Approval of the minutes of the Regular Meeting held July 2, 1996. 2. Recognition of Visitors and Guests regarding any matters that are not listed on the agenda. 3. OLD BUSINESS: The following information contains a report of compliance relative to old business of the Board. If a Board Member has questions or would like further information regarding any of the reports; the Code Enforcement Officer will be happy to respond to questions at the meeting. Case No. 0107 - Sarah and Charles Bratcher - property lying between West 9th Street and West 10th Street As directed by the Board, the Bratchers have complied with the first part of the order by June 7, 1996. The boat remains on the property at this time and may remain until November 15, 1996. Case No. 0108 - Robert J. Stewart - 348 Church Street Mr. Stewart was denied garbage pick up by the City under the conditions it was placed out. A hand delivered notice was given to Mr. Stewart and he is now in the process of compliance. I personally met with Mr. Stewart and pointed out conditions in need of improvement. Case No. 0112 - Wayne Weinaug - 850 Amberjack Lane Mr. Weinaug was to comply. Mr. Ford instructed him to have his permit process completed by June 24, 1996 or he would condemn the structure. Mr. Weinaug requested an additional 30 days to hire a contractor and complete an aluminum screen enclosure to replace what he had illegally constructed. This time extension was not granted by Mr. Ford. Mr. Weinaug agreed to demolish the illegal structure and hire a contractor to complete an aluminum screen enclosure. Repeat violator.- Case iolator: Case No. 4576 - Sean L. Phinney - 385 East Coast Drive. The owner of the property is in violation of Chapter 24, Section 24-65-C Permit Required and Chapter 19, Section 19-1 Obstructing Right -of -Way of the Code of the City of Atlantic Beach in that there exists on the premises located at 385 East Coast Drive the following condition(s): permit required for a fence and obstruction of right-of-way by placing a fence on the right- of-way. A fence permit was issued and the fence was moved from the right-of-way. Case No. 4362 - Robert Lang, Jr. - 2142 Fairway Villas Lane. The owner of the property is in violation of Chapter 12, Section 12-1-3 of the Code of the City of Atlantic Beach in that there exists on the premises located at 2142 Fairway Villas Lane the following condition(s): high weeds and grass, outside storage of bikes and miscellaneous trash - bottles, cans, paper and other items in front of the house. On March 6, 1996, the meter was locked for failure to pay past due bills. As of this date, the past due amount is $218.71, representing February, March, April, May and June. The occupant, Jeff Davis, came to the water department to request reconnection, however, it was denied until the pending bill is paid. Please refer to my letter to Willie Knight dated May 31, 1992, for a more detailed explanation of violations. It was determl ed three separate instances o��vlolations had occurred under Florida Statutes and each ins -mance could be fined not to exceed $500.00' It was determined wo issues should be considered (1) Mr. Moale did not get a ermit (2) was not licensed. It was moved by Mr. Dowling that � s Moale be fined $250.00 for violation of State Statutes for o being a licensed contractor for doing the kind of work was d ing, and for not pulling a permit when he was inform to do so. New Business: Case No 0051 Willie Knight, owner of property located at 790 Sailfish Drive, in violation of Section 22-29, Past Due Water Charges, Section -22-32, Connection of Private Water System to City System, Section 22-40, Well - Permit Required, Section 22- 41, Bacteriological Tests for Potable Water, and S B C C I Standard Plumbing Code 301.15, Princi le No. 15 (There shall be no direct or indirect cross connections, either existing or potential between a safe potable water supply and an unsafe, nonpotable supply) Heywood Dowling read the case hearing procedure for Case No. 0051, Willie Knight, and all witnesses were sworn in. George Bull read the violations against Willie Knight. Suzanne Green reported Willie Knight displayed the same behavior with reference to water when he lived at another property in Atlantic Beach. Don Ford reported the Water Department asked him to inspect Willie Knight's house located at 790 Sailfish Drive. He reported the water meter was shut off but there was evidence water was being utilized. Upon investigation Mr. Ford discovered there was a shallow well behind the carport and the water from the shallow well was being used by the Knight family. Mr. Ford met with Mr. Knight and filled out the proper notice indicating Mr. Knight had to disconnect the shallow well. To date, Mr. Ford reported, Mr. Knight had not disconnected the shallow well. Willie Knight stated he had a sick daughter who had been in a car accident in 1981. He reported he had to pay $400 per month in medical bills and, thus, was not able to pay his bill, and that 0 It was explained to Mr. Knight that a dangerous health hazard existed because the water he was getting from the shallow well could infiltrate into the City's water system. It was explained it would be necessary to disconnect the hose connected to the shallow well immediately. He was advised to see the City Manager immediately to make arrangements to get legal water to his residence. A motion was made by Mr. Martin, seconded by Mr. Dowling, that it would be necessary for Willie Knight to correct his water problem within two days, by January 7, 1993. The question was called and the motion passed unanimously. Mr. Martin read the ase hearing procedure for Cas o. 0052, Terry Kirton. (witnesses ere sworn in previously) Suzanne Green reported the condition of the uard rails at Royal Palms Apartments presentd a safety hazard the residents. Karl Grunewald distributed pic ures of the r flings which indicated their rusted state. He in��cated this s a violation of Florida Statutes. Don Ford reported he inspec ed the guard rails in 1992 and explained that Royal Pal would e cited if the guard rails were not repaired. He explax ed re -inspected in March, 1992 and nothing had been done. He'"n icated he was concerned for the safety of children. Terry Kirton reported she had ceiv d bids on having the work done and the job was presently and r cont ct. She reported she signed the contract December 16, 992 in th amount of $9,400. If it was not complete within 30 days, a $50.00 fine wo ld be levied on Royal Palms Apar� tents. If in the event the work was.not completed within 30 day on Ford was instructed to notify the `Florida Hotel and Restauran Commission. Mr. Dowling telt temporary safety measures should be taken in the meantime while the guard rails were being built.
