3. UNFINISHED BUSINESS:
A. Case No. 99-8445 (previously 99-7861) - Kevin & Kimberly Rissmiller,
386 Sargo Road. The owners of the property are in violation of the following sections of
Chapter 12 of the Atlantic Beach City Code, in that there exists on the premises located at 386
Sargo Road, the following condition(s):
Sec. 12-1-3
- Excessive vegetation on property
Sec. 12-1-4
- Swimming pool water is stagnant
Sec. 12-1-7
- Open storage, rear yard is cluttered
Sec. 12-1-8
- Allowing building, fence & property to
become unsafe and unsanitary
Sec. 12-1-3
- Property is a detriment to public health
and safety
Disposition: Mrs. Rissmiller has removed the majority of the items that were stored
in her yard. The vegetation has been cut and/or sprayed with a weed killer. The
fish have been removed and chlorine put into the water to kill any algae. Emptying
the pool will result in it raising out of the ground. Code Enforcement Official
Grunewald will monitor the situation and if needed, will have the pool covered with
a plywood deck. This method has been used in Jacksonville Beach on several
occasions. Unfortunately, there does not appear to be any male assistance in the
upkeep of this property.
H.R.S. and Department of Child and Family Services has been notified of the
apparent conditions at this location.
B. Case No. 99-8455 - Benjamin Brown, 457 Sailfish Drive. The owner of the
property is in violation of Chapter 12, Section 12-1-7, and Chapter 6, Section 6-108, of the Code
of the City of Atlantic Beach in that there exists on the premises located at 457 Sailfish Drive the
following condition(s): Outside storage Miscellaneous Material, and Address numbers not
displayed.
Disposition: Mr. Brown was not given a decisive time in which to reach
compliance. Notice of the Findings of Fact were sent via certified mail, however, the
receipt has not been returned to date. Code Enforcement Official Grunewald
requests that the board state a definite time frame for compliance and authorize
posting of the property with the new Findings of Fact.
C. Case No. 99-8457 - Thomas J. Bennet, 131 Belvedere Street. The owner of the
property is in violation of Chapter 24, Section 24-65(c), of the Code of the City of Atlantic Beach
in that there exists on the premises located at 131 Belvedere Street the following condition(s): No
building permit issued.
Disposition: The property is in compliance, and the administrative fee of $71.57
assessed to Mr. Bennet has been paid.
D. Case No. 99-8473 - Edward & Cindy Winters, 4824 Spring Glen Road,
Jacksonville, Florida. The owners of the property are in violation of Chapter 12,
Section 12-1-7, of the Code of the City of Atlantic Beach in that there exists on the premises
located at #986, vacant lot on Stocks Street, a/k/a Lot 2, Block 160, Section H, the following
condition(s): Outside storage of Building Material.
Disposition: On October 5, 1999, the Public Works Department cut and
removed all vegetation and trash from the property. The owners were invoiced in
the amount of $410.00 which has not been paid to date.

This individual received a citation from the Atlantic Beach Animal Control Officer,

