Beach was created pursuant to Florida Statutes and
exists for the purpose of facilitating the enforcement of the Code of Ordinances. It is comprised of seven
citizens of Atlantic Beach who meet regularly to hear allegations of code violations. The City of Atlantic
Beach adopted the International Property Maintenance Code and the Florida Building Code as part of
the City of Atlantic Beach Code of Ordinances in Chapter 6,Article II, Section 6-16.
You are hereby notified and ordered to appear at the next public hearing of the Code Enforcement Board
on March 12,2019 at 6:00 pm at Atlantic Beach City Hall, Commission Chamber, 800 Seminole Road,
to answer and be heard on the following alleged violations on the property known as 925 AMBERJACK
LN,RE#171176 0000, 30-60 17-2S-29E, ROYAL PALMS UNIT 1, LOT 22 BLK 4.
International Property Maintenance Code/City Code of Ordinances
Section 154 (g) Within all residential zoning districts, and also including any property containing a
residential use, household items, furniture and those items customarily intended for indoor use shall not
be displayed, maintained or permanently stored outdoors, or in any location on the lot where such items
are visible from adjacent properties. Discarded or unused household items shall be stored or properly
disposed of to avoid mold, rodent and insect infestations which may result in health risks and which also
create unsightly appearances that negatively affect neighborhoods. Such violations shall be corrected
immediately upon written order from the city.
IPMC 304.7 Roofs and drainage. The roof and flashing shall be sound, tight and not have defects that
admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and free
from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance.
STATEMENT OF CODE ENFORCEMENT OFFICER: On 1/25/2019 the undersigned Code
Enforcement Officer conducted an inspection of the premises located at 925 AMBERJACK LN. During
the inspection, the undersigned Code Enforcement Officer observed that the property was in violation of
the section listed above in the City of Atlantic Beach Code of Ordinances. The nature of the violation

included: The soffit of your roof is loose and needs to be repaired. All items being stored in the front
yard must be removed.

follows:
FINDINGS OF FACT

Failure to comply will result in a$250.00 per day fine for the first day and $250.00 every day
thereafter the violation continues to exist.
CONCLUSIONS OF LAW
THAT the Respondent is NOT IN COMPLIANCE with IPMC Section 304.7 and City of Atlantic Beach
Ordinance Section 154(g).
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach,
Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on or
before January 31, 2019. Failure to comply will result in fines of$250.00 for the first day and $250.00

for every day thereafter while the violation continues to exist. In addition, any fine shall also include the
administrative costs to the City incurred in prosecuting this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code Enforcement
Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the property at 925
AMBERJACK LN for the total assessment plus costs incurred for the filing of the lien. All lien
amounts are to be made payable at an interest rate of ten (10) percent per annum from date of
certification until paid.

The Code Enforcement Board may levy fines up to $250.00 per day for the first violation and $500.00
per day for a repeat violation. If the violation is corrected and then recurs or if the violation is not
corrected by the time specified for correction by the Code Enforcement Officer, the case could be
presented to the Code Enforcement Board even if the violation has been corrected prior to the Board
hearing. Upon completing the corrective action required, it is your responsibility to contact Atlantic
Beach Code Enforcement and arrange for an inspection to verify compliance at (904) 247-5855.

the receipt of this notice.

must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The
Board may impose fines up to two hundred fifty ($250.00) per day for continuing violations. Upon
completing the corrective action required, it is your responsibility to contact Atlantic Beach Code
Enforcement and arrange for an inspection to verify compliance.

IPMC Sec. 304.6 Exterior walls. All exterior walls shall be free from holes, breaks, and loose or rotting
materials; and maintained weatherproof and properly surface coated where required to prevent
deterioration.
IPMC Sec. 304.1 General. The exterior of a structure shall be maintained in good repair, structurally
sound and sanitary so as not to pose a threat to the public health, safety or welfare.
Section (A) 108.1.2 Unsafe equipment. Unsafe equipment includes any boiler, heating equipment,
elevator, moving stairway, electrical wiring or device, flammable liquid containers or other equipment
on the premises or within the structure which is in such disrepair or condition that such equipment is a
hazard to life, health, property or safety of the public or occupants of the premises or structure.
IPMC Sec. 505.4 Water heating facilities. Water heating facilities shall be properly installed, maintained
and capable of providing an adequate amount of water to be drawn at every required sink, lavatory,
bathtub, shower and laundry facility at a minimum temperature of 110F (43C). A gas-burning water
heater shall not be located in any bathroom, toilet room, bedroom or other occupied room normally kept
closed, unless adequate combustion air is provided. An approved combination temperature and pressure-
relief valve and relief valve discharge pipe shall be properly installed and maintained on water heaters.
This letter requests that the noted violation(s) be corrected by remove all standing water and
prevent any more water from entering the home. Repair water heater and pump and bring it up
to code. You will need to obtain a plumbing permit. Repair all holes in the interior walls and
pealing paint. Clean and dry all wet carpet. Repair broken concrete at overhang th within ten (10)
days of the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this notice
must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The

be displayed,maintained or permanently stored outdoors, or in any location on the lot where such items
are visible from adjacent properties. Discarded or unused household items shall be stored or properly
disposed of to avoid mold, rodent and insect infestations which may result in health risks and which also
create unsightly appearances that negatively affect neighborhoods. Such violations shall be corrected
immediately upon written order from the city.
IPMC 304.7 Roofs and drainage. The roof and flashing shall be sound,tight and not have defects that
admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and free
from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance.
This letter requests that the noted violation(s) be corrected by repairing loose soffit, removing all
items stored in front yard, gas cans, tires, concrete, bins, ladder, buckets within ten (10) days of
the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this notice
must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The
Board may impose fines up to two hundred fifty ($250.00) per day for continuing violations. Upon
completing the corrective action required, it is your responsibility to contact Atlantic Beach Code
Enforcement and arrange for an inspection to verify compliance.
