AN ORDINANCE Providing that no building
permit shall be issued for the construction
of any bui_ding or structure in which sanitary
facilities or plumbing will be installed, or
in which such facilities are required by ordi-
nace of the Town of Atlantic Beach to be
installed, until a permit for the construction
of a sanitary disposal system shall have first
been obtained; providing for the issuance of
such permit; and regulating the construction
and use of sewage disposal systema, establish
a fee for the issuance of such permit; and
providing a penalty for the violation thereof.
BE IT ORDAINED by the Mayor and Town Council of the Town
of Atlantic Beach, Florida:
Section 1. No building permit for the construction
of any building or structure in which sanitary facilities or
plumbing will be installed, or is required by ordinance of the
Town of Atlantic Beach to be installed, shall be issued until
a permit for the construction and use of a sewage disposal
system is first obtained.
Section 2. Any person desiring to construct in the
Town of Atlantic Beach a sewage disposal system, shall make
application to the Building Inspector of the Town for a permit
to construct such system. There shall be submitted with such
application plans, specifications and elevations for the en-
tire system and the floor plan of the building or structure
to be serviced by such system, together with such other data
as the Building Inspector may deem necessary in order to :-nake
the determination required to be made by him under Section 3
hereof. Said application shall be accompanied by ai application
to the County Health Unit of Duval County, Florida, for a
permit for the construction of said system in the form as
required by said.Unit.
Section 3. Upon receipt of the application for permit
as hereinabove provided for, the Building Inspector shall
inspect the site on which the applicant proposes to construct
said disposal system and the building or structure to be ser-
viced thereby, and shall make such investigation as he shall
deem necessary to ascertain and determine whether the proposed
system when constructed will'be in all respects adequate for
the purpose intended, will function oroperly, and will conform
to all of the requirements of Ordinance No. 85 of the Town of
Atlantic Beach and Chapter 5 of the Florida State Sanitary
Code. If the Building Inspector shall find and determine that
the proposed system will meet the requirements aforesaid, he
shall then forward to the said Duval County Health Unit the
applicant's ,Dplication to it for a permit for said system,
together with his recommendation to said Unit that t^e permit
so applied for be granted, and shall at the same time advise
the applicant of his action in the premises. If the Building
Inspector shall find and determine that the said proposed
system will not meet the requirements aforesaid, he shall
advise the applicant that the permit applied for is denied.
Section 4. In the event the Building of
the Town shall have approved the application for permit so
made to said Duval County Health Unit, and the said Duval
County Health Unit shall have issued a permit for the construc-
tion of said disposal system, said Building F,,o6t shall
then issue a permit for the construction of said disposal
system on behalf of the Town.
Section 5. Every disposal system shall be constructed
strictly in accordance with plans and specifications, eleva-
tions and data submitted with the application for the permit
for the construction of the same, and upon which such permit
was granted.

Section 6. Upon completion of construction of said
system and before any part thereof is covered with earth, said
system shall be inspected by the Building Inspector of the Town,
and shall be approved by him before put in service, and no
building or structure to be serviced by said system shall be
occupied until such system has first been approved as aforesaid.
Section %. Notwithstanding the issuance of any permit
for the construction of any disposal system and the approval
of the construction thereof by said Building Inspectcr, the
owner, and the contractor who shall have constructed the same
for the owner, shall at all times be and remain responsible
to the Town for the proper functioning of said system, and the
owner shall nevertheless at all times maintain the said system
in accordance with the requirements of Ordinance No. 85 of
the Town of Atlantic Beach, and Chapter 5 of the Florida State
Sanitary Code.
Section 8. Every applicant for a permit for the con-
struction of a disposal system shall pay to the Town, upon
the filing of his application, a fee of $5.00, and in the
event said application is approved and permit granted, the
further sum of $5.00 upon the granting of such permit.
Section g. Any person who shall violate any provision
of this Ordinance, shall upon conviction thereof be vunished
by fine in a sum not to exceed G or by imprisonment
for a period not to exceed 30 days, or both such fine and
imprisonment.