The meeting was called to order at 7:30 p.m. by Chairman Ken Rogosheske, followed by the
Pledge of Allegiance to the Flag.
1. Approval of Minutes of the Regular Meeting of May 4, 1999.
The minutes of the Regular Code Enforcement Board Meeting of May 4, 1999, were
unanimously approved as presented.
2. Recognition of Visitors and Guests regarding any matters that are not listed on the
agenda.
There were no visitors.
3. UNFINISHED BUSINESS:
Code Enforcement Official Grunewald presented brief follow-up reports on the following cases:
A. Case No. 98-7215 Richard Berdych (Corner Stone Concrete), 47 West 2nd
Street. Violation of Chapter 12, Sec. 12-1-7 of the City Code.
Disposition: The property is in compliance, and the administrative fee of $66.20
assessed to Mr. Berdych has been paid.
B. Case No. 99-8204 Willie Pearl Hobbs, 410 Sargo Road. Violation of Chapter 12,
Sec. 12-1-7 of the City Code.
Disposition: The property is in compliance, and the administrative fee of $66.20
assessed to Ms. Hobbs has been paid.
C. Case No. 99-8218 Stephen Corsano,1305 Rose Street. Violation of Chapter 12,
Sec. 12-1-3 of the City Code.
Disposition: The property is in compliance, and the administrative fee of $66.20
assessed to Mr. Corsano has been paid.
D. Case No. 99-8199 Willie Johnson, 1921 Mealy Street. Violation of Chapter 12,
Sec. 12-1-7 of the City Code.
Disposition: The property is in compliance, and the administrative fee of $66.20
assessed to Mr. Johnson has been paid.
E. Case No. 99-8257 Wayne Weinaug, 845 Amberjack Lane. Violation of Chapter
12, Sec. 12-1-7 of the City Code.
Disposition: The property is in compliance, and the administrative fee of $107.55
assessed to Mr. Weinaug has been paid.
F. Case No. 99-8213 Lisa Ulm (Dash Rip Rocks), 539 Atlantic Boulevard. Violation
of Chapter 11, Sec. 11-1 of the City Code.
Disposition: The administrative fee of $66.20 assessed to Ms. Ulm was paid on
May 24, 1999, and at that time the property was in compliance.
However, on June 26, 1999, police officers were dispatched to Dash Riprocks on two
separate occasions for excessive noise. On July 1, 1999, Code Enforcement Officer
Grunewald sent a certified letter to Lisa Ulm advising her that these calls fall within the
realm of the Findings of Fact of the Code Enforcement Board of May 4, 1999, submitted
a detailed Invoice, reflecting No Charge for the first violation, and a fine of $250.00 due
for the second violation. To date, this fine has not been paid.
Chairman Rogosheske asked Code Enforcement Officer Grunewald if there is any action
for the Board to take, and Officer Grunewald advised there is none to be taken at this
time.
Chairman Rogosheske asked if there was any business not on the Agenda to come before the
Board tonight. A man in the audience, Preston Jackson, said "Yes". Code Enforcement Official
Grunewald stated that the parties named in Item 7 of the Amended Agenda, Preston Jackson and
Dan Armstrong, were present and would like to be heard.

4. NEW BUSINESS:
Chairman Rogosheske read the case numbers and names of persons being brought before the
Code Enforcement Board. Code Enforcement Official Grunwald asked the Chairman for Item 7
to be brought up at this particular time, and Chairman Rogosheske granted his request.
Mr. Grunewald explained that Dan Armstrong has a licensed home occupation for a marketing
type business at his residence at 87 Nicole Lane. His neighbor, Preston Jackson of 86 Nicole
Lane, alleges that the business violates city code in that there is a UPS delivery made each day to
the front door of 87 Nicole Lane. Mr. Grunewald stated that this matter has been reviewed by
Code Enforcement, and his determination is that there is no violation. However, since Mr.
Jackson has pursued this, it has been brought before the Code Enforcement Board for
interpretation.
Code Enforcement Official Grunewald further stated that he has interviewed Mr. and Mrs.
Armstrong and concluded there is no violation of the Code. Mr. Grunewald has also spoken with
Community Development Director, George Worley, and City Attorney, Alan Jensen, who have
concurred that there is no violation of the code in this matter. Mr. Worley has written a letter to
the Code Enforcement Board regarding his interpretation of Chapter 24, Section 24-159 of the
Atlantic Beach Code of Ordinances. Mr. Grunewald advised that Mr. Worley is in a Tree Board
Meeting at City Hall and is available to testify if needed by the Board.
Prosecuting Attorney Suzanne Green stated that the interpretation of Mr. Worley and Mr.
Grunwald and an outline of the ordinance has been presented to the Board; that a violation of
the ordinance has not been filed; that it is a dispute between two citizens of Atlantic Beach.
Chairman Rogosheske asked legal counsel how to pursue this.
City Attorney Alan Jensen advised that he agrees with Code Enforcement Official Grunewald
and Community Development Director Worley's position, and his advice to the Board is that it
doesn't appear to be a violation.
Each of the Board members indicated they had read the ordinance in this regard.
Mr. Grunewald asked Preston Jackson if he would like to present his case.
Preston Jackson, 86 Nicole Lane, addressed the Board, and asked for help in resolving the
problem. He stated that the Armstrongs live directly across the street from him, and he has no
problem with someone having a business in their home, but he does feel that this particular
business does violate this particular ordinance. His primary concern is the daily scheduled home
pickups by UPS. He stated that the streets are a lot narrower in the neighborhood, the homes are
set back only 25 feet from the curb, and people should not be subjected to commercial type
traffic. He added that boxes are stacked up at door, noise of UPS truck making deliveries, truck
speeds through, his dog gets upset, and several times they haven't been able to get out of their
driveway because of the UPS truck. (At this point he read part of the ordinance pertaining to

