AN ORDINANCE Providing for the connecting of
Sewer Disposal Facilities in private Residences
with the Sewer System of the Town of Atlantic
Beach in the Subdivision of Selva i,iarina, Units
No. 1 and No. 2, and adjacent territory; Providing
the conditions under which said connections shall
be made; and Fixing and establishing Fees and
Charges to be paid for the privilege of connection
with and using said Sewer System
BE IT ORDAINED by the Mayor and Town Council of the
Town of Atlantic Beach, Florida:
Section 1. From and after the effective date of this
Ordinance any person desiring to connect sewerage disposal
facilities or plumbing in premises owned by such person with
the Sewerage Disposal System of the Town of Atlantic Beach,
Florida in the Subdivision of Selva Marina, Units No. 1 and
No. 2, and adjacent territory, shall first make application
to the Town Manager for a permit so to do, stating therein
the proposed location of all pipes, pipe lines and equipment
to be laid or installed for such purpose, the character and
style of the materials and equipment to be used, and the pro-
posed manner of doing the work. All such connecting lines shall
be constructed of such material and equipment and in such manner
as to comply with and conform to the specifications and require-
ments of the State Board of Health of Florida and all ordinances
of the Town of Atlantic Beach governing the same, and shall be
first inspected and approved by the Town Manager before the same
shall be put in use or operation.
Section 2. No permit for any connection with said sewer
disposal system shall be granted unless the same may properly
be granted under and pursuant to the agreement heretofore en-
tered into between the said Town and the Selva Marina Realty
Company, under which and pursuant to which the said system was
conveyed to the Town; and all permits which may be granted
hereunder shall be granted only upon compliance by the applicant
with all of the requirements of said agreement, and payment
of such sums, if any, as may be required by or provided in said
agreement.
Section 3. The following fees and service charges are
herebv imposed, _levied and establ-shed, and scall be paid
for the privilege of connecting with and using said sewerage
disposal system of said Town:
a) In all cases where it is necessary to construct any
line or facility between the property lines and said System of
said Town, such line shall be constructed by the Town or under
the supervision and direction of the Town Manager, and the
applicant shall first pay or secure to the Town the cost of
such work before the same is commenced, and in addition shall
a
pay/tap fee of JO o for each separate connection, such fee
to be paid upon the granting of the permit;
b) An annual service charge for each housing unit of
X30.00, payable in auarterly installments in advance on the
first day of January, April, July and October in each year,
beginning with the year 1957; provided that where any unit is
connected to said System for less than a full quarterly period,
the installment for such period shall be reduced proportionate-
ly. Should any service charge not be paid within(30) .
days after the same becomes due and payable, the same shall
bear interest at the rate of ten per cent per annum until paid.
The 'Town Council may by resolution direct the Town Manager to
disconnect or cause to be disconnected from said System any
line or connection thereto for which the charge aforesaid shall
not have been paid within the time as herein required. The

disconnecting of any such line shall not relieve the owner
of the premises involved, or any occupant thereof, from the duty
to comply with the requirements of any ordinance of said Town
requiring that such premises be provided with approved excreta
disposal facilities, and that the same be maintained. The
Town Council may also by resolution direct the Town Manager
to disconnect or cause to be disconnected water supplied by the
Town to the premises involved until said service charge is p aid.
Section 4. Any person who shall connect or cause to be
connected any plumbing or sewer facility with said Disposal
System, without first complying with all of the requirements
of this Ordinance, shall upon conviction thereof be punished
by fine of not more than v6500.00, or by imprisonment of not
more than 90 days, or by both such fine end imprisonment, in
the discretion of the Court.
