An Ordinance requiring that upon the issuance
of any permit for construction or improvement
of property in the Town of Atlantic Beach,
there shall be deposited with the Town the
sum of $50.00 to secure and indemnify the Town
against damage to public property arising out
of the work done in or about said construction
or improvement
BE IT ORDAINED by the Mayor and Town Council of the
Town of Atlantic Beach, Florida:
Section 1. All persons or corporations hereafter apply-
ing for any permit for the construction upon or improvement
of any land or premises in the Town of Atlantic Beach shall,
before such permit shall be granted, deposit with the Town
Clerk the sum of $50.00 cash to be held by the Town as security
for and to indemnify the Town against any damage which may be
done by anyone engaged in or contributing to the work involved
1! in such construction or improvement.
Section 2. It shall be the duty of the Town , and
he shall upon the completion of any construction or improvement
for which a permit has been issued, t -e -ascertain whether any
damage or injury has been done or occasioned to any sidewalk
or other town property by anyone engaged in or contributing to

said construction or improvements, and if any such damage or
injury has been found to have been done or occasioned, said
Town Manager shall, as soon as practicable, cause the said
town property to be repaired and restored and the cost thereof
shall be paid out of said deposit required under Section 1 above,
insofar as the same may reach, all persons liable therefor to be
and remain liable therefor to the Town for any excess in the
Ii costs of said repair or restoration. If no damage is found to
have been caused or occasioned to said Town property, or in the

event the cost of repair and restoration is less than the amount
of said deposit, then the said deposit, or such hart thereof as
is not required forsaid repair or restoration, as the case may
be, shall be refunded to said depositor.
Section 3. This Ordinance shall take effect immediately
upon its passage and approval by the Mayor.