vehicular traffic.) Mr. Jackson stated that every afternoon, a UPS truck comes and disrupts the
neighborhood, and it doesn't belong in a residential neighborhood.
Chairman Rogosheske stated that he lives in a gated community, Sevilla Condominiums, and
they have UPS come in and out all the time, and that he is not in business. He stated that he
thinks this is something that all of us experience.
Prosecuting Attorney Suzanne Green stated that Mr. Armstrong would like to speak also.
Dan Armstrong, 87 Nicole Lane, addressed the Board, and submitted to the Board copies of a
Florida Supreme Court case, Moore v. Stevens, 106 So. 901, 43 A.L.R. 1127, and presented a
diagram of the neighborhood. He stated that, in his defense, all of his neighbors have signed
affidavits stating they have no problem with the business in his home or UPS deliveries. Before
closing, he stated that he wouldn't go any further about the reason this matter was brought up,
because he would probably incur civil litigation.
The Code Enforcement Board reviewed the documentation presented by Mr. Armstrong, and
asked Attorney Jensen what the definition of "storage" is. Mr. Jensen reviewed the Code, and
advised that there is no definition at the beginning of the Code, but thinks that what is anticipated
by Sec. 24-159 "storage or outside use of equipment or materials" is like plumbing materials
stacked outside.
Mr. Jackson once again addressed the Board and stated "First of all, I would like to say I don't
appreciate Mr. Armstrong threatening me with civil litigation. These other people aren't home
when the trucks come."
Chairman Rogosheske advised Mr. Jackson that the Board has to decide whether there is a
violation here.
Each Board member stated his or her opinion, and each felt there is no violation involved here.
Chairman Rogosheske advised Mr. Jackson that it is the unanimous opinion of the Code
Enforcement Board that there is no violation of City Code in this matter. Mr. Jackson accepted
the findings, and stated that is why he wanted it brought before the Board, to get an opinion.
At this time, Chairman Rogosheske read the roll, the conduct of the meeting, and asked all
witnesses to stand, raise their right hands, and they were sworn in.

