The resulting lots will be: Western Lot: 50 feet by 140 feet. Known as the eastern 50 feet of Lot 28, Block 4 of Atlantic Beach Subdivision "A". and Eastern Lot: 75 feet by 140 feet. Known as the western 25 feet of Lot 24 and Lot 26, Block 4 of Atlantic Beach Subdivision "A". This decision is based on the evidence you provided that Lot 28, Block 4 of the Atlantic Beach Subdivision "A" did exist independently as a 50 foot wide, rectangular lot. Initially there were concerns about the status of Lot 28 based on the legal description used to define it today. It has been determined that when the Milbert Homes Subdivision was platted, the western portion of Lot 28 was used to create the some of the new lots. The remaining eastern 50 feet of Lot 28 was represented as an independent lot. Before formal approval can be granted, a few conditions must be met. A survey showing that the existing structure will not cross the proposed property lines and that it also meets current setback requirements. If the structure will cross the proposed property lines or will not meet current setback requirements, then a nonconforming structure would be created. Under the city's code, a division of land cannot create a nonconforming structure. In order to approve the proposed property division, the existing structure must be made conforming by altering the structure to a point that it conforms or demolish the entire structure. Once all conditions are met, the city can grant formal approval. I watched the Commission workshop on September 17 re: the update on the Kinley Horn project re: the rewrite of our Land Development Regulations. During that workshop, you outlined some "hot topics". One of those was re: splitting of lots. Your comments got my attention. I rewatched that meeting this past weekend. My mother passed in December 2013. As executor of her estate, I had a fiduciary responsibility to get the maximum valuation of her property for her heirs. As a result, I corresponded with both Jeremy Hubsch and Derek Reeves about whether or not the land on which the house was built in 1947 could go back to its original plat lines, assuming the house was demolished. I was told it could. So, as Executor, after receiving the approval from COAB, I advertised the property to be sold. Ossi Builders made a large and the highest offer for the property. Ultimately, I decided I wanted the opportunity/option to live on the property that my family had owned for 50 years. So, to be able to do this, I had to match their offer and then purchase it from the estate/my siblings. I did this based on the assumption I would be able to demolish the house and end up with two buildable lots ... one 50 x 140 and the other 75 x 140... so I could build on one and, if desired, could sell the other which would help finance the building of my own home. I am attaching the letter Jeremy Hubsch, the former AB Community Development Director, sent me. I would like assurance that, in light of how COAB is currently administering their understanding of our code and the pending rewrite of the land development regulations, I will have no issues in fulfilling my desire to demolish the house on the current property and splitting the lots into two buildable lots, as outlined in Mr. Hubsch's letter to me.
