CODE ENFORCEMENT BOARD MINUTES
NOVEMBER 12, 2002

The meeting was called to order at 7:30 p.m. by Chairman Sanders, followed by the Pledge of
Allegiance by all present.
Chairman Sanders requested that the roll be read. Secretary Shearer read the roll and determined
that there was a quorum.
1. Approval of the Minutes of the Regular Meeting held on September 3, 2002.
Following a brief review of the minutes, a motion was made by Board Member Wynkoop,
seconded by Board Member Mann and unanimously carried to approve the minutes of the
Code Enforcement Board Meeting of September 3, 2002.
2. Recognition of Visitors and Guest regarding any matters not listed on the agenda.
There were no visitors or Guests present
3. Unfinished Business from previous meeting:
NON-COMPLIANCE:
Case No.: 651-01, Kelly & Ruth Wilson, 615 Atlantic Blvd., Atlantic Beach, FL,
Chapter 17, Section 17-9 BUSINESS SIGN EXTENDING ABOVE CITY RIGHT
OF WAY
Mr. Sherrer reviewed the findings from the previous meeting and hearing regarding the Wilsons.
He stated that as of the date of this meeting the sign is still in violation, no extension was
requested, the administrative fees were not paid and he had received no communication from
Kelly or Ruth Wilson.

Mr. Sherrer gave these recommendations to the Board:
a. Levy a fine of $2,500 against Kelly & Ruth Wilson for failure to comply with the Boards
Order dated September 6, 2002.
b. Grant 60 days to pay the fine, and if not paid by January 13, 2003, file a lien against the
property located at 615 Atlantic Boulevard, Atlantic Beach, Florida.
c. Grant an additional 14 days to the Wilsons to correct the violation.
d. Direct the City to remove the illegal sign if not corrected by November 26, 2002 and
charge all reasonable costs for the removal to the Wilsons.
e. File a lien against the property at 615 Atlantic Boulevard for the past due administrative
fees. (The administrative fees in the amount of $495.83 were paid on November 13,
2002).
Motion by Board Member Mann to accept all of the recommendations set forth by Mr.
Sherrer. Seconded by Peter Wykoop. Carried Unanimously.
4. Public Hearing:
No hearings scheduled.
5. New Business:
Mr. Sherrer commented on the monthly Code Enforcement Report for October 2002. He
pointed out that signs; abandoned vehicles and housing issues (tenants) were the most
frequent violations.
Discussion regarding the dates of the Code Enforcement Meetings ensued and Mr. Sherrer
recommended changing future meetings to the 2°a Tuesday of their scheduled months. The
Board unanimously agreed on this recommendation.
Mr. Sherrer stated that a special called meeting may take place on December 10, 2002 for the
purpose of hearings on new violations.

The Board briefly discussed the monthly Code Enforcement Report "Attachment A".

7. Adjournment:
There being no further discussion or business to come before the Board, the meeting
adjourned at 7:55 p.m.

ORDER IMPOSING FINE
Based upon the Affidavit of Non -Compliance, and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the
City of Atlantic Beach, it is hereby ORDERED:
THAT the Respondents pay $2,500 for failure to comply with the Board's
Order dated September 6, 2002.
THAT the Respondents have 60 days from November 12, 2002 to pay this
fine, and if not paid by January 13, 2003 a lien shall be filed against the
property located at 615 Atlantic Boulevard, Atlantic Beach, Florida.
THAT the Respondents have an additional 14 days from November 12,
2002 to correct the violation.
THAT the City will remove the illegal sign and charge all expenses to the
Respondents if the violation is not corrected by November 26, 2002.
Failure to comply with this Order within the specified, time will result in
the recordation of this Order Imposing Fine, which constitutes a lien upon any
real or personal property owned by the violators and maybe foreclosed, and
your property sold to enforce this lien. If such lien is filed, you will be
assessed all costs incurred in recording and satisfying this lien. ,
The Code Enforcement Board is authorized to foreclose, collect, or
settle said lien using any legal or equitable remedies available, after three (3)
months from the filing of any lien, which remains unpaid.
This Order becomes self-executing upon being filed with the
Atlantic Beach City Clerk's Office and a hearing shall not be necessary.

CODE ENFORCEMENT BOARD MEETING
The Regular Meeting of the City of Atlantic Beach Code Enforcement Board will be
held on Tuesday, January 14, 2003, at 7:30 p.m. in the Commission Chambers, 800
Seminole Road, Atlantic Beach, Florida.
All persons interested are notified to be present at said time and place and they shall
be heard. If a person decides to appeal any decision at any meeting or hearing, he
will need a record of the proceedings, and for such purpose may need to ensure that
a verbatim record of the proceedings is made, which record shall include the
testimony and evidence upon which appeal is to be based.