Code Enforcement Official Grunewald then presented the first case:
A. Case No. 99-8445 (previously 99-7861) - Kevin & Kimberly Rissmiller,
386 Sargo Road. The owners of the property are in violation of the following sections of
Chapter 12 of the Atlantic Beach City Code, in that there exists on the premises located at 386
Sargo Road, the following condition(s):
Sec. 12-1-3 - Excessive vegetation on property
Sec. 12-1-4 - Swimming pool water is stagnant
Sec. 12-1-7 - Open storage, rear yard is cluttered
Sec. 12-1-8 - Allowing building, fence & property to
become unsafe and unsanitary
Sec. 12-1-3 - Property is a detriment to public health
and safety
Official Grunewald reported that this case has history dating back to 1994, 1995, 1997, 1998 and
March of 1999, and the Rissmillers are here again now. The reason this time is, again, the two
vehicles remained on the property, basically rusting away, and are obviously abandoned vehicles.
They have a water to air heat pump and were discharging the water into the city system.
Excessive vegetation is growing on the house; numerous piles of trash; and an inground pool is
not filtered, pool water is stagnant and has vegetation growing out of it. Official Grunewald
passed pictures of the property to the Board members, and stated that Mrs. Herbert Plum, a
neighbor is present as a witness.
Official Grunewald reported that he made many attempts to serve the Rissmillers by certified
mail and it was not accepted. He then served them by hand delivery. Mrs. Rissmiller then called
and asked Official Grunewald what she could do to bring the property into compliance. They
have been working on it, and to date, the two cars have been removed, and most of the trash has
been removed. The water has been redirected to sprinklers. The main concern to Official
Grunewald at this time is the swimming pool because it is unfiltered and polluted. Also, a
washer and dryer still remains in the back yard. Mrs. Rissmiller has indicated that she will make
every effort to get someone to get those items out to the curb for her. There is still vegetation on
the sides of the house.
Mrs. Rissmiller has asked the Board for an extension of time, and since she has taken some
action, Official Grunewald asked the Board to give her an additional 30 days. In addition, she
has outstanding administrative charges of $185.18, and an additional $189.84 for this meeting,
for a total of $375.02.
Kimberly Rissmiller appeared before the Board, and had 2 small children and an infant with her.
She stated that her husband is still ill, and that she is once again expecting another child. She
further stated that within the next week, she will get someone to move the washer and dryer, and

will replace the pump on the pool.
Chairman Rogosheske commented to Mrs. Rissmiller the fact that she has been before the Board
so many times before. Mrs. Rissmiller responded that before, it was the cars and back yard. She
also stated that she lost her job at America Online, but declared that the Board will not see her
here again.
Chairman Rogosheske stated to Mrs. Rissmiller that he is sorry, but there is a Code in Atlantic
Beach, and the Board has to look at what is presented to them as a code violation.
Mrs. Herbert Plum of 394 Sargo Road appeared before the Board as a witness, and stated that she
was not aware of the prior violations, however, the problem they have had was the water from
the A/C draining onto their property, and they asked the Rissmillers to change this since it
created a problem with the stench from the soggy ground and mosquitos, and there is stench from
the pool which is stagnant and it is a breeding ground for mosquitos. She stated that she doesn't
mean to be mean or spiteful, but would just like to have these problems corrected.
Mrs. Rissmiller stated there is no mosquitos, and that they have gold fish in the pool.
The Board discussed the entire situation, and expressed much concern about the pool. Board
Member Mann made a motion, seconded by Board Member Etheridge, to grant the 30 -day
extension based on Official Grunewald's recommendation, and if there is any violation of the
water going onto Mrs. Plum's yard, it has to be corrected. Mrs. Plum stated they have corrected
that already.
Board Member Etheridge made a motion, seconded by Board Member Sanders, that all of
the violations be corrected and 30 days be granted to satisfy those remaining, and that the
$375.02 administrative fees should be paid. Board Member Pelkey asked if she is not in
compliance within 30 days, what then? Board Member Etheridge asked Official Grunewald what
penalty would be proper if not in compliance in 30 days, and Official Grunewald advised that he
could not make that determination for the Board, but that it could go up to $250 a day. Mr.
Pelkey stated he would like to see the City go in there and clean it up if not in compliance in 30
days.
Board Member Etheridge made a motion to find the Rissmillers in violation of the Code,
and Board Member Pelkey seconded the motion. The motion was unanimously approved.
Chairman Rogosheske advised Mrs. Rissmiller that she has been found guilty of being in
violation of Sections 12-1-3, 12-1-4, 12-1-7, 12-1-8, and 12-1-3 of the Atlantic Beach City Code,
and as a result thereof, a decision will now be made by the Board as to what she must do.
Board Member Etheridge stated that as a part of his original motion, if the violations have
not been corrected in 30 days, Mrs. Rissmiller shall be fined $50.00 a day for each day over

