You have specifically requested that the proposed development projects be vested from Section 24-172 of the Land Development Regulations, the Residential Development Standards, which were adopted by Ordinance Number 90-06-195 on the night of September 11, 2006. Based upon information previously submitted to the City, which includes preliminary design plans for two single-family residences first submitted on July 19, 2006, and revised plans demonstrating additional architectural design work submitted on September 11, 2006, the intended plan for redevelopment of these two lots has been established prior to the adoption of Ordinance Number 90-06-195. The City finds that Mr. Petroni, the title owner of record of said lots, his successors or assigns, are entitled to common law vested rights, for a period of five (5) years, exempting the proposed development, as depicted on the preliminary architectural plans (dated 09-05-06) from Section 24-172 of the Land Development Regulations, the Residential Development Standards, in that each of the following criteria are demonstrated. 1. An act of the government has occurred. The City has adopted Residential Development Standards, which would otherwise be applicable to the subject properties. 2. The property owner has relied in good faith on previous acts of the government. Architectural design and stormwater plans have been prepared in good faith reliance on the Land Development Regulations in effect at the time such plans were prepared. Page two Mr.Bull September 14,2006 3. The property owner has had a substantial change in position. The expenditure of significant funds has been incurred in preparation of architectural design and stormwater plans. Please bear in mind that this vesting determination relates only to the project as proposed within the plans as submitted with this request. Any alternative plans would be subject to the requirements of Section 24-172 as these may apply. All other applicable land development regulations, building codes and permitting requirements, which are in effect at the time Building Permits are sought, shall apply to the redevelopment of this property.
