155ORDINANCE NO. / 5-6 AN ORDINANCE Fixing, Imposin,,7, and levying a Reasonable Garbage Collection Fee Upon Every Owner, Lessee, Permittee, or Agent in Charge of Any Property, Serviced by the Garbage Col- lection Force of the Town of Atlantic Beach, Duval County, Florida; and Prescribing Civil Remedies for the Delinquency of Any Such Fee; and Repealin` All Ordinances and Parts of Ordinances in Conflict Herewith. BE IT ORDAINED BY THE MAYOR AND TOWN COUP?CIL OF THE TOWN OF ATLk"TIC BEACH, DUVAL COUNTY, FLORIDA: Section 1: There is herein and hereby fixed, imposed and levied, in the manner, according to the schedule and definitions, and under the circumstances subsegaently set forth, and upon every owner, lessee, permittee, or agent in charge of any real property ser- viced by the garbage collection force of the Town of Atlantic Beach, Duval County, Florida, a reasonable fee for such service. Section 2. For the purposes and within the purview of this Ordinance the following definitions shall prevail: 1. "Residence A Unit". A residence A unit is a residence occupied by and the place of abode of a single family where one kitchen only is provided and maintained. 2. "Residence B Unit". A residence B unit is a residence or residences located on one plot and occupied by and the place of abode of more than one but not more than three families and where more than one but not more than three kitchens are provided and main- tained. 3. "Residence C Unit". A residence C unit is a residence or residences located on one plot occupied by and the place of abode of as many as four but not more than 10 families, and where as many as four but not more than 10 kitchens are provided and m^.in- tained. 4. "Commercial A Unit". A commercial A unit is any business establishment, store, house or shop other than a grocery or food store. ':7ithin this classification_ are, by way of example, amusement houses, drug and sundry stores, dry goods and hard goods stores, package houses and bars, filling stations, food pro- cessors and manufacturing establishments. 5. "Commercial B Unit". A commercial B unit is any restaurant or any bar having a seating capacity for less than ;5 persons. u. "Coi nercial C Unit". A commercial C unit is any restaurant or any bar having a seating capacity for 25 or more persons. 7. "Commercial D TTnit" . A commercial D unit is any large food or grocery store or super -market. 8. "Commercial D-1 Unit". A commercial D-1 unit is any small food or grocery store. 9. "Corir,lerc ial 7' Unit". A commercial unit is any hotel which operates less than 6 mo the in the calendar year. 10. "Commercial 1' Unit". A cop,-ffE rc ial F unit is any hotel which operates more than 6 months in the calendar year. Section 'the fee for the collection of garbage from the respective residence nd commercial units _s heieinabove uefined is hereby fixed and levied as follows: Residence A shall be '13.00 annually Residence B shall be ,33.25 annually Residence C shall be $36.00 annually Commercial A shall be X20.00 annually Coi.mercial B shall be 20.00 annually Commercial C shall be X36.00 annually Commercial D shall be 72.00 annually Commercial D-1 shall be `20.00 annually Commercial L shall be -46.00 annually Commercial r shall be X100.00 annually Section 4. a;very such garbage collection fee shall be computed initially for the 12 -month period beginnin- July 1, 1953, and shall be payable for each and every 12 -month period thereafter. Every such fee shall be due and payable July lst of each year beginning July 1, 1953, and shall become delinquent if not paid within 30 days thereafter. The said Town of Atlantic Beach may discontinue its garbage collection service to any property or unit, the owner, lessee, permittee or agent in charge of which has alloyed any fee imposed here- under to become delinquent; and the said Lown may recover the amount of any such delinquent fee by due process of law. Section 5. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 6. This ordinance shall ta:ce effect July 19 1953.