the 30 days until they are brought into compliance, and it was seconded by Board Member
Sanders.
Board Member Pelkey stated that he would like to see that the City come in and clean up this
property if it is not done in 30 days. Official Grunewald stated that the matter of the pool could
be turned over to the Health Department if not corrected in 30 days.
Board Member Etheridge reiterated his motion, and added that if the violations are not
corrected in 30 days, that whatever steps are necessary be taken to have the City investigate
and clean up the property, the costs of which would be the responsibility of the Rissmillers,
(except the swimming pool), and that the administrative charges previously discussed,
totalling $375.02 be charged. This motion and addition to the motion was seconded by
Board Member Sanders. The motion was unanimously approved.
Chairman Rogosheske then advised Mrs. Rissmiller of the Board's decision, and that she will be
notified within five working days, and that she will need to make sure that the administrative
costs are paid.
B. Case No. 99-8455 - Benjamin Brown, 457 Sailfish Drive. The owner of the
property is in violation of Chapter 12, Section 12-1-7, and Chapter 6, Section 6-108, of the Code
of the City of Atlantic Beach in that there exists on the premises located at 457 Sailfish Drive the
following condition(s): Outside storage Miscellaneous Material, and Address numbers not
displayed.
Code Enforcement Official Grunewald reported that he had a conversation with Mr. Brown and
his son and that some steps were taken to clean up the property, but there still remains a lot of
junk (for lack of a better word) to be cleaned up. Mr. Brown is not present for this meeting, and
Official Grunewald advised that Mr. Brown left a phone message that he has gone to a family
reunion. Official Grunewald further advised that this is not a repeat violation, that he was before
the Board previously on a vegetation violation.
Board Member Sanders made a motion, seconded by Board Member Ethridge, to find
Benjamin Brown in violation of Chapter 12, Section 12-1-7, and Chapter 6, Section 6-108 of
the Code of the City of Atlantic Beach, and that he is directed to remove the outside storage
of miscellaneous material, install house numbers visible from the street a minimum of three
inches in height, and pay the administrative fee assessed to him of $110.99. His failure to
do so will result in a fine of $250.00 per day, and any future violations of this ordinance will
result in an automatic fine of $500.00 per day from the day first noticed by the Code
Enforcement Officer until such time as the violation is brought into compliance. The
motion was unanimously approved.

C. Case No. 99-8457 Thomas J. Bennet, 131 Belvedere Street. The owner of the
property is in violation of Chapter 24, Section 24-65(c), of the Code of the City of Atlantic Beach
in that there exists on the premises located at 131 Belvedere Street the following condition(s): No
building permit issued.
Code Enforcement Official Grunewald reported that Mr. Bennet failed to get a building permit
for installation of a fence in front of his property. He was verbally informed that the fence as
installed was in violation of the zoning ordinance, and Official Grunewald cited him for not
having a permit. Mr. Bennet has cut the fence in front of the house to four feet, and the side of
the house is six feet. He has obtained a permit and is now in compliance with the City. Official
Grunewald's recommendation is to find Mr. Bennet in compliance, and if need be, will bring him
back before the Board on a zoning violation if he does not remove the six-foot fence.
Board Member Pelkey made a motion to find Thomas J. Bennet in compliance, and assess
administrative fees of $71.57 against the property. The motion was seconded by Board
Member Etheridge, and was unanimously approved by the Board.
D. Case No. 99-8473 - Edward & Cindy Winters, 4824 Spring Glen Road,
Jacksonville, Florida. The owners of the property are in violation of Chapter 12,
Section 12-1-7, of the Code of the City of Atlantic Beach in that there exists on the premises
located at #986, vacant lot on Stocks Street, a/k/a Lot 2, Block 160, Section H, the following
condition(s): Outside storage of Building Material.
Code Enforcement Official Grunewald reported that this is an abandoned construction site, and
he has posted the property. He recommended that the Board find the owners in violation of the
City Code, authorize the City to go in and clean it up at the time the notice expires, and assess an
administrative fee of $79.74 .
Mr. Bernard Showers of 974 Stock Street, appeared as a witness, and confirmed the allegations.
A motion was made by Board Member Pelkey to find Edward and Cindy Winters in
violation of Chapter 12, Sec. 12-1-7 of the City Code, and if the property is not cleaned up
within the time allowed on the posted notice, that the City go in and bring it up to standard
and any costs incurred be charged to the owners, and also that the administrative fee of
$79.74 be charged to the owners. Additionally, if there is a reoccurrence of the violation,
the owners shall be charged $250 per day until violation is corrected. Board Member
Etheridge seconded this motion. The motion was unanimously approved.

