ThompSori, Chief of Police/DPS BACKGROUND: On October 28, 2002, the City Commission recognized that structures in Bull Park were being damaged by skateboarders. To prevent further damage to the facilities, the Commission concurred that skateboarding in Bull Park should be discontinued. To .provide a foundation for the enforcement of a prohibition against skateboarding in Bull Park, an ordinance has been drafted for consideration.. When drafting the proposed ordinance, staff adapted language from municipal ordinances from other Florida cities. Additionally, staff provided a broader application of the limitations to include facilities including, but not limited, to Bull Park. The language includes: "Skateboarding is prohibited on City owned. and controlled property in and around all City parks and buildings, including the parking lots adjacent to them." This includes City Hall, the Public Safety Building, the Public Works Building, Utility Plants, all City Parks, and the parking lots around these facilities. This language provides a more comprehensive approach than simply addressing one problem in one location. The proposed ordinance also provides'a mechanism for the designation of areas for skateboarding within these locations as long as it has been so designated by the City Manager, Parks and Recreation Director, or by ordinance. Please see the specific language below: Sec. 5-32 Skateboarding on City Property a. Definitions 1. Skateboard is defined as a board made of wood, fiberglass, or other material or combination of materials mounted on two axles, front and rear, with two wheels made of clay~polyurethane or other material or combination of materials attached to each axle. The term "skateboard" al_so_includes motorized skateboards propelled by a motor mounted on the skateboard. AGENDA ITEM #8I NOVEMBER 11, 2002 2. Skateboarding is defined as lying, sitting, squatting, kneeling or standing upon a skateboard and propelling oneself by any means which causes the skateboard to move, including but not limited to: jumping on a skateboard; being pulled or pushed while situated on a skateboard• pushing the ground or other surface with one foot while keeping one's other foot on the skateboard; by riding a skateboard from one elevation to a lower elevation; b manipulating the skateboard with one's feet or by operation of a motor mounted on a skateboard. b. Prohibitions 1. Skateboarding is prohibited on City owned and controlled property in and around all City parks and buildings including the parking lots adiacent to them. 2. The prohibitions in this sectiori do not apply to skateboarding in areas specifically designated for such purpose by the City Manager, City Ordinance, or the Director of Parks and Recreation. This proposed language is intended to recognize and confirm the intent of the City Commission relative to limiting skateboarding on City property. The language maybe easily be altered and modified to reflect the wishes of the City Commission.
