The Code Enforcement Board of the City of Atlantic Beach was
created pursuant to Florida Statutes and exists for the purpose of
facilitating the enforcement of the Code of Ordinances. It is
comprised of seven citizens, residents of Atlantic Beach, who meet
regularly to hear allegations of code violations.
You are hereby notified and ordered to appear at the next
public hearing of the Code Enforcement Board on WEDNESDAY, the 5th
day of November, 1997 AT 7:30 P. M. at Atlantic Beach City Hall,
800 Seminole Road, to answer and be heard to the alleged
violation(s) of the following Section(s): Chapter 12.Section 12-1-
8, Fence Collapsing and Section 23-36, Vegetation, High Grass and
Weeds of the Code of the City of Atlantic Beach.
It is alleged that you are in violation of the above enumerated
code section(s) in that there exists on the premises located at 725
Atlantic Boulevard (RE# 171363-0000 and 171364-0000 aka Government
Royal Palms Unit 2A Lots 1 and 2, Block 16 , Plat Book 7655 Page
624 ) the City of Atlantic Beach, the following condition(s): high
grass and weeds and collapsing fence.
The Code Enforcement Board has the power to levy fines up to
$250.00 per day for the first offense and $500.00 for the second
offense against the property, if a violation is found to exist

RE: Kent Theaters/Atlantic Theaters
Representatives of Kent Theaters appeared at the August 19, 1997 Community
Development Board meeting to explain their delays in completing the required
landscaping of the Atlantic Theaters site. They noted that they had been pursuing joint
installation with a prospective tenant next door and that they fully intended to install all
of the landscaping required. The Community Development Board inquired as to a
reasonable timeframe for the work to be completed and was told that sixty days would
be sufficient. After some deliberation the Board agreed to recommend that the Code
Enforcement Board allow Kent Theaters sixty days to complete the landscaping. The
Board also recommended that the Code Enforcement Board impose the maximum
allowable fines if the work is not completed within the sixty day period.
The Community Development Board recognizes the authority of the Code
Enforcement Board in determining if a violation exists and in determining appropriate
punishment. The above recommendation is offered for your consideration only.