♦ Chairman Rogosheske announced that one of the members of the Board, Lou Etta Waters,
is leaving, and expressed to Lou Etta that the Board is sorry to see her go and they have
enjoyed having her with them. The Chairman then presented Lou Etta Waters with a
framed Certificate of Appreciation and a card, and asked everyone to have cake and
coffee with Lou Etta on her departure. Pictures were taken by the Secretary.
♦ Chairman Rogosheske also announced that Board Member Sanders has decided to stay on
the Board for another three years.

The Code Enforcement Board of the City of Atlantic Beach was
created pursuant to Florida Statutes and exists for the purpose of
facilitating the enforcement of the Code of Ordinances. It is
comprised of seven citizens, residents of Atlantic Beach, who meet
regularly to hear allegations of code violations.
You are hereby notified and ordered to appear at the next
public hearing of the Code Enforcement Board on TUESDAY, the 9th
day of November, 1999, AT 7:30 P. M. at Atlantic Beach City Hall,
800 Seminole Road, to answer and be heard to the alleged violations

The Code Enforcement Board of the City of Atlantic Beach was
created pursuant to Florida Statutes and exists for the purpose of
facilitating the enforcement of the Code of Ordinances. It is
comprised of seven citizens, residents of Atlantic Beach, who meet
regularly to hear allegations of code violations.
You are hereby notified and ordered to appear at the next
public hearing of the Code Enforcement Board on TUESDAY, the 9th
day of November, 1999, AT 7:30 P. M. at Atlantic Beach City Hall,
800 Seminole Road, to answer and be heard to the alleged violations
of the following Section (s) : Chapter -4, Section 4-30 (b) , Failure to
pay Animal Control Citation. It is alleged that you are in
violation of the above enumerated code section(s) in that you have
failed to pay the prescribed fine of $25.00 within 14 days of
issuance of the citation resulting in the fine increasing to
$50.00. Failure to pay any fine may result in a lien against your
home or personal property. Legal Description of property: Pt Govt

The Code Enforcement Board has the power to levy fines up to
$250.00 per day for the first offense and $500.00 for the second
offense against the property, if a violation is found to exist
beyond the date set by the Board for compliance. If the violation

Dear Mr. Mordt:
The Code Enforcement Board of the City of Atlantic Beach was
created pursuant to Florida Statutes and exists for the purpose of
facilitating the enforcement of the Code of Ordinances. It is
comprised of seven citizens, residents of Atlantic Beach, who meet
regularly to hear allegations of code violations.
You are hereby notified and ordered to appear at the next
public hearing of the Code Enforcement Board on TUESDAY, the 9th
day of November, 1999, AT 7:30 P. M. at Atlantic Beach City Hall,
800 Seminole Road, to answer and be heard to the alleged violations
of the following Section (s) : Chapter 4, Section 4-30(b) , Failure to
pay Animal Control Citation. It is alleged that you are in
violation of the above enumerated code section(s) in that you have
failed to pay the prescribed fine of $100.00 within 14 days of
issuance of the citation resulting in the fine increasing to
$150.00. Failure to pay any fine may result in a lien against your
home or personal property. Legal Description of property: Pt Govt
Lot 4, RE#: 172318-1000.
The Code Enforcement Board has the power to levy fines up to
$250.00 per day for the first offense and $500.00 for the second
offense against the property, if a violation is found to exist
beyond the date set by the Board for compliance. If the violation
is corrected and then recurs or if the violation is not corrected
by the time specified for correction by the code inspector, the
case may be presented to the enforcement board even if the
violation has been corrected prior to the board hearing.
You have the right to obtain an attorney at your own expense
and to present witnesses in your behalf. If you desire to have
witnesses, subpoenaed or if you have questions regarding the
procedure, please contact Linda Kilis, Secretary of the Code

