Exh 3B~-- AGENDA ITEM #3B AUGUST 12, 2002 CITY OF ATLANTIC BEACH CITY COMMISSION STAFF REPORT AGENDA ITEM: "PODS" and zoning regulations applicable to such temporary storage ;~""' structures ~- SUBMITTED BY: Sonya Doerr, AICP n _ Community Development Director DATE: July 24, 2002 _ BACKGROUND: The use of these temporary storage structures has recently become fairly' common since this company introduced the product to the Jacksonville. While our zoning- regulations do not. clearly address this type of structure, Chapter 24 provides provisions related to Accessory " `~ Structures and storage structures that may be reasonably construed to apply to "PODS." Our regulationsdo not distinguish between temporary and permanent storage structures, and while the ,''"" definition of Accessory Structures refers to structures that are constructed, this term generally includes anything that is placed, erected, built or installed on a Lot. PODS are available in two standards sizes, .both exceeding the 80 square feet exemption provided in the below definition, and therefore may be ~""" considered as Accessory Structures. / Accessory Structure shall mean any Structure .constructed on a Lot, not attached to the Principal Structure, and ancillary to the Principal Structure. Pump houses for exterior well pumps not exceeding nine (9) square feet in area and four (4) feet in height shall not be considered Accessory Structures.. " Pump houses larger than nine (9) square feet or four feet in height shall be considered as a Private ,~,,, Garage. for the purpose of determining height and area regulations. This definition shall not include ` Fences, Hedges and Walls, storage structures not exceeding ei,~hf (8) feet in height and eighty (80) `° square feet, children's play equipment, pet houses and Landscape elements provided such are otherwise in compliance with the requirements of this Chapter. C ~ -. « Accessory Structures are further addressed in Section 24-151 (2) iii. of the zoning regulations, which states: Accessory Uses and Structures shall not be located within Required Front. Yards and shall not ~""' be closer than five (S) feet from any Lot Line. w If the Commission concurs that this is an appropriate application of these regulations, PODS-could not '^ be placed within the required twenty (20} foot front yard on residential lots and would have to be at least five (5) feet from any property line. ('This would effectively prohibit their placement in most residential driveways.) Alternatively, the Commission-may wish to consider "that such structures- are ~+ generally placed. upon lots for only a short period of time, and may provide a needed service :with no a adverse impact when maintained on a lot for only a short duration. There are currently no time i~ ' limitations that would be applicable to these structures regardless of where they are allowed to be ~.,,, placed. The Commission may wish to consider the implementation of regulations that would limit the ` amount of time such structures may be maintained on a residential lot. It is staff's opinion that the use of these structures for long term or permanent storage in residential areas is not consistent with the Purpose and Intent of Chapter 24. ~, BUDGET: No budget issues involved with this item. `""" RECOMMENDATION: Direct staff to draft an ordinance amending the zoning regulations to define PODS as temporary Accessory Structures and permit these to be placed on residential lots for. a period not to exceed four (4) days or ninety-six (96) hours. ~- " ATTACHMENTS: None..
