Subject: City Code:Chapter 24,Sec 24-112 (b) Commercial General District Permitted Uses
Dear Ms.Baker,
The purpose of this correspondence is to serve as an Official Notification of Violation. It has been reported that
you are operating or managing a business within the jurisdiction of City of Atlantic Beach that is in violation of
the following City Code:
Chapter 24,Sec 24-112(b)Commercial General District Permitted Uses:Does not include amusement
centers,bingo,billiard or pool halls,game arcades,gaming,video poker establishments or individual
machines,including any type of token or coin operated video or simulated games or similar activities or
machines which are played for any type of compensation or reward in the City of Atlantic Beach.
In an effort to eliminate any undue hardship,you are granted 14 days from receipt of this letter to either bring
your business into compliance with the aforementioned ordinance by ceasing all operations that are in violation,
or by providing proof to the satisfaction of the Public Safety Director,the Zoning Department and myself that
no violation exists.
Any requests to appeal this notification must be made in writing and received by the City Clerk not later then 7
days from the date you receive this notification. Your appeal would then be scheduled to be heard before the
City Commission and would be based solely on your business practices and whether they are in violation of City
Code. The Commission is not empowered to provide leniency in regard to the City's ordinances and can only
interpret and enforce those that exist.
Failure to comply with this notification will be considered non-compliance and will result in Code Enforcement
action against you and your business,which can result in fines of up to$500.00 per day per violation from the
Code Enforcement Board.