designated authorized agent of the city and placed in a shelter for a period of not less than three
(3) days nor more than seven (7) days, except the animal may be released sooner upon
identification and compliance with the registration requirements contained herein, and upon the
payment of a. twenty dollar ($20.00) fee plus an additional $7.00 per day for the redemption of
said animal. The registration fee for unregistered dogs or cats that have been picked up shall be
double the fee in effect on the date the dog .or cat is picked up.

Sec. 4-23. Any unregistered dog or cat found in the city shall be picked up by the city or the
designated authorized agent of the city and placed in a shelter for a period of not less than three
(3) days nor more than seven (7) days, except the animal may be released sooner upon
identification and compliance with the registration requirements contained herein, and upon the
payment of a twenty dollar ($20.00) fee plus an additional $7.00 per day for the redemption of
said animal. The registration fee for unregistered dogs or cats that have been picked up shall be
double the fee in effect on the date the dog or cat is picked up.
If you wish to contest this c tation, contact the Clerk of the -Court, 330 E. Bay Street, Room M-
106, Courthouse, Jacksonvill , FL, Tel. # (904) 630-2070 within 10 days. If you fail to pay the
designated penalty or obtain court date within 10 days, you will be deemed to have waived your

Dear Ms. Luciano:
The Code Enforcement Board of the City of Atlantic Beach was
created pursuant to Florida Statutes and exists for the purpose of
facilitating the enforcement of the Code of Ordinances. It is
comprised of seven citizens, residents of Atlantic Beach, who meet
regularly to hear allegations of code violations.
You are hereby notified and ordered to appear at the next
public hearing of the Code Enforcement Board on TUESDAY, the 9th
day of November, 1999, AT 7:30 P. M. at Atlantic Beach City Hall,
800 Seminole Road, to answer and be heard to the alleged violations
of the following Sections) : Chapter 4 Section 4 -3 0 (b) , Failure to
pay Animal Control Citation. It is alleged that you are in
violation of the above enumerated code section(s) in that you have
failed to pay the prescribed fine of $25.00 within 14 days of
issuance of the citation resulting in the fine increasing to
$50.00. Failure to pay any fine may result in a lien against your
home or personal property. Legal Description of property: Lot 9,
Oceanwalk Unit 4, RE#169463-1518.
The Code Enforcement Board has the power to levy fines up to
$250.00 per day for the first offense and $500.00 for the second
offense against the property, if a violation is found to exist
beyond the date set by the Board for compliance. If the violation
is corrected and then recurs or if the violation is not corrected
by the time specified for correction by the code inspector, the
case may be presented to the enforcement board even if the
violation has been corrected prior to the board hearing.
You have the right to obtain an attorney at your own expense
and to present witnesses in your behalf. If you desire to have
witnesses, subpoenaed or if you have questions regarding the
procedure, please contact Linda Kilis, Secretary of the Code
Enforcement Board within five days of the receipt of this notice at
247-5810. Please note the presence of a court reporter for the
purpose of insuring a verbatim record in the event of an appeal
should be secured at your expense.

Pursuant to Fl S.S. 162. 07 (2) the following charges for prosecuting this case before the Code
Enforcement Board shall be charged to each violator provided they be found in violation. Such
costs may be included in a lien authorized under s. 162.09 (3) if not paid within 30 days. A
certified copy of an order imposing a fine may be recorded in the public records and thereafter
