We are writing as neighboring homeowners within The Bluffs to inform you of our position
with respect to your property at 2337 Seminole Road, Atlantic Beach, Florida. We object to
any plans for development of your property that would obscure any of the ocean view that
we have enjoyed for more than twenty-two years.
In January 2007,we put our home up for sale. Our real estate agent said that we needed to
disclose to potential buyers the possibility that you, or buyers of your property,might
transform your single-story building into one or more buildings that could obscure part of
our home's ocean view.
We took our agent's advice and disclosed your development possibilities. The possibility of
losing some of our view has already damaged us: we lost offers from two prospects who
decided not to buy, once they knew the possibilities of your development. Our real estate
contract expired last month, and we have taken the home off the market.
Our ocean view is tangible and has value. We write to serve notice to you,and your real
estate agent, of our intention to initiate legal action against you and any buyer planning to
modify the property in any manner that would impede the ocean view of our property.
We recognize that you have a right to use your property;however we assert that we,too,
have property rights in this matter. The damage we incurred as a result of your
undetermined development plans is real, and it is not negligible. We hope that you will
not exercise your property rights at the expense of your neighbors' property rights.
