AN ORDINANCE Finding and Declaring that, during
the entire period from 8 o'clock A. M. to 7
o'clock P. 111. of each day, beginning May lst
and continuing to and including September 30th
in each year, it is necessary for the Public
Safety and Welfare, that all that area of the
Ocean Beach within the corporate limits of the
Town of Atlantic Beach, Florida, Lying Southerly
of the Prolongation Easterly of the northerly
line of the Seawall to the low water mark of the
Atlantic Ocean and Northerly of the Prolongation
Easterly to said low water mark of the Northerly
line of Lot 5, Block 36, Atlantic ,'each, according
to plat recorded in Plat Book 5, page 69 of the
current public records of Duval County, Florida,
be Established as a Safety Zone; Establishing
such Brea as a Safety Zone for the use of persons
engaged in Bathing, Sun -Bathing, Games, Fishing
and similar Recreational Activities; Prohibiting
the Operation of Vehicles of all kinds and the
Driving and Riding of Animals on or within said
Area; Providing for the erection and maintenance
of suitable barricades or obstructions to prevent
the entry of Vehicles into said Area; and Providing
Penalties for the Violation of this Ordinance; and
Repealing Ordinance !,Jo. ADI and all Ordinances
in Conflict herewith.
BE IT ORDAINED by the Mayor and Town d ouncil of
the Town of Atlantic Beach, Florida:
Section 1. The iayor and Town Council of the Town
of Atlantic Beach, Florida, after full investigation,
have found and hereby declare that, during the entire
period from 8 o'clock A. ltii. and 7 o'clock P. of each
day, beginninCDg i11ay lst and continuing to and including
September 30 in each year, it is necessary for the public
safety and welfare that all that area of the Ocean Beach
within the corporate limits of the Town of Atlantic -Beach,
Florida lying Sout'ierly of the prolongation Easterly of
the Northerly line of the Seawall to the low water mark
of the Atlantic ocean and iuortherly of the prolongation
Easterly to said low water mark of the Northerly line of
Lot 5, Block 36,Atlantic Beach, according to plat recorded
in Plat Boob: 5, pa{e 69 of the current public records of
Duval County, Florida, be established as a safety zone
for the use of persons engaged in bathing, sun-bathing,
games, fishing and similar recreational activities, and that
vehicular traffic within said area be prohibited; and the said
area is hereby established as a safety zone for the uses afore-
said.
Section 2. It shall be unlawful for any person to
propel, operate, or drive any -power -driven vehicle cr any
vehicle drawn by a draft animal, or to ride any animal, at
any time within the hours of 8 o'clock A. TSI. and 7 o'clock
P. i' on any day beginning iiay lst and continuing to and in-
cluding aeptember 30th of each year, within that area of the
Ocean Beach within the corporate limits of the said Town of
Atlantic Beach, Florida lying Southerly of the prolonl,-ation
Easterly of the Northerly line of the Seawall to the low
water mark of the atlantic Ocean and Northerly of the prolong-
ation Easterly to the said low water mark of the Northerly line
of Lot 5, block 36, titlantic Beach, according to plat recorded
in Plat Book 5, page 69 of the current public records of Duval
County, Florida.
Section 3. There shall be erected and maintained at
all times during the hours and period as set forth in erection
2 hereof, and the Town Manager is hereb- directed to erect and
maintain during all said times, a suitable obstruction or
barricade along the Northerly and Southerly lines of said
area hereinbefore described, to prevent the entry therein of
vehicles and other traffic prohibited by this ordinance.
Section 4. any person violating any of the provisions
of this ordinance shall upon conviction bc(punisshad)by a

not exceeding 4500.00 or by imprisonment not exceeding 90 days,
or by both such fine and imprisonment.

Section 5. Ordinance PIo.O/ and all ordinances
and parts of ordinances in conflict herewith are hereby repealed.
