AGENDA ITEM: Approval of Interlocal Agreement with the City of Jacksonville
regarding Fleet Landing property

BACKGROUND: Fleet Landing owns and wishes to develop property which is
located partially in the City of Jacksonville and partially in the City
of Atlantic Beach. The City of Jacksonville has approved an
Interlocal Agreement which delegates responsibilities for zoning
compliance, pernutting, plan review, construction inspections,
review and final issuance of certificate of occupancy to Atlantic
Beach.
BUDGET: N/A
RECOMMENDATION: Authorize the Mayor to execute the Interlocal Agreement with the
City of Jacksonville concerning the expansion of Fleet Landing

hereby authorized to execute the Interlocal Agreement on behalf of '
the City of Jacksonville.
Section 3. Effective ,Date. This Resolution shall become
effective upon signature by the Mayor or upon becoming effective
without the Mayor's signature.

.THIS INTERLOCAL AGREEMEN4`.("Agreement") is made and entered
into this day of 2001, and shall
be effective upon filing with the Clerk as herein provided.
between the CITY OF JACY,SONVILLE, FLORIDA, a municipal
corporation' ("Jacksonville"), and the' CITY OF ATLANTIC BEACH,
FLORIDA, a municipal corporation ("Atlantic Seach"1, both in
Duval County, Florida.
IN CONSIDERATION of the mutual covenants contained herein
and ..for .other good and valuable consideration, the legal
sufficiency of which is acknowledged by the parties, the parties
agree as follows:
1. SIIS~TaSX. ..This Interlocal Agreement defin®s the
building codes and zoning code which shall control the
.development of the 100 acres owned by Fleet Landing,. a
Florida corporation, as more pazticularly described
and shown in Composite Attachment A, which, is attached
hezeto and incorporated herein by this reference.
_ 2. PURPOSE. This Interlocal Agreement is necessary
because ,the above-described property is located
partially in the City of .Jacksonville and partially in
the City of Atlantic Beach. Both the .zoning codes and'
building codes of each city are different. These

3. APPLSCABILITY OF ATLANTIC $EACB LAWS, ORDINANCES AND
REGIILATxONS. This project shall cos~cply with the laws,

of the City of Atlantic Beach.
4. xgsPOxsxsrzsTZ~s. The parties shall have the
following responsibilities, which max be sugplemented
or more specifically defined as necessary fzom time to
time for the conduct of this lntexlocal Agreement:

No responsibilities.

terminate this Interlocal Agreement, with or without
cause, upon thirty (30) days notice to each ocher,
either by a single writing signed by all the parties,
or by separate proposals to tezzninate thereafter
agreed to in writing by the other gazty.
