AN ORDINANCE Finding and Declaring that, during
the entire period from 8 o' clod A. to 7
o'clock P. Til. of each day, beginning 1.1ay lst
and continuing to and including September 30th
in each year, it is necessary for the Public
Safety and 1, elfare, that all that area of the
Ocean Beach within the corporate limits of the
Town of Atlantic Beach, Florida, Lying Southerly
of the Prolongation Easterly of the Southerly
line of Fifteenth Street to the low water mark
of the ritlantic Ocean and northerly of the Pro-
longation Easterly to said low water mark of the
Northerly line of Lot 5, Block 36, Atlantic Beach,
according to plat recorded in Plat Book 5, page
69 of the current public records of Duval County,
Florida, be Established as a Safety Lone;
Establishing, such Area as a Safety Lone for the
use of persons engaged in Bathing, Sun -Bathing,
Games, Fishing and similar Recreational Activities;
Prohibiting the Operation of Vehicles of all kinds
and the Driving and Riding of Animals on or within
said Area; Providing for the erection and maintenance
of suitable barricades or obstructions to prevent the
entry of Vehicles into said Area; and providing
Penalties for the Violation of this Ordinance.
BE IT ORDAINED by the vsayo r and Tovrn Council of the
Town of Atlantic Beach, Florida:
Section 1. The Mayor and Town Council of the Town of
Atlantic Beach, Florida, after full investigation, have found
and hereby declare that, during the entire period from 8 o'clock
A.•. and 7 o'clock P. i-_. of each day,beginning T:ay lst and
continuing to and including September 30 in each year, it is
necessary for the public safety and welfare that all that area
of the Ocean Beach within the corporate limits of the Town of
Atlantic Beach, Florida lying Southerly of the prolongation
Easterly of the Southerly line of Fifteenth Street to the low
water mark of the Atlantic Ocean and Northerly of the prolonga-
tion Easterly to said low water mark of the northerly line of
Lot 5, Block 36, Atlantic Beach, according to plat recorded in.
Plat Book 5, page 69 of the current public records of Duval
County, Florida, be established as a safety zone for the use
of persons engaged in bathing, sun-bathing, games, fishing and
similar recreational activities, and that vehicular traffic
within said area br-prohibited; and the area is hereby estab-
lished as a safety zone for the uses aforesaid.
JSection 2. It shall be unlawful for any person to pro-
pel, operate, or drive any power -driven vehicle or any vehicle
drawn by a draft animal, , or to ride any animal,
at any time within the hours of 8 o'clock A. 1 and 7 o'clock
on any day beginning May 1st and continuing to and in-
cluding September 30th of each vear, within that area of the
Ocean Beach within the corporate limits of the said Town of
A-dantic Beach, Florida lying Southerly of the prolongation
Easterly of the Southerly line of Fifteenth Street to the low
water mark of the Atlantic Ocean and Northerly of the prolonga-
tion Easterly to said low water mark of the Northerly line of
Lot 5, Block 36, Atlantic Beach, according to plat recorded in
Plat Book 5, page 69 of the current oublic records of Duval
County, Florida.
Section 3. There shall be erected and maintained at
all times during the hours and period as set forth in Section
2 hereof, and the Town Manager is hereby directed to erect and
maintain during all said times, a suitable obstruction or
barricade along the Northerly and Southerly lines of said
area hereinbefore described, to prevent the entry therein of
vehicles and other traffic prohibited by this ordinance.
Section 4. Any person violating any of the provisions
of this ordinance shall upon conviction be punished by a fine
not exceeding ,; .Dp.o or by imprisonment not exceeding 4_
days, or by both such fine and imprisonment.
Section 5, All Ordinances in conflict herewith are to
the extent of such conflict hereby repealed.
