Dear Property Owner:
Please be advised, the City of Atlantic Beach Code of Ordinances includes rules and regulations
governing construction activities and also maintenance standards for property within the City. These
standards are set forth in the International Property Maintenance Code and the Florida Building Code
and are made part of the City of Atlantic Beach Code of Ordinances in Chapter 6, Article II, Section 6-
16.
A code enforcement inspection at 605 PLAZA was conducted on 5/9/2019. The City of Atlantic Beach
Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of
Ordinances:
1. VIOLATION CODE: Sec. 24-106. Residential, single family dwelling district(RS-2) (b)
Permitted uses. The uses permitted within RS-2 zoning district shall be: (1) Single family dwellings.
NATURE OF VIOLATION: The house was originally built as a single family home and has been
subdivided into multiple units.
2.VIOLATION CODE: Sec. 6-16. Adoption of Florida Building Code. There is hereby adopted,
subject to any modifications,changes and amendments set forth in this article, and for the purpose of
establishing rules and regulations for the construction, alteration,removal, demolition,equipment,use
and occupancy, location and maintenance of buildings and structures, including permits and penalties,
that certain building code known as The Florida Building Code established by Florida Statutes Chapter
553, Part VII, as amended from time to time so that the latest edition of the Florida Building Code shall
apply and the International Property Maintenance Code,most recent edition. in the office of the city
clerk, and the same are adopted and incorporated as fully as if set out at length in this article,and the
provisions thereof shall be controlling in the construction of all buildings and other structures within the
city.
NATURE OF VIOLATION: No permits that would be required by the Florida Building Code to alter
the home can be found in City records. It appears load bearing walls were moved and electrical wiring
was altered without any permits or inspections. Exposed Romex wiring was seen over the bar in the
kitchen.
3.VIOLATION CODE: Sec. 703.1 Fire-resistance-rated assemblies. The required fire-resistance
rated of fire-resistance-rated walls, fire stops, shaft enclosures, partitions and floors shall be maintained.
NATURE OF VIOLATION: The walls used to separate the units are not fire-resistance rated.
4. VIOLATION CODE: IPMC 504.1 General. Plumbing fixtures shall be properly installed and
maintained in working order, and shall be kept free from obstructions, leaks and defects and be capable
of performing the function for which such plumbing fixtures are designed. Plumbing fixtures shall be
maintained in a safe, sanitary and functional condition.
NATURE OF VIOLATION: High moisture content was found on the back wall of the closet of the
tenant's child's bedroom adjacent to the bathroom indicating a leak in the plumbing system.
5. VIOLATION CODE: IPMC 603.1Mechanical equipment and appliances.Mechanical equipment,
appliances, fireplaces, solid fuel-burning appliances, cooking appliances and water heating appliances
shall be properly installed and maintained in a safe working condition, and shall be capable of
performing the intended function.
NATURE OF VIOLATION: The HVAC air handler in the closet is used as a return-air plenum,but is
not sealed, allowing moisture, dust, and attic air to be pulled into the HVAC system.
This home has been declared an Unlawful Structure by the Building Official for the City of
Atlantic Beach. IPMC 108.1.4 Unlawful structure-An unlawful structure is one found in whole or in
part to be occupied by more persons than permitted under this code, or was erected, altered or occupied
contrary to law. Please see attached memo.
This letter requests that the noted violation(s) be corrected by obtaining permits and restoring the
home to a single family dwelling unit, compliant with all codes, within thirty (30) days of the
receipt of this notice. The structure may not be maintained as a multi-family unit.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may
result in this case being referred to the Special Magistrate resulting in fines up to two hundred fifty
dollars ($250.00) per day. Upon completion of the action required, it is your responsibility to contact me
and arrange for an inspection to verify compliance. Please contact Atlantic Beach Code Enforcement at

This memo documents our visit to 605 Plaza, at 9:00 am,this morning, May 9, 2019.
The single-family dwelling appears to be divided into three dwelling units.
The renter occupying the largest part of the house invited us in to inspect the premises.
My observations include:
1. The house was originally built as a single-family dwelling, Group R-3, and is located in a
Residential, Single-Family Zoning District(RS-1).
2. As currently used,the three-unit residential building would be a Group R-2 Occupancy. No
permits are found, in City records for adding units or changing Occupancy Group from R-3 to
R-2. Building permits are required for the above changes.
3. It appears that load-bearing walls were structurally altered without building permits or
inspections.
4. It appears that electrical wiring was done without permits or inspection.
5. The walls used to separate units are not fire-resistance rated.
6. High moisture readings were found(over 19%) in one wall adjacent to a bathroom in an
adjoining unit.
7. The HVAC air handler closet is used as a return-air plenum, but is not sealed, allowing
moisture, dust, and attic air to be pulled into the HVAC system.
8. The electric panel and air handler are located in the inspected unit. Electric and HVAC for the
other units could not be observed.
9. Based on Items 1 —8, above, I consider this building to be an Unlawful Structure, per the 2018
IPMC, Section 108.1.4, with Unsafe Conditions, per the 2018 IPMC, Section 305, throughout
the interior of the'inspected unit.

infestation, questionable coding and permits. We now have health issues.
Landlord too busy and doesn';t seem to have integral work ethic.
Unfortunately been living here for 2 yrs because we want to live at beach.
